PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 25\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p>Learned APP, waives service of notice of rule on behalf of the<br \/>\nrespondent-State.\n<\/p>\n<p>1.\t\tThe<br \/>\npetitioners, by way of this petition, seek anticipatory bail in<br \/>\nconnection with the complaint, bearing C.R. No. I-66\/10, filed before<br \/>\nWankaner City Police Station, for the offences punishable under<br \/>\nSections-323, 325, 504, 394 and 114 of the Indian Penal Code and<br \/>\nSection-135 of the Bombay Police Act.\n<\/p>\n<p>2.\t\tThe<br \/>\nlearned<br \/>\nCounsel for the petitioners submitted that the alleged complaint is<br \/>\nan offshoot of a land deal, with regard to which certain disputes are<br \/>\ngoing on between the parties. He, further, submitted that,<br \/>\nsubsequently, on the allegation that one mobile phone was stolen,<br \/>\nSection-394 of the Indian Penal Code is also added.\n<\/p>\n<p>3.\t\tIn<br \/>\naddition to the above submission, I have also perused the nature of<br \/>\nallegations in the complaint. Taking into account the statement of<br \/>\nthe learned Counsel for the petitioners that they have no criminal<br \/>\nantecedents,<br \/>\nit is ordered that in the event of arrest of the petitioners, in<br \/>\nconnection with C.R. No. I-66\/10, filed before Wankaner<br \/>\nCity Police Station, they<br \/>\nshall be RELEASED on anticipatory bail,<br \/>\nupon furnishing  bond of Rs. 25,000\/-(Rupees Twenty<br \/>\nFive Thousand) with one surety, by EACH of THEM,<br \/>\nof the like amount, to the satisfaction of the lower Court and<br \/>\nsubject to the conditions that they,<\/p>\n<p>[A]\tshall<br \/>\nCOOPERATE with the investigation and make themselves<br \/>\navailable for interrogation whenever required;\n<\/p>\n<p>[B]\tshall<br \/>\nremain PRESENT at the concerned Police Station on 28th<br \/>\nJanuary, 2011, between 11:00 a.m. to 2:00<br \/>\np.m.;\n<\/p>\n<p>[C]\tshall<br \/>\nNOT hamper the investigation in any manner nor shall<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nwitness so as to dissuade him from disclosing such facts to the Court<br \/>\nor to any Police Officer;\n<\/p>\n<p>[D]\tshall,<br \/>\nat the time of EXECUTION of bond, furnish<br \/>\nthe ADDRESS to the Investigating Officer and the Court<br \/>\nconcerned and shall NOT CHANGE the residence till the<br \/>\nfinal disposal of the case or till further orders;\n<\/p>\n<p>[E]<br \/>\n\tWILL NOT leave INDIA without the prior<br \/>\npermission of the Court and, if is holding a PASSPORT,<br \/>\nshall SURRENDER the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nREMAND, if he considers it just and proper and the<br \/>\nconcerned Magistrate would decide it on merits;\n<\/p>\n<p>[G]\tThis<br \/>\norder will be operative if the applicant is arrested, at any time,<br \/>\nwithin a period of 90 days from, TODAY;\n<\/p>\n<p>[H]\tWithin<br \/>\na period of TEN DAYS from the date of arrest, the<br \/>\napplicant shall apply for REGULAR BAIL which<br \/>\napplication shall be decided by the competent Court in accordance<br \/>\nwith law WITHOUT being INFLUENCED by the<br \/>\nfact that anticipatory bail was granted.\n<\/p>\n<p>4.\t\tRule<br \/>\nis made absolute.
