Advocate\n\nHon'ble Kashi Nath Pandey,J.\n<\/pre>\n<p>This revision has been filed against the judgement<br \/>\nand order dated 9.12.02, passed by Sri Mahendra<br \/>\nNath Judicial Magistrate Ist District Bhadohi in case<br \/>\nno. 62 of 2001Smt. Pramila Devi Vs. Indrajeet Singh.<br \/>\nBy the impugned order the learned Magistrate<br \/>\nallowed the application under section 125 Cr.P.C.<br \/>\nand awarded the maintenance to Smt. Pramila Devi,<br \/>\nopposite party no. 2 and her minor child at the rate of<br \/>\nRs. 400\/- and Rs. 300\/- per month respectively for<br \/>\ntheir maintenance from the date of the judgement<br \/>\ndated 9.12.02. The amount of maintenance to the<br \/>\ndaughter Jaya is to be paid till her marriage.<br \/>\nI have heard Sri Sharad Chandra Upadhyay, holding<br \/>\nthe brief of Sri H.N. Singh, learned counsel for the<br \/>\nrevisionist at the stage of admission and have gone<br \/>\nthrough the grounds of revision.\n<\/p>\n<p>The impugned order has been challenged only on the<br \/>\nground of facts. It has not been challenged on<br \/>\naccount of any error of procedure or substantive law.\n<\/p>\n<p>Learned counsel for the revisionist argued that the<br \/>\nlearned lower court did not consider the ground of the<br \/>\nrevisionist on the point of fact that without any proper<br \/>\nreason the opposite party no. 2 is living separately<br \/>\nwhereas the revisionist is ready to maintain her with<br \/>\n her minor daughter. There is no substantive evidence<br \/>\nin support of the allegations of the opposite party<br \/>\nno.2 that she was thrown out of the house of the<br \/>\nrevisionist. There is no any evidence on the point of<br \/>\ndemand of dowry. They have one son Aditya and<br \/>\ndaughter Jaya. The son is living with him whereas<br \/>\nwithout any proper reason opposite party no. 2 is<br \/>\nliving separately with her daughter in her father&#8217;s<br \/>\nhouse since long. On the point of income of the<br \/>\nrevisionist there is no evidence. He is doing business<br \/>\nof tea shop earning a little amount. For his own<br \/>\nmaintenance he is dependent upon his father.\n<\/p>\n<p>The revisionist has filed a divorce petition under<br \/>\nsection 13 of the Hindu Marriage Act in which<br \/>\nopposite party no. 2 appeared before the court below<br \/>\nand filed her written statement, as such in reaction<br \/>\nshe has filed the petition under section 125 Cr.P.C.<br \/>\nunder Sub Sectioin 4 of the Section 125 Cr.P.C. She<br \/>\nis not entitled for any maintenance as without any<br \/>\nsufficient reason she refused to live with her<br \/>\nhusband\/revisionist inspite of best efforts made by<br \/>\nthe revisionist for keeping her with him. The court<br \/>\nbelow did not consider the statement of the<br \/>\nwitnesses adduced by the revisionist on the point of<br \/>\nincome. The revisionist is ready to maintain his<br \/>\nwife\/opposite party no. 2 with her daughter Jaya.\n<\/p>\n<p>The court while exercising the revisional power will<br \/>\nnot go into the merits of the fact concluded by the<br \/>\nlearned trial court. The revisional court can interfere<br \/>\n on the point of fact only on the ground of perversity, if<br \/>\nthe conclusion drawn by the learned lower court is<br \/>\nagainst the evidence on record, only then on the<br \/>\npoint of fact the court of revision can interfere. At the<br \/>\ntime of argument learned counsel does not challenge<br \/>\nthe proceedings on any error of procedure. There is<br \/>\nno any error of substantive law. The only ground left<br \/>\nfor consideration is the interference on account of<br \/>\nperversity of judgement in none of the grounds of<br \/>\nrevision. It has been alleged that the conclusion<br \/>\ndrawn by the learned lower court is against the<br \/>\nevidence on record. There is nothing to hold that the<br \/>\nconclusion on the point of fact can be said to be<br \/>\nperverse. I have gone through the impugned<br \/>\njudgment and order. The marriage of the revisionist<br \/>\nwith opposite party no. 2 is admitted. It is also<br \/>\nadmitted that the minor daughter Jaya is their<br \/>\ndaughter.\n<\/p>\n<p>According to the petition filed under section 125<br \/>\nCr.P.C. the revisionist and members of his family<br \/>\nwere not satisfied on account of the non fulfilment of<br \/>\ndowry demand. They were demanding colour TV,<br \/>\nscooter, fridge and Rs. 10,000\/- as cash from her<br \/>\nparents. They felt ill when she expressed their<br \/>\ninability to fulfil the demand of dowry. In the result<br \/>\nthey subjected her to mental and physical torture.<br \/>\nThey had also snatched her stridhan i.e. clothes,<br \/>\njewellery, Rs. 20,000\/- cash. They became more and<br \/>\nmore aggressive doing inhuman treatment towards<br \/>\nher. They used to beat her and threatened to remarry<br \/>\n the revisionist. She was turned out with her daughter<br \/>\nJaya and compelled her to come to her parents<br \/>\nhouse.\n<\/p>\n<p>She has no source of income to maintain herself and<br \/>\nher daughter. The revisionist has proper source of<br \/>\nincome of about Rs. 20,000\/- per month or more.<br \/>\nAccordingly she demanded Rs. 5000\/- for herself and<br \/>\nfor her daughter from her husband.\n<\/p>\n<p>All the above allegations have been denied by the<br \/>\nrevisionist\/husband    stating   that   he   belongs   to<\/p>\n<p>backward class, educated up to 4th standard and<br \/>\nbelongs to a poor family. No demand of dowry. He is<br \/>\nmaintaining his son who is living with him. He is also<br \/>\nready to maintain his daughter and wife. She is<br \/>\nhabitual of luxurious life that is why she is not living<br \/>\nwith him. She is under undue influence of her Behnoi,<br \/>\nthat is why she used to ignore her husband. He went<br \/>\nto her parents house for taking her but he was<br \/>\nabused by her parents and threatened to remarry<br \/>\nher. He was ill treated by her in presence of her<br \/>\nBehnoi, therefore, he has filed a suit for divorce in the<br \/>\nFamily Court at Allahabad.\n<\/p>\n<p>It is the discretion of the trial court to believe or<br \/>\ndisbelieve the version adduced by the parties. It is<br \/>\nnot the subject of the revisional court to substitute its<br \/>\nown finding in the finding of the trial court, if there is<br \/>\nevidence adduced by the applicant which has been<br \/>\nbelieved by the learned trial court then it is beyond<br \/>\nthe scope of the revisional court to interfere with the<br \/>\n finding of the trial court.\n<\/p>\n<p>The petitioner has examined herself as PW1 and in<br \/>\nsupport of her allegation PW2 Gulab Shankar, P.W..3<br \/>\nRati Lal have been examined. In rebuttal in support<br \/>\nof the objection filed by the revisionist he himself has<br \/>\nbeen examined as DW1 and in his support Pankaj as<br \/>\nDW2 and Jamuna            Das as DW3 have been<br \/>\nexamined. She has specifically stated that she had<br \/>\ngone to her husband&#8217;s house and performed her duty<br \/>\nas his wife, but they were demanding colour TV,<br \/>\ngolden chain, Rs. 10,000\/- in cash and on her failure<br \/>\nof fulfilment of the demand of dowry they ill treated<br \/>\nher, began to beat her from time to time, snatched<br \/>\nher clothes and jewelleries and cash. They did not<br \/>\nprovide her proper food, threatened her for second<br \/>\nmarriage of the revisionist. She was thrown out of her<br \/>\nhusband&#8217;s house with her daughter and that is why<br \/>\nshe was compelled to live with her father.\n<\/p>\n<p>P.W.2 Gulab Shankar her uncle and PW3 Rati Lal<br \/>\nher father have supported the above version which<br \/>\nhas been believed by learned trial court reaching to<br \/>\nthe conclusion that there was sufficient cause for her<br \/>\nliving separately from her husband. Learned lower<br \/>\ncourt believed that her husband is not maintaining<br \/>\nher and her daughter. The above evidence adduced<br \/>\nby the husband was disbelieved by the learned trial<br \/>\ncourt. Learned trial court disbelieved that he is ready<br \/>\nto maintain his wife and daughter. According to his<br \/>\nown version he himself has filed a suit for divorce<br \/>\n making allegations against chastity of the lady with<br \/>\nher Behnoi about her illicit relations, is also a type of<br \/>\ntorture, although her Behnoi visited his house only<br \/>\nonce and did not stay there even a single night. He<br \/>\ndoes not know the residence of her Behnoi. Thus the<br \/>\nallegations of illicit relations have not been believed<br \/>\nby the court below. Learned trial court did not believe<br \/>\nDW2 who has stated that on the request of Indrajeet<br \/>\nhe is adducing evidence. He has stated the fact as<br \/>\nhas been told by Indrajeet. He is not related with the<br \/>\nfamily of Indrajeet. He had formal introduction with<br \/>\nIndrajeet at the betel shop. DW2 has got no personal<br \/>\nknowledge regarding the family affairs of Indrajeet.<br \/>\nDW2 has been treated to be a chance witness. Thus<br \/>\nthe court below disbelieved the allegations of illicit<br \/>\nrelations of his wife with her Behnoi on the point of<br \/>\ntorture. Learned court below believed the petitioner&#8217;s<br \/>\nversion. She has also been believed on the point of<br \/>\ndemand of dowry as well as mental and physical<br \/>\ntorture. Learned trial court reached to the conclusion<br \/>\nthat even on the ground of assault on the character<br \/>\nof his wife is a sufficient ground for her separate<br \/>\nliving, it amounts to mental torture. Learned lower<br \/>\ncourt has referred ACC 1998 page 887 in support of<br \/>\nthe above conclusion. On the point of source of<br \/>\nincome the learned court below found that the<br \/>\nrevisionist is able to pay the maintenance amount of<br \/>\nRs. 700\/- per month, which is a petty amount, which<br \/>\ncan be given by the revisionist for maintenance of his<br \/>\nwife and daughter, whereas the petitioner is not able<br \/>\n to maintain herself as well as her daughter. The court<br \/>\nbelow did not believe DW3 on the point of her doing<br \/>\nthe business of tea shop. Learned trial court treated<br \/>\nDW3 as a chance witness, who cannot be believed.<br \/>\nThus the judgement passed by the trial court is<br \/>\nbased on evidence on record, which can not be said<br \/>\nto be perverse from any corner.\n<\/p>\n<p>Considering the above facts the revision is liable to<br \/>\nbe dismissed at the stage of admission.\n<\/p>\n<p>The revision is dismissed.
