The matter came up for hearing on<br \/>\n02.09.2011. The appellant was absent, whereas the respondents were represented by<br \/>\nShri P.S.S. Reddy, Director.\n<\/p>\n<p>2.      The appellant filed RTI-request dated 7.1.2011 seeking information on four queries\n<\/p>\n<p>&#8211; (1) Please furnish the reply given by Managing Director M\/s. Orissa Mining Development<br \/>\nCorporation, Bhubaneshwar against the show cause notice vide letter ref no. 47011\/1(1)\/2001-<br \/>\nCPAM\/CA-1 dated 29.9.2010 issued by Shri V.S. Rana, Under Secretary, Ministry of Coal; (2) If<br \/>\nthe said reply as depicted in Q. 1 was not received within 30 days from the date of issue of show<br \/>\ncause to Ministry of Coal, then please furnish the document related to appropriate action taken<br \/>\nagainst M\/s. Orissa Mining Development Corporation for de-allocation of Utkal &#8211; D block; (3)<br \/>\nPlease furnish the report of M\/s OMC vide letter dated 18.8.2010 about the item of formation of<br \/>\njoint venture as illustrated in para 2 of the above show-cause notice; and (4) Please furnish<br \/>\nclarification given by the Ministry of Coal by its letter No. 38039\/40\/2007-CA-1 dated 1.4.2009.<br \/>\nThe CPIO vide letter No. 38040\/4\/2011-CA-I dated 21.1.2011 requested the appellant to<br \/>\ndeposit Rs. 8, consisting of four pages of information, pertaining Point No. 4. Information<br \/>\non Point No. 1 to 3 was denied u\/s 8(1) (h) of the RTI Act.\n<\/p>\n<p><span class=\"hidden_text\">                                             2          Case No. CIC\/SS\/A\/2011\/001039<\/span><\/p>\n<p>3.     Aggrieved by reply of CPIO, the appellant preferred first-appeal on 18.2.2011<br \/>\nbefore FAA. The appellant has not received FAA&#8217;s order till the filing of second-appeal<br \/>\nbefore the Commission.\n<\/p>\n<p>4.     During the hearing the respondent submitted that FAA vide order No. A-60011\/<br \/>\n20\/2011-Coord dated 19.5.2011 has decided appellant&#8217;s first-appeal with the direction to<br \/>\nCPIO to provide information on Point No. 1 to 3 of appellant&#8217;s application dated 7.1.2011<br \/>\nwithin 15 days.     In compliance with the FAA&#8217;s direction the CPIO vide letter No.<br \/>\n38040\/4\/2011-CA-I dated 13.7.2011 provided the requisite information to the appellant.\n<\/p>\n<p>5.
