Balakrishnan.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>Shah, J.\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<br \/>\n    Aggrieved  by the judgment and order dated 8th December,<br \/>\n1995  passed  by  the High Court of Punjab  and\t Haryana  in<br \/>\nCriminal  Appeal No.  449-SB of 1986 confirming the judgment<br \/>\nand  order  passed by the Additional Sessions Judge,  Karnal<br \/>\ndated  6.5.1986\t convicting  the appellant for\tthe  offence<br \/>\npunishable  under  Section  15\tof the\tNarcotic  Drugs\t and<br \/>\nPsychotropic  Substances Act, 1985 (hereinafter referred  to<br \/>\nas  the\t N.D.P.S.   Act)  and  sentencing  him\tto  suffer<br \/>\nrigorous imprisonment for 10 years and a fine of Rs.One lac,<br \/>\nin  default of payment of fine further rigorous imprisonment<br \/>\nfor 5 years, the appellant has preferred this appeal.\n<\/p>\n<p>    The accused was charged under Section 15 of the N.D.P.S.<br \/>\nAct.   For proving the same, prosecution has examined P.W.2.<br \/>\nIshwar Singh, SI who on 12th January 1986 at about 5.25 p.m.<br \/>\nwas  present  on platform No.  1 of Railway Station,  Karnal<br \/>\nfor  checking smuggling and other anti-social elements.\t  At<br \/>\nabout  5.25  p.m.  Kalka passenger train arrived  at  Karnal<br \/>\nfrom  the side of Panipat and halted at platform No.  1.  It<br \/>\nis  his\t say  that  when  he was  checking  a  second  class<br \/>\ncompartment,   the   appellant\twho   was  sitting  in\t the<br \/>\ncompartment  became panicky and left the train from the door<br \/>\ntowards\t the side of engine carrying a katta (gunny bag)  on<br \/>\nhis  left shoulder.  On suspicion, he was nabbed in presence<br \/>\nof witness and it was found that he was carrying poppy straw<br \/>\nweighing  7 k.g.  in a polythene bag of white colour.  After<br \/>\nseparating  100 gms by way of sample, sample and the residue<br \/>\nwere  separately sealed in two separate parcels in  presence<br \/>\nof  witness.   The  seal which was affixed  on\tparcels\t was<br \/>\nhanded over to the witness (PW1) Harbans Lal.  He has stated<br \/>\nthat  the  case property was deposited with MHC on the\tsame<br \/>\nday.   He has also stated that on the personal search of the<br \/>\naccused,  second  class\t railway ticket was  recovered.\t  In<br \/>\ncross-examination,  it\tis his say that he  intercepted\t the<br \/>\naccused outside the compartment of platform No.\t 1.  At that<br \/>\ntime,  Harbans Lal was present at the railway station to see<br \/>\noff  his relatives.  He offered himself to become witness to<br \/>\nthe  recovery.\t He  has  also deposed that  seal  used\t for<br \/>\nsealing\t the case property remained with Harbans Lal for ten<br \/>\ndays.  It is his say that he had fixed only one seal made of<br \/>\nbrass bearing I.S.  on the gunny bag and also on the sample.<br \/>\nHe  admitted  that seal of the police station  is  different<br \/>\nfrom  the  seal of the Investigating Officer and he has\t not<br \/>\naffixed\t the seal of police station on the case property  as<br \/>\nalso on the sample at the time of delivery to M.H.C.  He has<br \/>\nalso  admitted\tthat  he was not maintaining any  record  of<br \/>\ninformation   sent  to\tCircle\t Inspector  of\tthe   Police<br \/>\nHeadquarter,   G.R.P.\t It  is\t his   say   that   he\t had<br \/>\ntelephonically\tinformed  his  superior\t officer  about\t the<br \/>\nseizure and its quantity.  He has denied the suggestion that<br \/>\naccused\t who was a rikshaw puller was falsely implicated  in<br \/>\nthe  case.   He has also denied the suggestion that  accused<br \/>\nasked  to  be  searched in presence of Magistrate  or  other<br \/>\nsuperior officer.\n<\/p>\n<p>    Prosecution\t has  also examined P.W.  1 Harbans  Lal,  a<br \/>\npanch  witness.\t It is his say that on the date of  incident<br \/>\nhe  was\t at  the railway station to see off his\t sister\t and<br \/>\nbrother\t in  law.   At\tthat time, he  noticed\tthe  accused<br \/>\nalighting  from the train on seeing the police.\t  Therefore,<br \/>\naccused\t was  nabbed  by the police in\this  presence.\t The<br \/>\npolice\tfound  that  the accused was  carrying\tpoppy  straw<br \/>\nplaced in polythene bag which on weighment was found to be 7<br \/>\nk.g.   The  police took sample of 100 grams.   The  recovery<br \/>\nmemo was prepared in his presence which he had attested.  In<br \/>\ncross-\texamination, he has stated that before searching the<br \/>\ncontents of gunny bag, the police had not offered itself for<br \/>\nsearch\tto the accused.\t It is his say that seal affixed  on<br \/>\nthe  case  property was made of wood (as against the say  of<br \/>\nthe  Investigating  Officer that it was a brass seal).\t The<br \/>\nseal  was  kept with him for 10 days.  He has also  admitted<br \/>\nthat  he had appeared as a prosecution witness in one excise<br \/>\ncase  and  that he was having business of sale of  tea\tnear<br \/>\nTonga  Stand  outside  the railway station for the  last  15<br \/>\nyears.\t It  is\t his say that he had not  earlier  seen\t the<br \/>\nground\tpoppy husk and the police had informed him that\t the<br \/>\nsubstance recovered from the accused was ground poppy husk.\n<\/p>\n<p>    Learned  counsel  for the appellant submitted  that\t the<br \/>\nInvestigating  Officer\thas  not   followed  the   procedure<br \/>\nprescribed  under  Section  50 of the Act of  informing\t the<br \/>\naccused\t whether search should be carried out in presence of<br \/>\nGazetted  Officer  or Magistrate.  As against this,  learned<br \/>\ncounsel\t for  the respondent submitted that in\tthe  present<br \/>\ncase,  there  is  no question of following  procedure  under<br \/>\nSection\t 50 because from the person of the accused,  nothing<br \/>\nwas  recovered, but from the gunny bag which he was holding,<br \/>\npoppy  straw  was recovered.  For this purpose\treliance  is<br \/>\nplaced\ton  the decisions of this Court in Kalema  Tumba  v.<br \/>\nState  of Mahrashtra [(1999) 8 SCC 463] and <a href=\"\/doc\/1438183\/\">State of  Punjab<br \/>\nv.  Baldev Singh<\/a> [(1999) 6 SCC 172].\n<\/p>\n<p>    In\tKalema\tTumba  (supra)\tthis  Court  considered\t the<br \/>\nmandatory  requirement\tof Section 50 of NDPS Act  and\theld<br \/>\nthat  only when the person of an accused is to be searched<br \/>\nthen  he  is required to be informed about his right  to  be<br \/>\nexamined  in presence of a gazetted officer or a magistrate.<br \/>\nThe  Court further held that in view of the decision in\t the<br \/>\ncase  of Baldev Singh (supra) the decision rendered by\tthis<br \/>\nCourt in <a href=\"\/doc\/1846579\/\">State of Punjab v.  Jasbir Singh<\/a> [(1996) 1 SCC 288]<br \/>\nwherein\t it  was held that though poppy husk  was  recovered<br \/>\nfrom the bags of the accused, he was required to be informed<br \/>\nabout  his  right to be searched in presence of\t a  gazetted<br \/>\nofficer\t or a magistrate stood overruled.  In facts of\tthat<br \/>\ncase  the  Court held that Heroine was found from  the\tbags<br \/>\nbelonging  to  the  appellant and not from  his\t person\t and<br \/>\ntherefore  it was not necessary to make an offer for  search<br \/>\nin presence of a gazetted officer or a magistrate.\n<\/p>\n<p>    In\tthe case of Baldev Singh (supra) the  Constitutional<br \/>\nBench  (in para 12) observed thus:  &#8211; On its plain reading,<br \/>\nSection 50 would come into play only in the case of a search<br \/>\nof  a  person as distinguished from search of  any  premises<br \/>\netc.\n<\/p>\n<p>    Further  after  considering various decisions the  Court<br \/>\nheld  (in para 57) that when an empowered officer or a\tduly<br \/>\nauthorised  officer acting on prior information is about  to<br \/>\nsearch\ta  person, it is imperative for him to inform  the<br \/>\nperson\tconcerned  of  his right under\tsub-section  (1)  of<br \/>\nSection 50 of being taken to the nearest gazetted officer or<br \/>\nthe nearest magistrate for making the search.  However, such<br \/>\ninformation may not necessarily be in writing.\n<\/p>\n<p>    In\tview of the aforesaid decision of the Constitutional<br \/>\nBench,\tin  our view, no further discussion is\trequired  on<br \/>\nthis  aspect.\tHowever, we may mention that this  right  is<br \/>\nextension  of  right conferred under Section 100 (3) of\t the<br \/>\nCriminal  Procedure Code.  Sub-Section (1) of Section 100 of<br \/>\nthe  Code provides that whenever any place liable to  search<br \/>\nor inspection is closed, any person residing in, or being in<br \/>\ncharge\tof,  such place, shall, on demand of the officer  or<br \/>\nother person executing the warrant, and on production of the<br \/>\nwarrant,  allow\t him  free ingress thereto, and\t afford\t all<br \/>\nreasonable facilities for a search therein.  Sub-Section (3)<br \/>\nprovides  that\twhere any person in or about such  place  is<br \/>\nreasonably  suspected  of  concealing about his\t person\t any<br \/>\narticle\t for which search should be made, such person may be<br \/>\nsearched  and if such person is a woman, the search shall be<br \/>\nmade  by  another  woman  with\tstrict\tregard\tto  decency.<br \/>\nSub-section  (7)  of Section 100 further provides that\twhen<br \/>\nany  person is searched under sub-section (3) a list of\t all<br \/>\nthings\ttaken  possession  of shall be prepared and  a\tcopy<br \/>\nthereof\t shall be delivered to such person.  This would also<br \/>\nbe  clear  if  we  refer to search  and\t seizure,  procedure<br \/>\nprovided  under\t Sections  42  and   43\t of  the   building,<br \/>\nconveyance  or place.  Hence, in our view, Section 50 of the<br \/>\nN.D.P.S.   Act would be applicable only in those cases where<br \/>\nthe search of the person is carried out.\n<\/p>\n<p>    The\t learned  counsel for the appellant  next  contended<br \/>\nthat  from the evidence it is apparent that the I.  O.\t has<br \/>\nnot  followed the procedure prescribed under Sections 52, 55<br \/>\nand  57 of the N.D.P.S.\t Act.  May be that the I.O.  had  no<br \/>\nknowledge  about  the operation of the N.D.P.S.\t Act on\t the<br \/>\ndate  of  the incident as he recorded the FIR under  Section<br \/>\n9\/1\/78\tof  the\t Opium\tAct.  In our  view,  there  is\tmuch<br \/>\nsubstance in this submission.  It is true that provisions of<br \/>\nSections  52  and  57  are directory.\tViolation  of  these<br \/>\nprovisions  would  not\tipso  facto  violate  the  trial  or<br \/>\nconviction.   However,\tI.O.   cannot totally  ignore  these<br \/>\nprovisions  and\t such  failure\twill   have  a\tbearing\t  on<br \/>\nappreciation  of evidence regarding arrest of the accused or<br \/>\nseizure\t of  the  article.  In the present case,  I.O.\t has<br \/>\nadmitted  that\tthe seal which was affixed on  the  muddamal<br \/>\narticle\t was  handed over to the witness P.W.1 and was\tkept<br \/>\nwith  him  for\t10  days.  He has  also\t admitted  that\t the<br \/>\nmuddamal parcels were not sealed by the officer in charge of<br \/>\nthe  police  station  as required under Section\t 55  of\t the<br \/>\nN.D.P.S.   Act.\t  The prosecution has not led  any  evidence<br \/>\nwhether\t the  Chemical\tAnalyser received  the\tsample\twith<br \/>\nproper\tintact\tseals.\tIt creates a doubt whether the\tsame<br \/>\nsample\twas  sent to the Chemical Analyser.  Further, it  is<br \/>\napparent  that\tthe  I.O.  has not  followed  the  procedure<br \/>\nprescribed  under Section 57 of the N.D.P.S.  Act of  making<br \/>\nfull  report of all particulars of arrest and seizure to his<br \/>\nimmediate superior officer.  The conduct of panch witness is<br \/>\nunusual as he offered himself to be a witness for search and<br \/>\nseizure\t despite  being not asked by the I.O.,\tparticularly<br \/>\nwhen he did not know that the substance was poppy husk., but<br \/>\ncame  to  know\tabout it only after being  informed  by\t the<br \/>\npolice.\t  Further,  it is the say of the Panch witness\tthat<br \/>\nMuddamal seal used by the PSI was a wooden seal.  As against<br \/>\nthis,  it is the say of PW2 SI\/IO that it was a brass  seal.<br \/>\nOn   the  basis\t of  the   aforesaid  evidence\tand   faulty<br \/>\ninvestigation  by the prosecution, in our view, it would not<br \/>\nbe  safe  to convict the appellant for a serious offence  of<br \/>\npossessing poppy-husk.\n<\/p>\n<p>    In\tthe  result, the appeal is allowed and the  impugned<br \/>\njudgment  and order passed by the High Court confirming\t the<br \/>\nconviction  of the appellant is set aside.
