NO.3665     OF 2008\n            ===========================\n\n     Dated this the 14th day of November,2008\n\n                       ORDER\n<\/pre>\n<p>    Revision petitioner is the accused and first<\/p>\n<p>respondent the complainant in C.C.809\/2001 on the<\/p>\n<p>file of Judicial First Class Magistrate,Chalakudy.<\/p>\n<p>Case of the first respondent was that petitioner<\/p>\n<p>borrowed  Rs.20,000\/-  and  towards  its  discharge<\/p>\n<p>issued Ext.P1 cheque drawn in his account and when<\/p>\n<p>the cheque was presented it was dishonoured under<\/p>\n<p>Ext.P2 for want of sufficient funds and inspite of<\/p>\n<p>Ext.P4  notice  served  on  the  petitioner,  under<\/p>\n<p>Ext.P6, it was not paid and petitioner thereby<\/p>\n<p>committed  an   offence   under  section   138   of<\/p>\n<p>Negotiable Instruments Act.  Petitioner pleaded not<\/p>\n<p>guilty.  First respondent was examined as PW1 and<\/p>\n<p>Exts.P1 to P6 were marked.     Petitioner did not<\/p>\n<p>adduce any evidence.   The defence raised was that<\/p>\n<p>Ext.P1  cheque  was   issued  not   to  the   first<\/p>\n<p>respondent but to his cousin and it was misused by<\/p>\n<p><span class=\"hidden_text\">CRRP 3665\/2008              2<\/span><\/p>\n<p>the first respondent.       Learned Magistrate on the<\/p>\n<p>evidence disbelieved the defence case and accepted<\/p>\n<p>the evidence of PW1 and found that Ext.P1 cheque<\/p>\n<p>was   issued    towards     repayment of  the   amount<\/p>\n<p>borrowed.      Petitioner was convicted and sentenced<\/p>\n<p>to   imprisonment    till  rising  of    court and   a<\/p>\n<p>compensation of Rs.22,000\/- and in default simple<\/p>\n<p>imprisonment      for   three  months.      Petitioner<\/p>\n<p>challenged     the  conviction   and sentence   before<\/p>\n<p>Sessions      Court,   Thrissur   in   Crl.A.229\/2006.<\/p>\n<p>Learned      Sessions  Judge   on  reappreciation   of<\/p>\n<p>evidence confirmed the conviction and sentence and<\/p>\n<p>dismissed the appeal.       It is challenged in this<\/p>\n<p>revision.\n<\/p>\n<p>     2.     Learned counsel appearing for petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>     3.    The argument of the learned counsel is that<\/p>\n<p>courts below should not have     believed the evidence<\/p>\n<p>of PW1 and should have found that Ext.P1 cheque was<\/p>\n<p>not   issued     towards  payment  of  any     legally<\/p>\n<p>recoverable debt and instead was issued to Shaji an<\/p>\n<p><span class=\"hidden_text\">CRRP 3665\/2008              3<\/span><\/p>\n<p>LIC agent and therefore the conviction is not<\/p>\n<p>sustainable.\n<\/p>\n<p>     4.    On hearing the learned   counsel and going<\/p>\n<p>through the judgments of the courts below, I do not<\/p>\n<p>find any reason to interfere with the conviction.<\/p>\n<p>Though petitioner contended that Ext.P1 cheque was<\/p>\n<p>not issued to     first respondent and was issued   to<\/p>\n<p>one Shaji, learned Magistrate and learned Sessions<\/p>\n<p>Judge on proper appreication of evidence found the<\/p>\n<p>evidence of PW1      credible and reliable.    It was<\/p>\n<p>found that Ext.P1 cheque was not issued to Shaji<\/p>\n<p>but was issued towards       repayment of the amount<\/p>\n<p>borrowed.     I find no reason to interfere with that<\/p>\n<p>factual     finding,  in  the  absence  of  any  other<\/p>\n<p>material.       The  fact   that  Ext.P1  cheque   was<\/p>\n<p>dishonoured for want of sufficient funds and first<\/p>\n<p>respondent has complied with all the statutory<\/p>\n<p>formalities     provided under sections 138 and 142 of<\/p>\n<p>Negotiable Instruments Act are not disputed.        In<\/p>\n<p>such circumstance, conviction of the petitioner is<\/p>\n<p>perfectly legal.\n<\/p>\n<p><span class=\"hidden_text\">CRRP 3665\/2008             4<\/span><\/p>\n<p>     5. Then the only question is regarding the<\/p>\n<p>sentence.      The sentence awarded by the learned<\/p>\n<p>Magistrate as confirmed by the learned Sessions<\/p>\n<p>Judge is only imprisonment till rising of      court<\/p>\n<p>and compensation which was only Rs.2000\/- in excess<\/p>\n<p>of the amount covered by the dishonoured cheque.   I<\/p>\n<p>find no reason to interfere with the sentence also.<\/p>\n<p>     Criminal    Revision  Petition  is   dismissed.<\/p>\n<p>Petitioner is granted two months time to pay the<\/p>\n<p>amount.
