IX.\n<\/p>\n<p>          For the Respondent :- Mr. Shashi Shekhar Tiwary, Advocate.<\/p>\n<p>04\/   21.01.2011               The present L.P.A. application has been filed<\/p>\n<p>                   against the order dated 03.02.2010 passed in C.W.J.C. No.<\/p>\n<p>                   2299 of 2005 whereby the learned Single Judge after going<\/p>\n<p>                   through the merits of the case has allowed the petitioner-<\/p>\n<p>                   respondent herein.\n<\/p>\n<p>                               The respondents-appellants have challenged the<\/p>\n<p>                   order passed by the learned Single Judge questioning the<\/p>\n<p>                   action to the respondents-appellants withholding the amount<\/p>\n<p>                   of Rs.81,693\/- on the ground of excess payment w.e.f. 1st<\/p>\n<p>                   April, 1981 to 30th June, 2001.\n<\/p>\n<p>                               The case of the petitioner-respondent before the<\/p>\n<p>                   learned Single Judge was that the authority has no right to<\/p>\n<p>                   withhold the amount as it is not a case of misrepresentation of<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>excess payment, misrepresentation or fraud.<\/p>\n<p>           The appellants-respondents herein being the<\/p>\n<p>respondents took the stand that even there is direction of the<\/p>\n<p>Commandant not to make payment, as the State of Bihar has<\/p>\n<p>not accepted the revision of pay scale, still the Commandant<\/p>\n<p>has paid the excess salary and it is also contended that the<\/p>\n<p>appellants have not placed the letters addressed by the<\/p>\n<p>department before the Commandant. The learned Single<\/p>\n<p>Judge has not accepted the contention finding that there is no<\/p>\n<p>material available to come to such conclusion as the<\/p>\n<p>Commandant has failed to take action against the respondent-<\/p>\n<p>petitioner. The learned Standing Counsel appearing on behalf<\/p>\n<p>of the department has also contended that more so letters<\/p>\n<p>advanced before the learned Single Judge contending that the<\/p>\n<p>respondent-petitioner was at fault in not putting the letters<\/p>\n<p>before the Commandant and he has misconducted himself.<\/p>\n<p>However, there is no material placed before this Court to<\/p>\n<p>support such contention and the fact remains that the said<\/p>\n<p>Commandant has not taken any action against the<\/p>\n<p>respondent-petitioner if any of the letters have not been<\/p>\n<p>placed before him normally for a period of more than 15<\/p>\n<p>years. In the absence of such material, we have no hesitation<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>              in upholding the order of the learned Single Judge passed in<\/p>\n<p>              the writ petition and we see no force in the contention of the<\/p>\n<p>              learned counsel for the appellants.\n<\/p>\n<p>                          The L.P.A. application is dismissed without<\/p>\n<p>              costs.\n<\/p>\n<\/p>\n<p>                                               (T.
