SHAH\n\t\t\n\t\n\n \n\nDate\n: 17\/06\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tConsidering<br \/>\nthe affidavit-in-reply filed on behalf of respondent No.1, Shri<br \/>\nJapee, learned advocate appearing on behalf of the appellants, under<br \/>\nthe instruction from his client &#8211; appellant No.1 who is<br \/>\npersonally present in the Court, seeks permission to withdraw the<br \/>\npresent Appeal From Order and Civil Application therein<br \/>\nunconditionally. He has also tendered unconditional apology on behalf<br \/>\nof the appellants for not disclosing the correct facts before the<br \/>\nlearned trial Court as well as this Court with respect to disposing<br \/>\nof some of the suit properties during the pendency of the<br \/>\nproceedings.  In the facts and circumstances of the case, this Court<br \/>\nwas not inclined to permit the appellants to withdraw the present<br \/>\nAppeal From Order without imposing exemplary cost.  Shri Japee,<br \/>\nlearned advocate appearing on behalf of the appellants, under the<br \/>\ninstruction from the appellants, has stated at the Bar that<br \/>\nappellants are ready and willing to deposit the<br \/>\ncost which may be quantified by this Court.  This Court suggested<br \/>\nthat appellants can be permitted to withdraw the present Appeal and<br \/>\nunconditional apology tendered by them can be accepted on condition<br \/>\nthat they deposit Rs.25,000\/- with the Registry of this Court, which<br \/>\nis agreeable to Shri Japee, learned advocate appearing on behalf of<br \/>\nthe appellants as well as original appellant No.1, who is personally<br \/>\npresent in the Court.\n<\/p>\n<p>2.\tIn<br \/>\nview of the above, unconditional apology tendered on behalf of the<br \/>\nappellants is hereby accepted and the appellants are permitted to<br \/>\nwithdraw the present Appeal From Order and Civil Application therein<br \/>\nunconditionally on condition that the appellants shall deposit a sum<br \/>\nof Rs.25,000\/- with the Registry of this Court within a period of one<br \/>\nweek from today and on such deposit, Registry is directed to transmit<br \/>\nthe same to Gujarat State Legal Services Authority.  If the aforesaid<br \/>\namount is not deposited by the appellants within the aforesaid<br \/>\nperiod, Registry is directed to place the present Appeal From Order<br \/>\non board for appropriate orders.
