Agnihotri, J\n\n\n\n\n\n\n       Dated:24\/07\/2009\n\n\n\n:       Judgment\n\n\n----------------------------------------------------------\n----------------------------------\n                       ORDER (ORAL)\n<\/pre>\n<p>            (Passed on 24th day of  July, 2009)<\/p>\n<p>  1.   By  this petition, the petitioner seeks a direction<\/p>\n<p>       against the Family Court, Bilaspur, wherein the petitioner<\/p>\n<p>       is not happy with the conduct of the Family Court. This<\/p>\n<p>       petition  is  preferred under Article  226  of  the<\/p>\n<p>       Constitution of India.\n<\/p>\n<p>  2.   It is well settled that no writ can be issued against<\/p>\n<p>       any judicial authority. Article 227 has been incorporated<\/p>\n<p>       in  the Constitution of India, which gives power of<\/p>\n<p>       superintendence to the High Court over all subordinate<\/p>\n<p>       Courts and tribunals to interfere with the order passed by<\/p>\n<p>       the  Courts  below in such cases where  perversity,<\/p>\n<p>       illegality, irregularity or jurisdictional error is writ<\/p>\n<p>       large on the face of the record. It is not in dispute that<\/p>\n<p>       the petitioner seeks a direction to the Family Court, in<\/p>\n<p>       conduct of the proceedings, which is subordinate to the<\/p>\n<p>       High Court. Thus, the only remedy, which may be available<\/p>\n<p>       to  the  petitioner, is under Article  227  of  the<\/p>\n<p>       Constitution of India, not under Article 226.<\/p>\n<p>  3.   A  Bench  of nine Hon&#8217;ble Judges of Hon&#8217;ble Supreme<\/p>\n<p>       Court of India, in <a href=\"\/doc\/1643138\/\">Naresh Shridhar Mirajkar v. State of<\/p>\n<p>       Maharashtra and<\/a> another1, in respect of jurisdiction of<\/p>\n<p>       the High Court to issue writ against a civil court,<\/p>\n<p>       observed as under:\n<\/p>\n<blockquote><p>           &#8220;63..The ultimate proposition is set out  in<br \/>\n           the terms: &#8220;Certiorari does not lie to quash<br \/>\n           the  judgments of inferior Courts  of  civil<br \/>\n           jurisdiction&#8221;.   These  observations   would<br \/>\n           indicate that in England the judicial orders<br \/>\n           passed    by   civil   Courts   of   plenary<br \/>\n           jurisdiction  in or in relation  to  matters<br \/>\n           brought  before  them are  not  held  to  be<br \/>\n           amenable to the jurisdiction to issue  writs<br \/>\n           of certiorari.&#8221;\n<\/p><\/blockquote>\n<p>  4.   Recently, in Radheshyam and another v. Chhabi  Nath<\/p>\n<p>       and others2, the Hon&#8217;ble Supreme Court, after having<\/p>\n<p>       considered Surya Devi Rai, observed as under:<\/p>\n<blockquote><p>           &#8220;31.  Under Article 227 of the Constitution,<br \/>\n           the  High  Court does not issue  a  writ  of<br \/>\n           certiorari.  Article 227 of the Constitution<br \/>\n           vests  the  High  Courts  with  a  power  of<br \/>\n           superintendence  which   is   to   be   very<br \/>\n           sparingly  exercised to keep  tribunals  and<br \/>\n           courts within the bounds of their authority.<br \/>\n           Under Article 227, orders of both civil  and<br \/>\n           criminal courts can be examined only in very<br \/>\n           exceptional  case when manifest  miscarriage<br \/>\n           of  justice has been occasioned. Such power,<br \/>\n           however, is not to be exercised to correct a<br \/>\n           mistake of fact and of law.\n<\/p><\/blockquote>\n<blockquote><p>           32.   The  essential  distinctions  in   the<br \/>\n           exercise of power between Articles  226  and<br \/>\n           227  are well known and pointed out in Surya<br \/>\n           Devi   Rai   and  with  that  we   have   no<br \/>\n           disagreement.  But we are  unable  to  agree<br \/>\n           with  the  legal proposition  laid  down  in<br \/>\n           Surya  Devi Rai that judicial orders  passed<br \/>\n           by  a  civil court can be examined and  then<br \/>\n           corrected\/reversed by the writ  court  under<br \/>\n           Article 226 in exercise of its power under a<br \/>\n           writ  of certiorari. We are of the view that<br \/>\n           the aforesaid proposition laid down in Surya<br \/>\n           Devi  Rai,  is  contrary  to  the  ratio  in<br \/>\n           Mirajkar and the ratio in Mirajkar  has  not<br \/>\n           been overruled in Rupa Ashok Hurra.&#8221;\n<\/p><\/blockquote>\n<p>  5.   Accordingly,  this petition under  Article  226  is<br \/>\n       dismissed as not maintainable. However, in the interest of<br \/>\n       justice, liberty is reserved to the petitioner to take<br \/>\n       recourse to the remedy, available under provisions of law,<br \/>\n       if so advised.\n<\/p>\n<p>                                                     JUDGE<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chattisgarh High Court Smt.
