1.\tPresent
\napplication has been filed by the applicant for grant of regular bail
\nunder Section 439 of Cr.P.C. after the charge-sheet is filed.\n<\/p>\n
2.\tThe
\napplicant accused is charged with having committed offences under
\nSections 302, 307, 147, 148, 149, 323, 324, 325, 504 and 506(2) of
\nIndian Penal Code and Section 25(1)(a) of the Arms Act and Section
\n135 of the B.P.Act for which F.I.R. being CR No.I-4\/2007 has been
\nregistered with Kirti Mandir Police Station, Porbandar.\n<\/p>\n
3.\tLearned
\nSenior Counsel Mr. Thakkar appearing for the applicant referred to
\nthe papers and the role attributed and submitted that the applicant
\nis the original accused No.5 who is alleged to been attributed with
\nfire arm. However, he submitted that no injury has been caused to the
\ndeceased with the fire arm which is evident from  the P.M. report. He
\nhas also referred to the medical certificate of both the hospitals at
\nPorbandar and Jamnagar and submitted that the applicant is not
\nattributed with any kind of injury except to one witness and
\ntherefore present application may be allowed considering the fact
\nthat the charge-sheet is now filed. He further submitted that the
\nDistrict Court has referred to the aspect of proceeding under Section
\n70 as well as the antecedent of the applicant. He submitted that in
\nmost of the cases the applicant has been acquitted including the
\noffence under Section 302. He has also submitted that the complainant
\nis also having antecedent for which he referred to the list of cases
\nregistered against the complainant. He, therefore, submitted that the
\npresent application may be allowed subject to any conditions.\n<\/p>\n
4.\tLearned
\nA.P.P. Mr. M.R.Mengdey referred to the police papers and strenuously
\nsubmitted that the incident is stated to have been occurred in
\nJanuary-2007 and the present applicant accused was arrested only in
\nSeptember-2009. He further submitted that there are other cases
\npending against the applicant and therefore the present application
\nmay not be allowed. He also submitted referring to the statement that
\nthere was indiscriminate firing, though nobody injured. But,
\nconsidering the antecedent and conduct, the present application may
\nnot be allowed.\n<\/p>\n
4.1.\tLearned
\nCounsel Mr. Vasavda referred to the order passed by the Sessions
\nCourt and emphasized on the aspect that applicant was absconding. He
\nhas also submitted that it is not a simple case of involvement in one
\noffence but there are number of offences registered and they are
\nworking as a separate Gang and therefore public interest may also be
\nconsidered. He, therefore, submitted that present application may not
\nbe allowed.\n<\/p>\n
5.\tHaving
\nregard to the rival submissions, it is required to be considered
\nwhether the present application can be entertained or not.\n<\/p>\n
5.1.\tAt
\nthis stage, the Court is not required to appreciate or scrutinize the
\nevidence in detail. However, for considering the prima facie case,
\nthe relevant aspects like, the nature of offence\/gravity, manner in
\nwhich the offence is alleged to have been committed, role attributed
\nand weapon used are required to be considered.\n<\/p>\n
5.2.\tIn
\nthe facts of the present case, as referred, no injury has been caused
\nwith the fire arm as it is evident from the P.M. report. Therefore,
\nwithout any further elaboration, having noted the objections with
\nregard to the conduct and the antecedent and also considering the
\nrole attributed and the fact that now the charge-sheet is filed, the
\npresent application deserves to be allowed subject to the conditions
\nhereinafter.\n<\/p>\n
\t6.\tAccordingly,
\n\tpresent application stands allowed. The applicant is ordered to be
\n\treleased on regular bail in connection with the F.I.R. being CR
\n\tNo.I-4\/2007 registered with Kirti Mandir Police Station, Porbandar,
\n\ton his executing a bond of Rs.5,000\/- (Rupees Five Thousand) with
\n\tone solvent surety of the like amount to the satisfaction of the
\n\tlower Court and subject to the conditions that he shall:\n<\/p>\n
(a)\tnot
\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n
(b)\tnot
\nto try to tamper or pressurize the prosecution witnesses or
\ncomplainant in any manner.\n<\/p>\n
(c)\tnot
\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n
(d)\tmaintain
\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n
(e)\tmark
\nhis presence before concerned Police Station on 1st Monday
\nof every month of English calender between 11:00 AM to 2:00 PM till
\nthe trial commences;\n<\/p>\n
(f)\tfurnish
\nthe address of his residence to the Investigating Officer and also to
\nthe Court at the time of execution of the bond and shall not change
\nhis residence without prior permission of the Court.\n<\/p>\n
(g)\tsurrender
\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n
(h)\tnot
\nenter the Taluka Porbandar for a period of six months.\n<\/p>\n
7.\tIf
\n\tbreach of any of the above conditions is committed, the concerned
\n\tSessions Judge will be  free to issue warrant or take appropriate
\n\taction in the matter.\n<\/p>\n
8.\tBail
\n\tbefore the lower Court having jurisdiction to try the case. It would
\n\tbe open to the trial Court concerned to give time to furnish the
\n\tsolvency certificate if prayed for.\n<\/p>\n
9.\tRule
\n\tis made absolute to the aforesaid extent. Direct service is
\n\tpermitted.\n<\/p>\n
