    Heard arguments of counsel on both sides.<\/p>\n
    2. Petitioners are the plaintiffs in a suit for<\/p>\n
temporary injunction restraining the respondents\/<\/p>\n
defendants from conducting blasting and excavation<\/p>\n
of granite stones from the quarry in the scheduled<\/p>\n
property.  It is contended that they are doing so<\/p>\n
illegally and unscientifically and also destroying<\/p>\n
the public pathway in the plaint schedule property.<\/p>\n
The trial court granted an interim injunction after<\/p>\n
hearing the parties, vide Exhibit P1 order.    Even<\/p>\n
in the said order, it was made clear that the said<\/p>\n
injunction order will not prevent the respondents\/<\/p>\n
defendants from excavating the granite stones after<\/p>\n
demarcating  2.12  acres  of  property  covered  by<\/p>\n
Exhibit B7 permit.\n<\/p>\n
    3. Respondents\/defendants filed I.A.No.649\/08<\/p>\n
seeking permission to excavate granite stones from<\/p>\n
2.12  acres  of  property  covered  by  Exhibit  B7<\/p>\n
WPC 595\/09                2<\/span><\/p>\n
permit.    I do not understand the purpose of moving<\/p>\n
such a petition, as that had been allowed by<\/p>\n
Exhibit P1 order itself.      Vide Exhibit P2 order<\/p>\n
passed on I.A.No.649\/08, the court below observed<\/p>\n
that Exhibit P1 order on I.A.No.513\/08 also permits<\/p>\n
the petitioners therein (defendants in the suit),<\/p>\n
who are the respondents herein, to excavate granite<\/p>\n
stones from the said property.     It was clarified<\/p>\n
further   that  they  are  permitted  to  blast  and<\/p>\n
excavate the rocks in accordance with Exhibit B7<\/p>\n
permit.   Petitioners  have  no  case  that  if  the<\/p>\n
blasting is done in accordance with Exhibit B7,<\/p>\n
there is any grievance for them. In Exhibit P2<\/p>\n
order    itself, it  is   further stated  that   the<\/p>\n
petitioners\/defendants     shall   do    so    after<\/p>\n
demarcating the area as per law and further that if<\/p>\n
the respondents are in any way aggrieved as to the<\/p>\n
proper demarcation and marking, they are at liberty<\/p>\n
to take out a commission and approach that court.<\/p>\n

     4. It is the grievance of the petitioners that<\/p>\n
respondents\/defendants have not done demarcation as<\/p>\n
directed in Exhibit P2 order, whereas, according to<\/p>\n
the   counsel  for  the   respondents,  they   have<\/p>\n
demarcated the area with the assistance of the<\/p>\n
Village Officer and it is only thereafter that they<\/p>\n
are doing blasting in compliance with Exhibits P1<\/p>\n
and P2 orders. Exhibit P2 order is dated 9.4.2008.<\/p>\n
On   18.9.2008,  petitioners   filed   Exhibit   P3<\/p>\n
application for getting down a report and plan<\/p>\n
through the very same Commissioner, who submitted a<\/p>\n
report and plan earlier, asking for several matters<\/p>\n
to be ascertained.   I do not see any averment in<\/p>\n
the affidavit accompanying Exhibit P3 that the<\/p>\n
demarcation of 2.12 acres of property covered by<\/p>\n
Exhibit   B7  had  not  been   done  or  that   the<\/p>\n
respondents are doing blasting in the quarry not<\/p>\n
within the area covered by Exhibit B7.    The only<\/p>\n
question that deserved consideration was as to<\/p>\n
whether quarrying was being done within 2.12 acres<\/p>\n
WPC 595\/09                4<\/span><\/p>\n
of property covered by Exhibit B7 permit.   I do not<\/p>\n
see such a request made in Exhibit P3 application.<\/p>\n
On the same day on which Exhibit P3 application was<\/p>\n
filed, petitioners filed Exhibit P4 application as<\/p>\n
well for a prohibitory injunction restraining the<\/p>\n
respondents   from  doing  quarrying,  blasting  the<\/p>\n
rocks    and again  on  the  same  day,  Exhibit  P6<\/p>\n
application also was filed for prosecuting the<\/p>\n
respondents. As per Exhibit P7 order passed on I.A.<\/p>\n
No.1282\/08, the injunction application filed by the<\/p>\n
petitioners, was dismissed. The C.M.Appeal filed<\/p>\n
assailing the said order was dismissed vide Exhibit<\/p>\n
P9 judgment by the first appellate court.     It is<\/p>\n
assailing    the  said   judgment,  confirming   the<\/p>\n
dismissal of the injunction petition vide Exhibit<\/p>\n
P7 order, that this writ petition has been filed.<\/p>\n
     5.   I do not find any reason to interfere with<\/p>\n
the concurrent orders so passed by the courts below<\/p>\n
for the reason that there is no specific case for<\/p>\n
the petitioners that, as directed in Exhibit P2<\/p>\n

order, the respondents herein have not properly got<\/p>\n
demarcated 2.12 acres of property as per Exhibit B7<\/p>\n
permit    and  have also not  applied  for   proper<\/p>\n
demarcation and marking of the said 2.12 acres of<\/p>\n
property covered by Exhibit B7 permit, though they<\/p>\n
have asked for several other matters to be got<\/p>\n
ascertained as per Exhibit P3 application, which is<\/p>\n
seen to be with intention to create and develop new<\/p>\n
contentions, which were obviously not there while<\/p>\n
the court passed Exhibits P1 and P2 orders.   Prima<\/p>\n
facie, I am of the view that it is only the eyesore<\/p>\n
of the petitioners to see that the respondents do<\/p>\n
not do any work in the quarry that has prompted<\/p>\n
them to take up the matters to several courts<\/p>\n
raising   one  contention or  the  other,  although<\/p>\n
inconsistent. If at all their grievance is that the<\/p>\n
property covered by Exhibit B7 permit is not the<\/p>\n
property    within which quarrying  is  done,   the<\/p>\n
petitioners may file an application to remit back<\/p>\n
the commission report to the same Commissioner to<\/p>\n
WPC 595\/09               6<\/span><\/p>\n
verify that aspect, viz., as to whether quarrying<\/p>\n
is being done in any portion of the quarry, which<\/p>\n
is stated to be extending to about 10-15 acres<\/p>\n
other than in the portion of 2.12 acres covered by<\/p>\n
Exhibit B7 permit or the permit thereafter renewed,<\/p>\n
which is stated to be the one now in force and<\/p>\n
thereafter to seek for appropriate directions.<\/p>\n
     This writ petition is disposed of with the<\/p>\n
above observations.\n<\/p>\n
