      Petitioners are the plaintiffs in a suit for permanent<\/p>\n
prohibitory injunction which had been dismissed for default for<\/p>\n
his nonappearance. An application was moved on the listed day<\/p>\n
of the suit by the plaintiffs for adjournment, but, turning down<\/p>\n
the application suit had been dismissed, submits the counsel for<\/p>\n
the petitioners.   Petitioners\/plaintiffs moved an application for<\/p>\n
restoring the suit. Ext.P8 is the copy of that application. Till the<\/p>\n
dismissal of the suit dismissed for default, according to the<\/p>\n
counsel, an order of interim injunction was in force restraining<\/p>\n
the defendants from filling up the plaint schedule property. After<\/p>\n
the dismissal of the suit the respondents\/defendants are taking<\/p>\n
steps to tamper and fill up the plaint property, is the grievance<\/p>\n
espoused     in the   writ   petition   for   issue  of   appropriate<\/p>\n
direction\/order restraining the respondents\/defendants from<\/p>\n
interfering with that property till disposal of the restoration<\/p>\n
petition moved by the petitioners\/plaintiffs.        I find that the<\/p>\n
W.P.(C).No.35725 of 2009 – O<\/p>\n
                                   2<\/span><\/p>\n
visitorial jurisdiction of this Court cannot be invoked for the relief<\/p>\n
canvassed. However, taking note of the submissions made and<\/p>\n
the facts and circumstances presented, there will be a direction to<\/p>\n
the court below to dispose the restoration application moved by<\/p>\n
the petitioners\/plaintiffs, as expeditiously as possible.     Notice<\/p>\n
given to the counsel for the defendants in the court below on the<\/p>\n
restoration    application    shall be   treated  as  sufficient  for<\/p>\n
conducting the enquiry on that petition so as to dispose it<\/p>\n
expeditiously.\n<\/p>\n
      Subject to the above direction, writ petition is closed. Hand<\/p>\n
over a copy of the judgment to the counsel for the petitioner.<\/p>\n
