No.25626 of 2010\n                     SURESH YADAV, SON OF SRI CHETU YADAV\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   29.07.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 147, 148, 149, 307 and 302 of the<\/p>\n<p>                  Indian Penal Code.\n<\/p>\n<p>                             Considering the relationship between the parties as<\/p>\n<p>                  also that there is general allegation of assault against all the<\/p>\n<p>                  accused persons and the occurrence took place on account of<\/p>\n<p>                  land dispute, let the petitioner above named, be released on<\/p>\n<p>                  bail on furnishing bail bond of Rs. 5,000\/- (Five thousand) with<\/p>\n<p>                  two sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>                  Judicial Magistrate, Gaya, in Magadh University P.S. Case No.<\/p>\n<p>                  35 of 2004 subject to the following conditions: (i)That one of the<\/p>\n<p>                  bailors will be a close relative of the petitioner who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner. The bailor will undertake to furnish information to the<\/p>\n<p>                  court about any change in address of the petitioner. (ii)That the<\/p>\n<p>                  affidavit shall clearly state that the petitioner is not an accused<\/p>\n<p>                  in any other case and if he is, he shall not be released on bail.<\/p>\n<p>                  (iii)That the petitioner will give an undertaking that he will<\/p>\n<p>                  receive the police papers on the given date and be present on<\/p>\n<p>                  date fixed for charge and if he fails to do so on two given dates<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
