Justice ANTONY DOMINIC\n\n Dated :25\/03\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                         ===============\n                      W.P.(C) NO. 9268 OF 2008 C\n                    ====================\n\n                Dated this the 25th day of March, 2008\n\n                              J U D G M E N T\n<\/pre>\n<p>      The petitioner against whom proceedings have been initiated by the<\/p>\n<p>Bank under the Securitisation and Reconstruction of Financial Assets and<\/p>\n<p>Enforcement of Security Interest Act has approached this court challenging<\/p>\n<p>Ext.P2, a sale notice published by the Bank. It is stated on behalf of the<\/p>\n<p>Bank that about Rs. 8 lakhs is due from the petitioner and although the<\/p>\n<p>petitioner has paid Rs. 4 lakhs after the initiation of the proceedings, the<\/p>\n<p>balance remains unpaid. The counsel only seeks an instalment facility for<\/p>\n<p>discharging the balance liability.\n<\/p>\n<p>      2.     I heard the standing counsel for the Bank as well in this<\/p>\n<p>respect.\n<\/p>\n<p>      3.     Having regard to the submissions made, I dispose of this writ<\/p>\n<p>petition directing that the petitioner shall pay the balance amount due to<\/p>\n<p>the Bank in three equal monthly instalments, first of which will be payable<\/p>\n<p>before 31st of March, 2008 and the second and third instalments will be<\/p>\n<p>payable before 30th of April and 31st of May 2008. Subject to payment as<\/p>\n<p>WPC 9268\/08<br \/>\n<span class=\"hidden_text\">                                     :2 :<\/span><\/p>\n<p>above, further proceedings will stand deferred and in case the petitioner<\/p>\n<p>commits default, the Bank will be free to continue the proceedings that are<\/p>\n<p>already initiated.\n<\/p>\n<p>      Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                             ANTONY DOMINIC,JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.R.
