The petitioner has also prayed for direction to the<br \/>\nrespondents to permit the petitioner to possess and sell fireworks as<br \/>\nper the licence issued to the petitioner by the Deputy Controller of<br \/>\nExplosives which has been renewed upto March, 2010 by issuing<br \/>\nsuitable, writ, order or direction under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>[2]\tThis<br \/>\nCourt has passed a detailed order on 30th October, 2009<br \/>\nand admitted this petition and issued rule. While issuing rule, this<br \/>\nCourt has observed that granting interim relief at this stage shall<br \/>\namount to allowing the petition. Therefore, it would not be<br \/>\nappropriate at this stage to grant interim relief. This Court has<br \/>\nfurther observed that in view of the concurrent findings of both the<br \/>\nauthorities, this Court is of the view that it is subject to the<br \/>\nsatisfaction of the authority concerned to consider whether the<br \/>\nbusiness undertaken by the petitioner proves to be a hindrance to the<br \/>\npublic at large or not and thereby whether to grant or cancel the<br \/>\nlicence. The jurisdictional error which has been contested by the<br \/>\npetitioner can be decided only at the final stage and not admission<br \/>\nstage.\n<\/p>\n<p>[3]\tIn<br \/>\nview of the above order, Mr.C. L. Soni, learned advocate appearing<br \/>\nfor the petitioner has submitted that before going into the merits of<br \/>\nthe matter, the jurisdictional issue is required to be decided. He<br \/>\nhas, however, submitted that the respondent No.1 has recently decided<br \/>\nAppeal Nos.15 of 2009 and 17 of 2009 filed by Ambika Trading Company<br \/>\nand Ambika Trade Link Private Limited wherein the Additional<br \/>\nSecretary, Home Department has observed that the Joint Police<br \/>\nCommissioner (Traffic) has no jurisdiction to cancel the licence. At<br \/>\nthe most, he can decide as to whether  No Objection Certificate<br \/>\nissued or not. After above observation, the Additional Secretary has<br \/>\nremanded the matter to the Joint Commissioner (Traffic) for<br \/>\nreconsideration. Mr.Soni, relying on this appellate decision has<br \/>\nrequested the Court that earlier decision which is under challenge in<br \/>\nthe present petition is contrary to the subsequent decision of the<br \/>\nSecretary, Home Department. He has, therefore, submitted that the<br \/>\nmatter may be remanded to the Secretary to decide the case afresh in<br \/>\nlight of the decision taken by him.\n<\/p>\n<p>[4]\tMs.Manisha<br \/>\nNarsinghani, learned AGP appearing for the respondent No.1, on the<br \/>\nother hand, has submitted that she has no objection if the matter is<br \/>\nremanded to the Additional Secretary, Home Department for deciding<br \/>\nafresh.\n<\/p>\n<p>[5]\tIn<br \/>\nabove view of the matter and without going into merits of the matter,<br \/>\nsince the matter is to be remanded to the Secretary, Home Department,<br \/>\nimpugned order passed by him earlier is quashed and set aside with a<br \/>\ndirection to decide afresh in light of the order passed by him in<br \/>\nAppeal Nos.15 of 2009 and 17 of 2009. It is open for the petitioner<br \/>\nto make request and if such request is made, the same shall be<br \/>\nconsidered and appropriate decision shall be taken in the matter so<br \/>\nremanded by this Court and the same shall decide as expeditiously as<br \/>\npossible. Direct service is permitted.\n<\/p>\n<p>[6.]\tWith<br \/>\nthese directions and observations, this petition is, accordingly,<br \/>\ndisposed of. Rule is made absolute to the aforesaid extent.
