By filing this writ petition, petitioner<\/p>\n<p>                    desires that his case be considered for appointment<\/p>\n<p>                    as PDS Dealer. For such purpose, petitioner filed<\/p>\n<p>                    application dated 13.10.2004, Annexure-1.<\/p>\n<p>                              3. It is submitted on behalf of the<\/p>\n<p>                    petitioner that till date application dated 13.10.2004,<\/p>\n<p>                    Annexure-1 for appointment as PDS Dealer has not<\/p>\n<p>                    been considered by the authorities.<\/p>\n<p>                              4. Counsel for the State, with reference to<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>the averments made in the counter affidavit duly<\/p>\n<p>affirmed by the Acting Marketing Officer dated<\/p>\n<p>28.6.2006, states that case of the petitioner for<\/p>\n<p>appointment as PDS Dealer was considered but as<\/p>\n<p>he was minor on the relevant date, he was not<\/p>\n<p>granted PDS licence. In addition it is submitted that<\/p>\n<p>father of the petitioner is also a Thela Vender and<\/p>\n<p>two persons in a family cannot be allowed to<\/p>\n<p>become agent of the Government for the purpose of<\/p>\n<p>distribution of commodity.\n<\/p>\n<p>          5. In rejoinder, counsel for the petitioner<\/p>\n<p>submitted that area of operation of the father of the<\/p>\n<p>petitioner is different from the area for which<\/p>\n<p>request has been made by the petitioner for grant of<\/p>\n<p>PDS licence.\n<\/p>\n<p>          6. Aforesaid submissions have been noted<\/p>\n<p>so as to enable the authorities to consider the same<\/p>\n<p>while considering the request of the petitioner<\/p>\n<p>contained in the application dated 13.10.2004,<\/p>\n<p>Annexure-1 and thereafter to pass a reasoned order<\/p>\n<p>either granting\/ refusing PDS licence to the<\/p>\n<p>petitioner. Appropriate orders in this regard be<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>         passed by the Licensing Authority in accordance<\/p>\n<p>         with law, as early as possible, in any case within<\/p>\n<p>         two months from the date of receipt\/ production of a<\/p>\n<p>         copy of this order.\n<\/p>\n<p>                   7.
