Justice P.R.RAMACHANDRA MENON\n\n Dated :08\/09\/2010\n\n O R D E R\n                         C.K.ABDUL REHIM, J\n                  ---------------------------\n                     W.P(C) No. 26784 of 2010-W\n             Dated----------------------------2010.\n                   this the 8th day of September,\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner has approached this Court aggrieved by the coercive<\/p>\n<p>steps initiated under the Securitization and Reconstruction of<\/p>\n<p>Financial Assets and Enforcement of Security Interest Act, 2002<\/p>\n<p>(SARFAESI Act). The petitioner availed a cash credit facility as well as<\/p>\n<p>a term loan from the respondent Bank, with respect to his business<\/p>\n<p>activities.  Consequent to default committed in repayments, the<\/p>\n<p>Bank initiated proceedings under the SARFAESI Act and the Chief<\/p>\n<p>Judicial Magistrate Court was approached invoking Section 14(1) of<\/p>\n<p>the Act. Ext.P2 is the notice issued by the Advocate Commissioner<\/p>\n<p>appointed by the Chief Judicial Magistrate Court, requesting the<\/p>\n<p>petitioner to handover possession of the immovable property, which<\/p>\n<p>is a secured asset.\n<\/p>\n<p>      2.    Eventhough various contents are raised against the<\/p>\n<p>proceedings, learned counsel for the petitioner submitted that the<\/p>\n<p>petitioner is ready and willing to regularize the loan account by<\/p>\n<p>effecting payment of the outstanding dues, within a reasonable<\/p>\n<p><span class=\"hidden_text\">W.P(C) No. 26784 of 2010-W           2<\/span><\/p>\n<p>time. The said proposal was not opposed by the respondent Bank.<\/p>\n<p>       3.    Under the above circumstances, eventhough interference<\/p>\n<p>on merits on the challenges raised in this writ petition is not at all<\/p>\n<p>possible, I am inclined to show indulgence in permitting to<\/p>\n<p>regularize the loan account.\n<\/p>\n<p>       4.    In the result, the writ petition is disposed of directing the<\/p>\n<p>respondents to keep dispossession of the petitioner pursuant to<\/p>\n<p>Ext.P2 notice in abeyance for a period of one month. The petitioner<\/p>\n<p>is permitted to make payment of the entire amount outstanding in<\/p>\n<p>the loan account (overdue amount) within the said period. If such<\/p>\n<p>amounts are remitted the respondent Bank shall regularise the loan<\/p>\n<p>account and permit the petitioner to continue payment as per the<\/p>\n<p>original terms of the loan accounts.\n<\/p>\n<p>       5.
