Justice J.M.JAMES\n\n Dated :25\/08\/2006\n\n O R D E R\n                             J.M.JAMES, J.\n\n                               --------------\n\n                           B.A. 5253\/2006\n\n                             ------------------\n\n    DATED THIS THE 25TH DAY OF AUGUST, 2006\n\n\n\n\n                               O R D E R\n<\/pre>\n<p>              The   petitioners   are   accused   of   the   offence<\/p>\n<p>punishable   under   Section   308   IPC   read   with   Section   34<\/p>\n<p>IPC and also under Section  3(2)(a) of the PDPP Act.   It is<\/p>\n<p>alleged   that   on   8.8.2006,   the   petitioners   had   illegally<\/p>\n<p>tapped   the  electricity   from  the  electric   line,   drawn  along<\/p>\n<p>the   side   of     the   river,   and   made   electricity   be   passed   on<\/p>\n<p>the   flowing water, for the purpose of killing the fish and<\/p>\n<p>then   collecting   them.     Because   of   the   information,<\/p>\n<p>received   by   the   engineer   of   Perambra,   the   matter   was<\/p>\n<p>reported and Perambra Police Station authorities arrested<\/p>\n<p>the petitioners   on 8.8.2006 itself.   Crime No.354\/2006 of<\/p>\n<p>that   Police   Station   was   registered,   as   per     the   offence<\/p>\n<p>stated   above,   as   well   as     under   the   provisions   of   the<\/p>\n<p>Electricity Act.\n<\/p>\n<\/p>\n<p>       2.     When the application came up for  hearing, the<\/p>\n<p>learned   counsel   for   the   petitioners   submitted   that   the<\/p>\n<p>B.A.5253\/2006<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>petitioners,   if   at   all   did   the   act,     without   any   intention<\/p>\n<p>and  the petitioners are not required for interrogation by<\/p>\n<p>the Investigating Officer, as no recovery is necessitated.<\/p>\n<p>       3.     The   prosecution   though   opposed   the   bail<\/p>\n<p>application,   on   going   through   the   materials,   I   find   that<\/p>\n<p>the investigation  is nearly  complete,  in  respect of  these<\/p>\n<p>petitioners,   and   the   materials,   used   for   tapping   the<\/p>\n<p>electricity   and   passing   the   same   on   the   flowing   water,<\/p>\n<p>were   also   recovered.     Material   witnesses   had   been<\/p>\n<p>questioned.\n<\/p>\n<\/p>\n<p>       4.     In   view   of   the   above   facts   situation,   I   grant<\/p>\n<p>bail   and   release the   petitioners  from   jail,   subject  to   the<\/p>\n<p>following conditions:-\n<\/p>\n<\/p>\n<blockquote><p>             (a).    Each   petitioner   shall   execute   a<\/p>\n<p>             bond   for   Rs.25,000\/-,   with   two   solvent<\/p>\n<p>             sureties,   each   for   the   like   sum,   to   the<\/p>\n<p>             satisfaction of the Judicial Magistrate of<\/p>\n<p>             First  Class-I, Perambra.<\/p><\/blockquote>\n<p>             (b).
