Shah, learned Additional Public Prosecutor waives the<br \/>\n\tservice of notice of rule on behalf of the respondent No.1 and<br \/>\n\tMr.J.C. Shah, learned advocate waives the service of notice of rule<br \/>\n\ton behalf of the respondent No.2.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocate appearing on behalf of the<br \/>\n\trespective parties and in the facts and circumstances of the case,<br \/>\n\tpresent petition is taken up for final hearing today.\n<\/p>\n<p>Present<br \/>\n\tpetition has been preferred by the petitioner under sec.482 of the<br \/>\n\tCode of Criminal Procedure to quash and set aside the First<br \/>\n\tInformation Report being CR No.I-116 of 2010 registered with<br \/>\n\tVastrapur Police Station, Ahmedabad for the offences punishable<br \/>\n\tunder sections 498(A) of Indian Penal Code  and under sections 3 and<br \/>\n\t7  of Dowry Prohibition Act.\n<\/p>\n<p>At<br \/>\n\tthe outset,  it is reported that during the pendency of the present<br \/>\n\tpetition, investigation is over and now chargesheet is already filed<br \/>\n\tby the investigating officer before the competent Court.\n<\/p>\n<p>In<br \/>\n\tview of the above, Mr.Dipen Shah, learned<br \/>\n\tadvocate appearing on behalf of the petitioner  seeks<br \/>\n\tpermission to withdraw the present petition as the petitioner<br \/>\n\tproposes to approach the learned trial court for discharge under<br \/>\n\tsec.227 of the\u00a0 Code of Criminal Procedure.\n<\/p>\n<p>In<br \/>\n\tview of the above, without expressing any opinion on merits, present<br \/>\n\tCriminal Misc.Application is dismissed as withdrawn.  The petitioner<br \/>\n\tis permitted to file discharge application before the court below<br \/>\n\tunder sec.227 of the\u00a0 Code of Criminal Procedure.
