SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p> CRIMINAL APPEAL NO.   356 OF 2008<br \/>\n(Arising out of SLP (CRL) No. 2006\/2007)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order passed by a<br \/>\nlearned Single Judge of Jharkhand High Court setting aside<br \/>\nthe order of acquittal recorded by the trial Court in favour of<br \/>\nthe present appellants by allowing the revision filed by<br \/>\nrespondent No.1-Rajesh (hereinafter referred to as the<br \/>\n&#8216;informant&#8217;). Learned counsel for the appellants submitted that<br \/>\nthe approach of the High Court is clearly erroneous. No<br \/>\nreasons have been indicated to show that there was any<br \/>\ninfirmity in the trial Court&#8217;s judgment. In fact, according to<br \/>\nhim, the trial Court&#8217;s judgment was a very detailed one and<br \/>\nample reasons were indicated. \tThe High Court without even<br \/>\npointing out as to what infirmity existed, in a mechanical<br \/>\nmanner directed the matter the matter to be re-heard. Abrupt<br \/>\nconclusion was arrived at that the trial Court had not<br \/>\nappreciated the evidence on record in its right perspective and<br \/>\nby mis-appropriation of evidence, directed acquittal.  It is<br \/>\nsubmitted that it has not been indicated as to how the<br \/>\nevidence has not been appreciated in the right perspective<br \/>\nand\/or how there was mis-appropriation of evidence. It is<br \/>\npointed out that the revision was not maintainable at the<br \/>\ninstance of the complainant. The exercise of revisional<br \/>\njurisdiction has to be within limited parameters. Unless there<br \/>\nare glaring defects in the procedure or manifest errors of law<br \/>\nleading to great mis-carriage of justice, there is no scope for<br \/>\ninterference. It is pointed out that the alleged occurrence took<br \/>\nplace on 20.11.1994 and a complaint was filed after about 13<br \/>\nmonths i.e. on 11.12.1995.\n<\/p>\n<p>3.\tLearned counsel for respondent No.1 submitted that<br \/>\nthough the High Court has not referred to the evidence in<br \/>\ndetail, the conclusions of the trial Court are sufficient to show<br \/>\nthat the appellants were guilty of alleged offence.\n<\/p>\n<p>4.\tThe impugned order of the High Court reads as follows:\n<\/p>\n<p>\t&#8220;Heard.\n<\/p>\n<p>This revision has been filed by the informant<br \/>\nagainst the impugned Judgment by which, the<br \/>\naccused persons were acquitted from the charges<br \/>\nunder Section 364, 366A, 368 and 120B of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>It appears from the impugned Judgment that<br \/>\nthough the trial Court held that the minor girl Sarita<br \/>\nKumari was kidnapped from the lawful guardianship<br \/>\nof her father but by discarding the evidence of P.Ws.<br \/>\non the ground that they are hearsay and further<br \/>\nrejecting the evidence of the prosecutrix Sarita<br \/>\nKumari on the ground that the same was<br \/>\ncontradictory to her statement made under Section<br \/>\n164 Cr.P.C., acquitted the accused persons holding<br \/>\nthat the prosecution failed to produce any reliable<br \/>\nevidence.\n<\/p>\n<p>In my view, the trial Court has not appreciated<br \/>\nthe evidence on record in its right perspective and by<br \/>\nmisappreciation of evidence has acquitted the<br \/>\naccused persons.\n<\/p>\n<p>Accordingly, without giving any specific finding<br \/>\non the evidence on record, the matter is being<br \/>\nremitted to the Trial Court by setting aside the<br \/>\nimpugned order with a direction to the Trial Court to<br \/>\nconsider the materials and evidence on record afresh<br \/>\nin its right perspective and pass a fresh Judgment in<br \/>\naccordance with law after hearing the parties on the<br \/>\nbasis of the materials already on record within a<br \/>\nperiod of eight weeks from the date of receipt of a<br \/>\ncopy of this order.&#8221;\n<\/p>\n<p>5.\tA bare reading of the impugned order shows that no<br \/>\nreason has been indicated and\/or there has been no analysis<br \/>\nof the evidence recorded. The abrupt conclusions arrived at<br \/>\nshow non application of mind.\n<\/p>\n<p>6.\tReasons introduce clarity in an order. On plainest<br \/>\nconsideration of justice, the High Court ought to have set forth<br \/>\nits reasons, howsoever brief, in its order indicative of an<br \/>\napplication of its mind. The absence of reasons has rendered<br \/>\nthe High Court&#8217;s judgment not sustainable.\n<\/p>\n<p>7.\tEven in respect of administrative orders Lord Denning<br \/>\nM.R. in Breen v. Amalgamated Engineering Union (1971 (1) All<br \/>\nE.R. 1148) observed &#8220;The giving of reasons is one of the<br \/>\nfundamentals of good administration&#8221;. In Alexander Machinery<br \/>\n(Dudley) Ltd. v. Crabtree (1974 LCR 120) it was observed:<br \/>\n&#8220;Failure to give reasons amounts to denial of justice&#8221;. Reasons<br \/>\nare live links between the mind of the decision taker to the<br \/>\ncontroversy in question and the decision or conclusion arrived<br \/>\nat&#8221;. Reasons substitute subjectivity by objectivity. The<br \/>\nemphasis on recording reasons is that if the decision reveals<br \/>\nthe &#8220;inscrutable face of the sphinx&#8221;, it can, by its silence,<br \/>\nrender it virtually impossible for the Courts to perform their<br \/>\nappellate function or exercise the power of judicial review in<br \/>\nadjudging the validity of the decision. Right to reason is an<br \/>\nindispensable part of a sound judicial system, reasons at least<br \/>\nsufficient to indicate an application of mind to the matter<br \/>\nbefore Court. Another rationale is that the affected party can<br \/>\nknow why the decision has gone against him. One of the<br \/>\nsalutary requirements of natural justice is spelling out reasons<br \/>\nfor the order made, in other words, a speaking order. The<br \/>\n&#8220;inscrutable face of a sphinx&#8221; is ordinarily incongruous with a<br \/>\njudicial or quasi-judicial performance.\n<\/p>\n<p>8.\tAbove being the position, the impugned order is clearly<br \/>\nunsustainable and is set aside.
