In this revision<br \/>\napplication he has challenged legality of the judgment of acquittal<br \/>\ndated 30.12.1999 passed by the learned Judicial Magistrate, First<br \/>\nClass, Botad in Criminal Case No.458 of 1996.\n<\/p>\n<p>2.<br \/>\n Respondents No.2 to 5 were the original accused.  The offences<br \/>\nalleged against them are  punishable under Sections 323, 504 read<br \/>\nwith Sec.114 of Indian Penal Code  and  Section 135 of Bombay Police<br \/>\nAct. By the impugned judgment, the learned Magistrate acquitted all<br \/>\nthe accused.\n<\/p>\n<p>3.<br \/>\n  Initially this revision application was admitted by this Court and<br \/>\nwas ordered to be heard with Criminal Appeal No.409 of 2000 (State<br \/>\nappeal against acquittal).  Subsequently on 27.7.2001 the learned<br \/>\nSingle Judge of this Court, since had dismissed the State appeal as<br \/>\ntime barred, dismissed the present revision application also since<br \/>\nthe same was ordered to be heard along with State appeal.  This order<br \/>\nwas carried in appeal by the petitioner before the Apex Court and the<br \/>\norder dated 27.7.2001 was set aside and the proceedings were remanded<br \/>\nfor fresh consideration on merits by the Apex Court by an order dated<br \/>\n22.4.2002.\n<\/p>\n<p>4.<br \/>\n  Though Record &amp; Proceedings was called for from the trial<br \/>\ncourt, it appears that due to passage of time, substantial portion of<br \/>\nRecord &amp; Proceedings have been destroyed.  Counsel for the<br \/>\npetitioner is able to reconstruct part of evidence by producing the<br \/>\nrecord, deposition of some witnesses which were available with the<br \/>\ncomplainant.  However, full record was not available before me.\n<\/p>\n<p>5.<br \/>\n Counsel for the petitioner submitted that the trial court committed<br \/>\na serious error in acquitting all the accused though there were<br \/>\neye-witnesses account of the alleged evidence.  He, therefore,<br \/>\nsubmitted that the revision application should  be allowed.\n<\/p>\n<p>6.<br \/>\n On the other hand, counsel for the accused opposed the revision<br \/>\napplication contending that the scope of revision is limited; order<br \/>\nof acquittal is recorded on the basis of evidence available, no case<br \/>\nfor interference is made out.\n<\/p>\n<p>7.<br \/>\n With the assistance of the learned counsel appearing for the<br \/>\nparties, I have perused the judgment under challenge and also the<br \/>\ndocuments available. It may be noted that the alleged incident was of<br \/>\nthe year 1996, the learned Magistrate had, after full fledged trial,<br \/>\nafter recording the evidence of the witnesses found that there were<br \/>\nmajor discrepancies in the eye-witnesses account.  Panch witness had<br \/>\nturned hostile.  Notification under the Bombay Police Act was not<br \/>\nproduced.  On all counts, therefore, the learned Magistrate was of<br \/>\nthe opinion that the charges levelled against the accused for the<br \/>\noffences under Secs.323, 504 read with Sec.114 of Indian Penal Code<br \/>\nand Sec.135 of Bombay Police Act are not proved.\n<\/p>\n<p>8.<br \/>\n In particular, I find that the complainant&#8217;s evidence suffers from<br \/>\nnumber of self-contradictions noticed by the learned Magistrate in<br \/>\nthe impugned judgment.  There were no independent witnesses.  The<br \/>\nlearned Magistrate, therefore, found unsafe to convict any of the<br \/>\naccused.\n<\/p>\n<p>9.<br \/>\n Considering  above aspects of the matter and considering  the scope<br \/>\nof revision  against judgment of acquittal, I am of the opinion that<br \/>\nno case for interference is made out.  Considering all these aspects<br \/>\nof the matter and the reasons indicated by the learned Magistrate for<br \/>\nrecording judgment of acquittal and the incident had taken place way<br \/>\nback in the year 1996, I do not find it a fit case where revisional<br \/>\npowers can be exercised.  Hence, this Revision Applciation is<br \/>\ndismissed.
