S.J. MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nland belong to one deceased Hiralal Parshottamdas Patel. He applied<br \/>\nfor permission to sell the land to the appellant. By order dated<br \/>\n13.12.1981, the authorities permitted him to sell the land on two<br \/>\nconditions namely, (i) application for use of non-agriculture purpose<br \/>\nshould be made within 6 months from the date of transfer of land, and\n<\/p>\n<p>(ii) the land should be put to non-agriculture use within 3 years<br \/>\nfrom the date of the order.\n<\/p>\n<p>2.\tIn<br \/>\nview of such conditional permission, said deceased Hiralal<br \/>\nParshottamdas Patel sold 35 Gunthas of land in favour of the<br \/>\nappellant on 31.5.1982, but no construction was made over the land<br \/>\nfor years together.\n<\/p>\n<p>3.\tUnder<br \/>\nthe Bombay Tenancy &amp; Agricultural Lands Act, 1948 provisions have<br \/>\nbeen made to withdraw the permission to sell the property or to<br \/>\ncancel the same, if conditions are not fulfilled. Having not<br \/>\nfulfilled the conditions, proceedings under Section 84-C of the<br \/>\nBombay Tenancy &amp; Agricultural Lands Act, 1948 was initiated by<br \/>\nnotice dated 16.11.1985. The matter was challenged and reached<br \/>\nfinality upto Supreme Court where the appellant lost.\n<\/p>\n<p>4.\tAfter<br \/>\nhaving lost in the proceedings under Section 84-C of the Act, after<br \/>\nmore than 13 years, the appellant preferred a revision application<br \/>\nunder Section 211 of the Bombay Land Revenue Code in the year 2007<br \/>\nagainst the orders, which were passed on 1.9.1994 and 14.11.1994.<br \/>\nSuch application having filed, as the petition being time barred, it<br \/>\nwas dismissed, which is also confirmed by the learned Single Judge.\n<\/p>\n<p>5.\tWe<br \/>\nhave heard the counsel for the appellant and Ms. Call, learned AGP,<br \/>\nfor the State.\n<\/p>\n<p>6.\tIt<br \/>\nis not in dispute that the final orders which were passed on 1.9.1994<br \/>\nand 14.11.1994 were not challenged by the appellant for more than 13<br \/>\nyears. The proceedings under Section 84-C also reached finality when<br \/>\nappellant lost before the Supreme Court. It is also not in dispute<br \/>\nthat no construction has been made on the land in question even till<br \/>\ndate. In the facts and circumstances, no relief can be granted. In<br \/>\nabsence of any merits, the appeal is dismissed.
