Shah, learned Assistant Government Pleader waives service of<br \/>\nRule on behalf of the respondents. In the facts and circumstances of<br \/>\nthe case, and with the consent of the learned counsel for the<br \/>\nparties, the matter is taken up for final hearing today.\n<\/p>\n<p>2.\t\tThis<br \/>\npetition has been filed by the petitioners with the following<br \/>\nprayers:-\n<\/p>\n<p>[A]<br \/>\nYour Lordship may be pleased to admit the present petition.\n<\/p>\n<p>[B]<br \/>\nYour Lordship may be pleased to issue a writ of Certiorari or a writ<br \/>\nin nature of Certiorari or any other appropriate, writ\/s, order\/s<br \/>\nand\/or direction\/s quashing and setting aside the notice issued by<br \/>\nthe respondent no. 2 dated 13.09.2006 (Annexure-A) as well as order<br \/>\npassed by the respondent no. 2 dated 24.03.2003 (Annexure-B).\n<\/p>\n<p>[C]<br \/>\nYour Lordship may be pleased to issue a writ of mandamus or a writ in<br \/>\nnature of mandamus or any other appropriate writ\/s, order\/s, and\/or<br \/>\ndirection\/s directing the respondent no. 3 to enter the necessary<br \/>\nmutation entry giving effect to the order dated 09.10.2002 passed by<br \/>\nthe respondent no. 5 in Tenancy Case No. 84 of 2002 (Annexure-C) in<br \/>\nthe revenue records\/Village Form Nos. 6 and 7\/12 of Village Adajan,<br \/>\nTaluka City Surat, District Surat within a reasonable time which may<br \/>\nbe stipulated by this Hon&#8217;ble Court.\n<\/p>\n<p>[D]<br \/>\nPending, admission, hearing and final disposal of this petition,<br \/>\nYour Lordship may be pleased to grant and ad-interim\/ interim relief<br \/>\nstaying the execution, operation and implementation of the notice<br \/>\nissued by the respondent no. 2 dated 13.09.2006 (Annexure-A) as well<br \/>\nas order passed by the respondent no. 2 dated 24.03.2003<br \/>\n(Annexure-B).\n<\/p>\n<p>[E]<br \/>\nSuch other and further relief\/s as may be deem just and proper in the<br \/>\nfacts and circumstances of the case may pleased be granted in favour<br \/>\nof the petitioners in the interest of justice.\u00fd\u00fd<\/p>\n<p>3.\t\tBriefly<br \/>\nstated, the facts of the case are that the petitioners are the owners<br \/>\nand possessors of land bearing Revenue Survey No.11\/1, 17 and 698\/2<br \/>\nof Village Adajan, Taluka City Surat, District Surat, admeasuring<br \/>\nabout 2529 sq.mtrs., 2630 sq.mtrs. and 2125 sq.mtrs. respectively<br \/>\n[hereinafter referred to as \u00fdSthe land in question\u00fd\u00fd]. It is the<br \/>\ncase of the petitioners that the respondent no. 5 i.e. the Additional<br \/>\nMamlatdar and ALT (Tenancy) Choryasi, vide order dated 9th<br \/>\nOctober, 2002 rendered in Tenancy case No. 84 of 2002 under the<br \/>\nprovisions of Section 70(O) of the Bombay Tenancy and Agricultural<br \/>\nLands Act, 1948 [the \u00fdSAct\u00fd\u00fd for short], declared the petitioners<br \/>\nas permanent tenants, thereby removing the restrictions imposed under<br \/>\nSection 43 of the Act. It is the case of the petitioners that the<br \/>\norder dated 9th October, 2002, which was passed by the<br \/>\nrespondent no 5 was confirmed by the respondent no. 4 [Deputy<br \/>\nCollector], Choryasi Prant by order dated 27th February,<br \/>\n2003.\n<\/p>\n<p>4.\t\tThe<br \/>\ncase of the petitioners is that the State Government has not<br \/>\nchallenged the order dated 9th October, 2002 passed by the<br \/>\nrespondent No.5 till date. However, a Circular dated 7th<br \/>\nOctober, 2005 came to be issued by the State Government, empowering<br \/>\nthe District Collector to decide the cases under the provisions of<br \/>\nSection 43 of the Act.  Pursuant thereto, the Collector issued notice<br \/>\ndated 13th September, 2006 to the petitioners stating that<br \/>\nthe respondent No.5 had no authority to decide the question of<br \/>\npermanent tenancy and that this power had been vested with the<br \/>\nCollector, pursuant to issuance of Circular dated 7th<br \/>\nOctober, 2005. The Government Circular dated 7th October,<br \/>\n2005 was challenged by a number of persons by filing Special Civil<br \/>\nApplication No.9609 of 2006 and other allied matters and this court,<br \/>\nvide judgment dated 17-18-23\/01-2007, has quashed and set aside the<br \/>\nCircular dated 7th October, 2005 as being ultra vires<br \/>\nthe provisions of the Act. The petitioners are, therefore, aggrieved<br \/>\nby the notice dated 13th September, 2006 (Annexure \u00fdSA\u00fd\u00fd<br \/>\nto the petition), which has been issued by the respondent No.1<br \/>\npursuant to the Circular dated 7th October, 2005 and has<br \/>\ntherefore, approached the Court by filing this petition.\n<\/p>\n<p>5.\t\tI<br \/>\nhave heard Mr. K.K. Trivedi,learned counsel for the petitioners and<br \/>\nMr. J. K. Shah,learned Assistant Government Pleader for the<br \/>\nrespondents and have gone through the averments made in the petition<br \/>\nas well as the documents annexed thereto.\n<\/p>\n<p>6.\t\tA<br \/>\nperusal of the impugned communication dated 13th<br \/>\nSeptember, 2006 makes it clear that the said notice has been issued<br \/>\nby placing reliance upon the circular dated 7th October,<br \/>\n2005, which has already been set aside by this court vide judgment<br \/>\ndated  17-18-23\/01-2007 rendered in Special Civil Application No.9609<br \/>\nof 2006.\n<\/p>\n<p>7.\t\tMr.\n<\/p>\n<p>J.K. Shah, learned Assistant Government Pleader has submitted that<br \/>\nthe State Government  has filed a Letters Patent Appeal against this<br \/>\njudgment but the same is lying in the Registry of the High Court for<br \/>\nremoval of office objections. Be that as it may, the fact remains<br \/>\nthat the judgment of this Court dated: 17-18-23\/1-2007 in Special<br \/>\nCivil Application No.9609 of 2006 whereby the Court has dealt with<br \/>\nthe rights of a person claiming protection as a protected or<br \/>\npermanent tenant, and whereby the Circular dated 7th<br \/>\nOctober, 2005 of the State Government  has been quashed and set<br \/>\naside, still holds the field. Since the Circular dated 7th<br \/>\nOctober, 2005 has not yet been restored, it cannot be made applicable<br \/>\nto the case of the petitioners.\n<\/p>\n<p>8.\t\tIn<br \/>\nview of the above facts and circumstances, the notice dated 13th<br \/>\nSeptember, 2006 (Annexure \u00fdSA\u00fd\u00fd to the petition) insofar as it<br \/>\nrelates to the Circular dated 7th October, 2005 of the<br \/>\nState Government is quashed and set aside, with the clarification<br \/>\nthat the present direction shall  not operate as  a bar to the<br \/>\nCollector in exercising other statutory powers, as may be available<br \/>\nunder the Act, and nor shall the bar operate for other remedial<br \/>\nmeasures against the order dated 9th October, 2002 passed<br \/>\nby the Mamlatdar and ALT, if otherwise permissible in law.\n<\/p>\n<p>9.\t\tSo<br \/>\nfar as the directions of the Collector at Annexure \u00fd  B are<br \/>\nconcerned, it is clarified that if the respondents do not take proper<br \/>\nrecourse to law, within a period of three months from the date of<br \/>\nthis order, the restriction imposed vide order dated 24th<br \/>\nMarch, 2003 (Annexure \u00fd  B) shall cease to operate after the expiry<br \/>\nof the above stipulated period of three months. It is open to the<br \/>\npetitioners to apply to respondent No.3 for the mutation of entries<br \/>\nin pursuance of order dated 9th October, 2002, which will<br \/>\nbe dealt with by the respondent No.3, in accordance with law <\/p>\n<p>10.\t\tThis<br \/>\npetition is disposed of in the above terms.
