He has taken the'd\u00e9fe5\u00a2e of total\n\ndenial and he has not led eny=evieence in his defence.\n\nThe Trial Court_onVepnrecietion of the material\non record, aoqeitted the aceuse\ufb01 and aggrieved by the\n\nacquittal, the State has sreferred this appeal.\n\n3.i_ I-ha\ufb01e heard the learned Government Pleader\n\nand the learned connselafor the respondent.\n\nj44::'The eoint that arises for my consideration\n\nWis1l*\n\n2 V\ufb02\ufb01hether the Judgment and Order of\necq\ufb01ittal of the respondent in respect of\n\ufb02u ,the\"eharges leveled under the provisions of\nV *,the Karnataka Forest Act etc. is illegal and\n\nperverse? '\u00a2\n\nK.\n\n\n\nS. The learned Government Pleader contended that\nthere is sufficient material on record to the\n\nencroachment of the forest land and that the act Of\n\nencroachment is recurring offence and~\u00abthereferef'heu\u00bb\n\nsubmits that the Trial Court gerreel in tgranei\ufb01g, the =\n\nacquittal.\n\n6. The yerusafl. of  by the\nprosecution reveals vthet.h\u00a7;$5rlTlto;_3 who are the\nattesting witnesses Vforl thee gahgza; have turned\nhostile to the e\u00a7\u00a7se\u00a7u:i\u00a7\ufb01.\u00a3ff\ufb01e;efore, the testimony\nof these eitnesses is of he heln to the prosecution.\nThe other yitnessee are Range Forest Officer [P.W.41,\nthe pores; and the Forester [P.W.6].\n\nThe complaint Rae for the encroachement of 21 guntas\n\n'of the Eereat land by the accused and growing banana,\n\ni\u00a2gcgnu::;\u00a7e\u00e9s,f\u00a2tc. and putting up the construction of\n\nthe huildine in the encroached portion. The perusal\n\nl,_r of the~e\u00a7idence reveals that the encroachment is said\n\n\"' 'to nhave been done by' the accused about 25-30 years\n\n'\"erior to the registration of the complaint. The\n\n\".\u00a7roperty extract produced reveals that the land is\n\ng;ann\u00a7: in possession of the Forest Department. The\n\nK\n\n\n\ncopy of the notification placed at E'.x.P'? reveals the\nSy. No.92 as the forest land. The said notification\nwas issued under the provisions of the Indie'n\"\u00bbr\u00a3'ore$t\n\nAct 18'?8. The said notification issue~d...'p&amp;un_ti\u00e9;'::V\"the\n\nearlier Act continues to be valid under._ the i'pries3ent--._\n\nAct. But, unfortunately, the ;department;'has._nVo'tV\"ta.ken_ \n\nany action against the respciniindenti \nyears and the delay has  Vprope'iflV\u00a7nb4'VeXplained.\nThe inordinate delayp   'the c'o\ufb01znpl.ain\u00a7t leads to\na doubt with regard to of ownership in\n\nrespect of the_\"'encroach~etd  State can have\n\nrecours;e\"i'torA...t.he '7px:'o\u00a7i.s'ions_\"v'of Section 64(A} of the\nKarnatakiap i.For'eet.'if.}5~;ct'\u00b0*-._and seek summary eviction.\n\nThough there isV'v;nat--ver'i'al regarding encroachment, but\n\n.~-the  V__area\"\"\u00abencroached has to be found out by\n\nVideniarcetioni'\u00abvcciiief the boundary through the proper\n\n  View of the remedy available to the\n\ngespondenpt thunder Section 64(A) of the Act, the\n\n\ufb02d.eparr_tment is at liberty to initiate the action by\n\n the eviction of the respondent summarily and\n\n:'u\"to\"iVtake the possession. In the circumstances and in\n\nit iziew of insufficient material on record, I do not find\n\nany ground to warrant the interference.
