Justice V.K.MOHANAN\n\n Dated :09\/07\/2010\n\n O R D E R\n                         V.K.MOHANAN, J.\n                       -------------------------------\n                    Crl.Appeal No.1225 of 2010\n                       -------------------------------\n               Dated this the 9th day of July, 2010.\n\n                          J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred by the complainant in a<\/p>\n<p>prosecution for an offence punishable u\/s.138 of Negotiable<\/p>\n<p>Instruments Act, as he is aggrieved by the order of the trial court<\/p>\n<p>u\/s.256(1) of Cr.P.C.\n<\/p>\n<p>      2. The learned counsel for the appellant submitted that,<\/p>\n<p>the accused entered appearance and recorded his pleading only<\/p>\n<p>on 5.1.2010 and on the next posting date, the impugned order is<\/p>\n<p>passed by the trial court.         The learned counsel also made<\/p>\n<p>available to me a certified copy of the proceedings of the trial<\/p>\n<p>court, which is sufficient to substantiate the submission made by<\/p>\n<p>the learned counsel.\n<\/p>\n<p>      3. From the order impugned, it is not discernible whether<\/p>\n<p>the complainant was persistently absent and negligent in<\/p>\n<p>adducing evidence. As the impugned order was passed on the<\/p>\n<p>first date of posting, after recording the plea of the accused, I am<\/p>\n<p>Crl.Appeal No.1225 of 2010<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>of the view that the learned Magistrate is not justified in<\/p>\n<p>acquitting the accused u\/s.256(1) of Cr.P.C., only for the reason<\/p>\n<p>that the complainant was not present on that particular date.<\/p>\n<p>      In the result, this appeal is disposed of setting aside the<\/p>\n<p>order dated 8.1.2010 in S.T.No.739\/08 of the trial court.<\/p>\n<p>Accordingly, the appellant\/complainant is directed to appear<\/p>\n<p>before the trial court on 10.8.2010, on which date the learned<\/p>\n<p>Magistrate is directed to restore the complaint on file and to<\/p>\n<p>proceed with the same in accordance with the procedure and<\/p>\n<p>law and dispose of the same on merit.\n<\/p>\n<\/p>\n<p>                                                V.K.MOHANAN,<br \/>\n                                                      Judge.\n<\/p>\n<p>ami\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.R.Ramachandran vs Bhargavi on 9 July, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM CRL.A.No. 1225 of 2010() 1.
