In\u00a0the\u00a0present\u00a0two\u00a0cases,\u00a0the\u00a0only\u00a0issue\u00a0before\u00a0the\u00a0Commission\u00a0is\u00a0whether\u00a0the\u00a0name\u00a0of\u00a0the\u00a0<br \/>\nperson\u00a0making\u00a0a\u00a0request\u00a0for\u00a0a\u00a0chartered\u00a0flight\u00a0can\u00a0be\u00a0withheld\u00a0under\u00a0the\u00a0RTI\u00a0Act.\u00a0\u00a0In\u00a0brief\u00a0the\u00a0facts\u00a0<br \/>\nof\u00a0the\u00a0case\u00a0are\u00a0that\u00a0in\u00a0the\u00a0month\u00a0of\u00a0April,\u00a02010,\u00a0there\u00a0were\u00a0news\u00a0items\u00a0in\u00a0the\u00a0newspapers\u00a0reporting\u00a0<br \/>\nthat\u00a0a\u00a0scheduled\u00a0flight\u00a0was\u00a0aborted\u00a0less\u00a0than\u00a012\u00a0hours\u00a0before\u00a0its\u00a0departure\u00a0to\u00a0allow\u00a0the\u00a0aircraft\u00a0to\u00a0<br \/>\nbe\u00a0deployed\u00a0as\u00a0a\u00a0chartered\u00a0flight.\u00a0\u00a0In\u00a0this\u00a0regard\u00a0the\u00a0Appellant,\u00a0while\u00a0seeking\u00a0other\u00a0information\u00a0in\u00a0<br \/>\nconnection\u00a0with\u00a0this\u00a0incident\u00a0sought\u00a0the\u00a0name\u00a0of\u00a0the\u00a0person\u00a0making\u00a0the\u00a0request\u00a0for\u00a0the\u00a0chartered\u00a0<br \/>\nflight,\u00a0as\u00a0mentioned\u00a0in\u00a0the\u00a0news\u00a0report.\u00a0\u00a0The\u00a0PIO\u00a0denied\u00a0this\u00a0information\u00a0under\u00a0Section\u00a08(1)(e)\u00a0of\u00a0<br \/>\nthe\u00a0RTI\u00a0Act.\u00a0 \u00a0Aggrieved\u00a0with\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0Respondent\u00a0the\u00a0Appellant\u00a0has\u00a0approached\u00a0this\u00a0<br \/>\nCommission\u00a0for\u00a0disclosure\u00a0of\u00a0the\u00a0name\u00a0of\u00a0the\u00a0person\u00a0making\u00a0the\u00a0request\u00a0for\u00a0the\u00a0charted\u00a0flight.\u00a0\n<\/p>\n<p>         Parties\u00a0heard.\u00a0 \u00a0The\u00a0Respondent\u00a0during\u00a0the\u00a0hearing\u00a0submit\u00a0that\u00a0the\u00a0name\u00a0of\u00a0the\u00a0person\u00a0<br \/>\nrequesting \u00a0 for\u00a0 the \u00a0 chartered \u00a0 flight \u00a0 cannot \u00a0 be \u00a0 disclosed\u00a0 under \u00a0 the \u00a0 RTI \u00a0 Act,\u00a0 as \u00a0 the \u00a0 sought \u00a0 for\u00a0<br \/>\ninformation\u00a0includes\u00a0commercial\u00a0confidence\u00a0the\u00a0disclosure\u00a0of\u00a0which\u00a0would\u00a0harm\u00a0their\u00a0competitive\u00a0<br \/>\n position.\u00a0\u00a0The\u00a0Appellant,\u00a0on\u00a0the\u00a0other\u00a0hand,\u00a0submits\u00a0that\u00a0no\u00a0commercial\u00a0confidence\u00a0is\u00a0involved\u00a0in\u00a0<br \/>\nthe\u00a0disclosure\u00a0of\u00a0the\u00a0sought\u00a0for\u00a0information\u00a0and\u00a0moreover\u00a0even\u00a0exempted\u00a0information\u00a0can\u00a0be\u00a0<br \/>\ndisclosed\u00a0under\u00a0sub\u00adsection\u00a02\u00a0of\u00a0the\u00a0Section\u00a08\u00a0of\u00a0the\u00a0RTI\u00a0Act,\u00a0if\u00a0public\u00a0interest\u00a0in\u00a0disclosure\u00a0<br \/>\noutweights\u00a0harm\u00a0to\u00a0the\u00a0protected\u00a0interests.\u00a0\u00a0He\u00a0further\u00a0submits\u00a0that,\u00a0as\u00a0per\u00a0the\u00a0news\u00a0reports,\u00a0the\u00a0<br \/>\nscheduled\u00a0flight\u00a0was\u00a0allegedly\u00a0aborted\u00a0before\u00a0its\u00a0departure\u00a0to\u00a0allow\u00a0the\u00a0aircraft\u00a0to\u00a0be\u00a0deployed\u00a0as\u00a0a\u00a0<br \/>\nchartered \u00a0flight\u00a0for\u00a0conveying\u00a0some\u00a0IPL\u00a0players\u00a0from\u00a0Chandigarh\u00a0to\u00a0Chennai,\u00a0in\u00a0violation\u00a0of\u00a0<br \/>\nRules.\u00a0 \u00a0During\u00a0the\u00a0proceedings\u00a0of\u00a0the\u00a0hearing,\u00a0parties\u00a0point\u00a0out\u00a0some\u00a0inadvertent\u00a0errors\u00a0in\u00a0the\u00a0<br \/>\nprevious\u00a0case\u00a0No.\u00a0CIC\/SS\/C\/2010\/000427,\u00a0to\u00a0the\u00a0effect\u00a0that\u00a0there\u00a0is\u00a0a\u00a0wrong\u00a0date\u00a0in\u00a0the\u00a0order\u00a0and\u00a0<br \/>\nalso\u00a0to\u00a0the\u00a0effect\u00a0that\u00a0it\u00a0had\u00a0been\u00a0wrongly\u00a0mentioned\u00a0in\u00a0the\u00a0order\u00a0that\u00a0the\u00a0PIO\u00a0had\u00a0failed\u00a0to\u00a0respond\u00a0<br \/>\nto\u00a0the\u00a0RTI\u00a0application\u00a0of\u00a0Sh.\u00a0Subhash\u00a0Chander\u00a0Agrawal,\u00a0thought\u00a0in\u00a0fact\u00a0the\u00a0PIO\u00a0had\u00a0responded.\u00a0\n<\/p>\n<p>        After\u00a0hearing\u00a0the\u00a0parties\u00a0and\u00a0on\u00a0perusal\u00a0of\u00a0the\u00a0relevant\u00a0documents\u00a0on\u00a0file\u00a0and\u00a0also\u00a0keeping\u00a0<br \/>\nin\u00a0view\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0of\u00a0the\u00a0present\u00a0case,\u00a0the\u00a0Commission\u00a0is\u00a0of\u00a0the\u00a0view\u00a0that\u00a0public\u00a0<br \/>\ninterest\u00a0in\u00a0disclosure\u00a0of\u00a0the\u00a0sought\u00a0for\u00a0information\u00a0outweights\u00a0the\u00a0harm\u00a0to\u00a0the\u00a0protected\u00a0interest,\u00a0as\u00a0<br \/>\nimpropriety\u00a0and\u00a0favouritism\u00a0in\u00a0aborting\u00a0the\u00a0flight\u00a0on\u00a0the\u00a0behest\u00a0of\u00a0an\u00a0influential\u00a0person\/persons,\u00a0in\u00a0<br \/>\nviolation\u00a0of\u00a0the\u00a0rules,\u00a0has\u00a0been\u00a0alleged\u00a0by\u00a0the\u00a0Appellant\u00a0and\u00a0in\u00a0the\u00a0news\u00a0reports\u00a0provided\u00a0by\u00a0him.\u00a0\u00a0\n<\/p>\n<p>        In\u00a0view\u00a0of\u00a0the\u00a0above,\u00a0in\u00a0the\u00a0interest\u00a0of\u00a0transparency\u00a0and\u00a0accountability,\u00a0the\u00a0PIO\u00a0is\u00a0hereby\u00a0<br \/>\ndirected \u00a0 to \u00a0 disclose \u00a0 the \u00a0 name \u00a0 of \u00a0 the \u00a0 person\/body\/ \u00a0 organization \u00a0 making \u00a0 the \u00a0 request \u00a0 for \u00a0 the\u00a0<br \/>\nchartered\u00a0flight\u00a0and\u00a0also\u00a0provide\u00a0a\u00a0copy\u00a0of\u00a0the\u00a0rules\u00a0to\u00a0the\u00a0Appellant,\u00a0permitting\u00a0the\u00a0authorities\u00a0to\u00a0<br \/>\naccede\u00a0to\u00a0such\u00a0a\u00a0request,\u00a0\u00a0within\u00a010\u00a0days\u00a0of\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0\n<\/p>\n<p>        The \u00a0 inadvertent \u00a0 errors \u00a0 in \u00a0 the \u00a0 previous \u00a0 order \u00a0 dated \u00a0 28.10.2010, \u00a0 in \u00a0 case \u00a0 No.\u00a0<br \/>\nCIC\/SS\/C\/2010\/000427\u00a0stands\u00a0rectified\u00a0to\u00a0the\u00a0effect\u00a0that\u00a0the\u00a0matter\u00a0was\u00a0heard\u00a0on\u00a027.10.2010\u00a0and\u00a0<br \/>\nthe\u00a0PIO\u00a0had\u00a0responded\u00a0to\u00a0the\u00a0RTI\u00a0application\u00a0of\u00a0Shri\u00a0Subhash\u00a0Chandra\u00a0Agarwal.\n<\/p>\n<p>
