Petitioner is raiyat of plot no.5306<\/p>\n<p>                      measuring 0.0.8 dhurs carved out of old plot no.4706 in<\/p>\n<p>                      village      Singhia   within   Rosera   sub-division     of<\/p>\n<p>                      Samastipur district. He has filed this writ petition for a<\/p>\n<p>                      direction to the respondent authorities to ensure<\/p>\n<p>                      removal of encroachment made over the aforesaid land<\/p>\n<p>                      by Sita Ram Singh, respondent no.6. In this connection,<\/p>\n<p>                      he also relied on the report submitted by the Anchal<\/p>\n<p>                      Amin dated 15.3.2003, Annexure-3. Appreciating the<\/p>\n<p>                      report of the Anchal Amin the Circle Officer, Singhia<\/p>\n<p>                      and the Sub-Divisional Officer, Rosera passed orders<\/p>\n<p>                      for removal of encroachment but till date the<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          encroachment made over the lands in question by<\/p>\n<p>          respondent no.6 has not been removed. Petitioner has<\/p>\n<p>          filed this writ petition praying inter alia to direct the<\/p>\n<p>          respondent     authorities    to   ensure     removal   of<\/p>\n<p>          encroachment      from       the   lands     in   question.<\/p>\n<p>          Encroachment made by respondent no.6 is over plot no.<\/p>\n<p>          plot no.5306 measuring 0.0.8 dhurs which is carved out<\/p>\n<p>          from old plot no.4706, which is raiyati land, as such, in<\/p>\n<p>          my opinion, the revenue authorities including the civil<\/p>\n<p>          administration has no jurisdiction to pass orders for<\/p>\n<p>          removal of encroachment made by respondent no.6.<\/p>\n<p>                     3. The writ petition is, accordingly, disposed<\/p>\n<p>          of granting liberty to the petitioner to file suit before<\/p>\n<p>          the civil court of competent jurisdiction for declaration<\/p>\n<p>          of title and recovery of possession over plot no.5306<\/p>\n<p>          measuring 0.0.8 dhurs which has been carved out of old<\/p>\n<p>          plot no.4706 of village Singhia. In the suit petitioner<\/p>\n<p>          should also apply for grant of interim injunction<\/p>\n<p>          restraining respondent no.6 for raising any further<\/p>\n<p>          construction over the lands in question.<\/p>\n<pre>Rajesh\/                            (V.
