on the \ufb01le of I Addl. Civil Judge (Sr; & iC.1M,–.Dhariv-.{ad;’ partly
\nallowing the claim petition for c’o1jnp.ensatiori _and% seeking
\nenhancement ofcompensation.   *    <\/p>\n
This appeal coming on for day, N.K.Patil J.,
\ndelivered the following:,. V     V <\/p>\n
1. This is..l..a enhancement of
\nirnpugned judgment and award
\ndated  No. 185\/2000 on the file of the
\nFCi_vil iliidge”(Senior Division) & C.J.M. Dharwad.<\/p>\n
Thelfribugnal judgment and award awarded a sum of<\/p>\n
:”‘Rs.4,39,05?il– withi’:’..interest at 9% p.a. as against the claim of<\/p>\n
“‘-R’.s~v.’3__1_l,’65AA,000\/Q account of the death of late Abdul Khan @<\/p>\n
 ._iAfzall{liari–\u00bb}ainadar in a road traffic accident.<\/p>\n
2. Brief facts of the case are:\n<\/p>\n
The appellant is none other than the wife of the <\/p>\n
contends that her husband-deceased was working asbaii  it<\/p>\n
earning Rs. 25,000\/— p.m. from the profescsionlland <\/p>\n
agriculture. On the fatal day at 04.0%) p.m.;–. on <\/p>\n
deceased after completing his Court   I\ufb01harwad in
\norder to go to his house was vvait:i.ng  market
\nside on his motorcycle  to go to
\nhis house. At that tgh-hel   No. TN–27\/Z–75 75<\/span>
\ncame rashly and  traffic rules and
\nregulations arid’  on account of which he
\nsustained grievous\u00ab-.tinju.ries__la1idl succumbed to the same on the spot.
\nQrt account  of deceased, a claim petition was filed u\/S<\/p>\n
   compensation of R53 1,65,000\/– against the<\/p>\n

..7f1’i.bunal and the Tribunal in turn after appreciating the oral and<\/p>\n
 ‘documen’ta_ry1–‘evidence available on record has taken the income of the<\/p>\n
  at Rs. 4,000\/- p.m., deducted l\/3″ towards personal<\/p>\n
‘\/,,..\/<\/p>\n
expenses of the deceased and awarded a sum of Rs. 4,I”6.>052\/–<\/p>\n
towards loss of dependency, Rs. I0,000\/- towards loss <\/p>\n
Rs. 10,000\/– towards loss of estate and Rs. 3,000\/gV__toward_s’~ iftuiera!.i <\/p>\n
and transportation expenses. In all, a co1T=;pensatione_of  4-,\u00a739_,:O5A2\/i-A\u00bb<\/p>\n
was awarded. According to the Vcla4imant”.the said”lcompens\u00a7atiion_:t><\/p>\n
awarded by the Tribunal is on theiiiidoiwer    requires
\nenhancement and she has presie-nted_ this appealbbiei’ng aggrieved by the
\nimpugnedjudgrnent and,awardv.,~–  V M i<\/p>\n
3. We have heard ‘appearing for the appellant
\nand learned  r\u00e9ilspondent no. 3-Insurance<\/p>\n
Company at considerablel.eng:th..__iof”time. After evaluation of the<\/p>\n
records available oni\ufb01*l.eA and on perusal of the impugned award, what<\/p>\n
enzergiesisiiiihatithe_iTr_ibunal has committed a grave error in assessing<\/p>\n
 incorrie”  at Rs. 4,000\/– p.m. and deducting 1\/3″<\/p>\n
if-towards personal ‘expenses of the deceased cannot be justifiable for<\/p>\n
‘riea.so’nsi-that if the Advocate is practicing for more than ten years<\/p>\n
 Tribiunaliiought to have considered his age, status and nature of<\/p>\n
\/<\/p>\n
work. The deceased is having agricultural land also. Assessing the<\/p>\n
monthly income of the deceased at Rs. 4,000\/– pm. is  and<\/p>\n
on lower side. Having regard to the age and occvup’at.ion.:”We can, <\/p>\n
safely assess monthly income of the dece-asedmat <\/p>\n
the interest of justice and 50% of tl1e__same”‘toi’oe de.dticgte:d_VVtoV:’\u00a7\/ards.3><\/p>\n
personal expenses, the monthly incomiewcvoines  The<\/p>\n
deceased was aged about 45  _ The gypropervniulgtiplier is 14 in the<\/p>\n
light of the judgment of the l’lO’i”i7:bl:t? Supreme;  in the case of<\/p>\n
Sarla Verma (Smt..)_.anldi l\u00e9ellii Corporation and
\nanother   Cases 121. We
\nredetermine they  loss of estate instead of loss of
\ndependency referredtvy  in a sum of Rs. 5,04,000\/– as
\nagainst’  2__\/-  ‘3v.0G{‘)\/– x 12 x 14). Further, the Tribunal is<\/p>\n
rightly ‘justi’\ufb01edv–..:_ir1ldayyarding just and reasonable compensation of<\/p>\n
0,00.0\/–__ltowards’: of consortium and in this regard impugned<\/p>\n
—-j.ud.gme.nt and “award does not call for interference. However, the<\/p>\n
if  hast-awarded only Rs. 3,000\/- towards transportation and<\/p>\n
  funeral _expenses and it requires enhancement. Therefore we deem \ufb01t<\/p>\n

to award Rs. 10,000\/- towards transport and funeral expenses— The<\/p>\n
Tribunal has committed an error in not awarding compenspat-ioh-‘under<\/p>\n
the head loss of love and affection and we award Rs.  _  <\/p>\n
the same. Total compensation under conventional ._head-s’ w__ou_id.__be’i<\/p>\n
40,000\/- as against Rs. 23,000\/– awarded   iilniitalii,” <\/p>\n

Rs. 5.(},(_)_iO(i)\/-  proportionate interest shall be deposited in any<\/p>\n
