Justice S.S.SATHEESACHANDRAN\n\n Dated :17\/09\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n       W.P.(C).Nos.23558 AND 25732 OF 2009\n           --------------------------\n    Dated this the 17th day of September 2009\n      -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>            These two writ petitions are filed in<\/p>\n<p>respect of a suit O.S No. 358\/2000 on the file of<\/p>\n<p>the 2nd Additional Sub Court, Kozhikode.  The above<\/p>\n<p>suit admittedly was instituted by a firm for a<\/p>\n<p>decree of prohibitory injunction, nearly nine years<\/p>\n<p>ago.  Subsequently the plaintiff moved an amendment<\/p>\n<p>application so as to seek additional relief of<\/p>\n<p>settlement of accounts and recovery of money.  Case<\/p>\n<p>canvassed  in  this  writ  petition  is  that  such<\/p>\n<p>amendment was allowed only in 2007 pursuant to<\/p>\n<p>judgment passed by this court in a writ petition.<\/p>\n<p>When the case came up in the list for trial, since<\/p>\n<p>the plaintiff was not prepared to prosecute the<\/p>\n<p>suit, it was dismissed for default.  An application<\/p>\n<p>moved by the plaintiff to restore the suit under<\/p>\n<p>Order 9 Rule 9 of Code of Civil Procedure was also<\/p>\n<p>W.P.(C).Nos.23558          Page numbers<br \/>\nAND 25732 OF 2009<\/p>\n<p>dismissed by the trial court.          In the appeal<\/p>\n<p>preferred against that order of dismissal fixing a<\/p>\n<p>time   limit    for the  disposal    of the  suit  the<\/p>\n<p>District Judge allowed the appeal.     The trial court<\/p>\n<p>was directed to dispose the suit before 30\/08\/2009.<\/p>\n<p>An application moved for extension of time before<\/p>\n<p>the learned District Judge for disposal of the suit<\/p>\n<p>was   disallowed.     Impeaching   the  propriety and<\/p>\n<p>correctness of that order in the interlocutory<\/p>\n<p>application passed by the learned Sub Judge, writ<\/p>\n<p>petition No.23558\/2009 has been filed.       Meanwhile<\/p>\n<p>an application was moved before the trial court<\/p>\n<p>stating that the firm has been reconstituted and so<\/p>\n<p>much so, some other persons who have obtained<\/p>\n<p>interest over the firm have to be substituted in<\/p>\n<p>the place of the original plaintiff, the firm.<\/p>\n<p>That amendment application was disallowed by the<\/p>\n<p>learned Sub Judge vide Ext.P5 order.     Propriety and<\/p>\n<p>correctness of that order is challenged in the writ<\/p>\n<p>petition No.25732\/2009 by the persons who have<\/p>\n<p>W.P.(C).Nos.23558           Page numbers<br \/>\nAND 25732 OF 2009<\/p>\n<p>sought for such substitution moving for amendment<\/p>\n<p>of the suit.\n<\/p>\n<\/p>\n<p>          2.     I heard the counsel on both sides.<\/p>\n<p>Having regard to the submissions made and taking<\/p>\n<p>note of the facts and circumstances presented, I<\/p>\n<p>find no notice to the respondent is necessary and<\/p>\n<p>it is dispensed with.     The learned counsel for the<\/p>\n<p>petitioner      submitted  that    consequent  to  the<\/p>\n<p>dismissal of Ext.P5 order disallowing the amendment<\/p>\n<p>application      moved   for   substitution   of   the<\/p>\n<p>plaintiff, the suit was also dismissed.      Such being<\/p>\n<p>the position, the orders challenged in the two writ<\/p>\n<p>petitions before this court are not in respect of<\/p>\n<p>any pending suit before the court.       I do not want<\/p>\n<p>to go into the merit of the applications which are<\/p>\n<p>challenged in the present writ petitions in the<\/p>\n<p>circumstances indicated above. But it has to be<\/p>\n<p>stated that the plaintiff firm which has instituted<\/p>\n<p>the suit is sought to be substituted by some other<\/p>\n<p>W.P.(C).Nos.23558           Page numbers<br \/>\nAND 25732 OF 2009<\/p>\n<p>persons who are stated to be the erstwhile partners<\/p>\n<p>of the plaintiff firm by an amendment moved in the<\/p>\n<p>suit.    The relief claimed in the suit included one<\/p>\n<p>for settlement of accounts with the defendant.      How<\/p>\n<p>far   such    an  amendment  could    be allowed  is  a<\/p>\n<p>question to be looked into with reference to the<\/p>\n<p>Partnership Act covering the rights and liabilities<\/p>\n<p>of a firm in respect of contracts entered with<\/p>\n<p>third parties.     In the present writ petition, I do<\/p>\n<p>not want to express any opinion on the proposed<\/p>\n<p>amendment,      since   the  counsel    submitted,   an<\/p>\n<p>application has been moved for restoring the suit<\/p>\n<p>which was dismissed for default.
