Justice THOMAS P.JOSEPH\n\n Dated :07\/10\/2010\n\n O R D E R\n                   THOMAS P.JOSEPH, J.\n           ====================================\n                   W.P(C) No.12863 of 2010\n           ====================================\n          Dated this the 07th    day of October, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>     This Writ Petition is at the instance of judgment debtor No.1<\/p>\n<p>in E.P.No.404 of 2004 in O.S. No.708 of 1996 of the court of<\/p>\n<p>learned Principal Sub Judge, Ernakulam. For the amount due to<\/p>\n<p>respondent No.1-decree holder property of petitioner was brought<\/p>\n<p>up for sale.  At that stage petitioner filed E.A. No.128 of 2010<\/p>\n<p>under Rule 69 of Order XXI and Section 151 of the Code of Civil<\/p>\n<p>Procedure (for short, &#8220;the Code&#8221;) to adjourn the sale for a further<\/p>\n<p>period of one month (obviously for payment of the amount due<\/p>\n<p>under the decree). That application was dismissed by the learned<\/p>\n<p>Sub Judge as per Ext.P3, order on 11.02.2010. That was followed<\/p>\n<p>by Ext.P4, order as per which property was sold on 11.02.2010 for<\/p>\n<p>Rs.6,00,000\/- and execution petition was posted for confirmation of<\/p>\n<p>sale on 12.04.2010.       Exhibits P3 and P4, orders are under<\/p>\n<p>challenge in this Writ Petition.\n<\/p>\n<p>     2.     Though various grounds are urged in the petition in<\/p>\n<p>challenge of the sale and       though it is contended by learned<\/p>\n<p>counsel for respondent No.1 that no application to set aside sale as<\/p>\n<p>contemplated under Order XXI of the Code was preferred by the<\/p>\n<p>   W.P(C) No.12863 of 2010<\/p>\n<p><span class=\"hidden_text\">                                  -: 2 :-<\/span><\/p>\n<p>petitioner in the executing court and hence this petition itself is<\/p>\n<p>not maintainable, counsel for petitioner, counsel for respondent<\/p>\n<p>No.1 and counsel for respondent No.2-auction purchaser (who<\/p>\n<p>already deposited a portion of the bid amount in the executing<\/p>\n<p>court) have now come to terms after consultation with parties<\/p>\n<p>concerned and accordingly they have settled the terms between<\/p>\n<p>them. Accordingly petitioner has to pay the entire decree amount<\/p>\n<p>as on the date of sale, i.e., 11.02.2010 (less the amount if any<\/p>\n<p>already paid) to respondent No.1-decree holder within a week<\/p>\n<p>from this day.    So far as the claim of respondent No.2-auction<\/p>\n<p>purchaser is concerned he is willing to give up his claim for the<\/p>\n<p>property purchased by him in auction if petitioner pays              a<\/p>\n<p>consolidated sum of Rs.65,000\/- towards interest and costs within<\/p>\n<p>a week from this day. It is also agreed between the parties that<\/p>\n<p>the amount deposited by respondent No.2 in the executing court<\/p>\n<p>pursuant to his bid in the auction can be withdrawn by him.<\/p>\n<p>Submission made by counsel on both sides is accepted and<\/p>\n<p>recorded.\n<\/p>\n<\/p>\n<p>      Resultantly, Writ Petition is disposed of in the following lines:<\/p>\n<p>            (a)    Sale conducted by the executing court on<\/p>\n<p>W.P(C) No.12863 of 2010<\/p>\n<p><span class=\"hidden_text\">                                 -: 3 :-<\/span><\/p>\n<p>  11.02.2010 shall stand set aside on fulfillment of the<\/p>\n<p>  following conditions:\n<\/p>\n<\/p>\n<blockquote><p>                    (i)   Petitioner shall pay the<\/p>\n<p>            entire decree amount as on the date<\/p>\n<p>            of sale, i.e., 11.02.2010 (less the<\/p>\n<p>            amount if any already paid) to<\/p>\n<p>            respondent No.1 within a week from<\/p>\n<p>            this day as above stated.<\/p>\n<\/blockquote>\n<blockquote><p>                    (ii)  Respondent    No.1   shall<\/p>\n<p>            file a statement in the executing<\/p>\n<p>            court within a further period of one<\/p>\n<p>            week from the date of receipt of<\/p>\n<p>            money.<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                    (iii) Petitioner shall deposit a<\/p>\n<p>            consolidated     sum    of   Rs.65,000\/-<\/p><\/blockquote>\n<p>            (Rupees Sixty five thousand only) in<\/p>\n<p>            the executing court for payment to<\/p>\n<p>            respondent No.2 being costs and<\/p>\n<p>            interest on the amount deposited by<\/p>\n<p>W.P(C) No.12863 of 2010<\/p>\n<p><span class=\"hidden_text\">                               -: 4 :-<\/span><\/p>\n<p>            respondent No.2 in the executing<\/p>\n<p>            court within a period of one week<\/p>\n<p>            from this day.\n<\/p>\n<\/p>\n<p>                    (iv) On compliance of       the<\/p>\n<p>            above conditions it will be open to<\/p>\n<p>            respondent No.2 to withdraw the<\/p>\n<p>            amount mentioned in clause (iii) and<\/p>\n<p>            the amount he already deposited in<\/p>\n<p>            the executing court.\n<\/p>\n<\/p>\n<p>                    (v)  On      compliance      of<\/p>\n<p>            condition Nos.(i) to (iii) the sale held<\/p>\n<p>            by      the   executing      court   on<\/p>\n<p>            11.02.2010 will stand set aside.<\/p>\n<\/p>\n<p>                    (vi) In case condition Nos.(i)<\/p>\n<p>            and (iii)     are not complied with as<\/p>\n<p>            aforesaid this petition will stand<\/p>\n<p>            dismissed.\n<\/p>\n<\/p>\n<p>        (b)     Respondent No.1 shall on receipt of the<\/p>\n<p>  W.P(C) No.12863 of 2010<\/p>\n<p><span class=\"hidden_text\">                                 -: 5 :-<\/span><\/p>\n<p>    amount and along with filing of the statement report<\/p>\n<p>    full satisfaction of the decree to the executing court so<\/p>\n<p>    that the execution petition can be closed.<\/p>\n<p>                             THOMAS P.
