The\t trial court rejected the  plaintiffs  claim\nthat he was the owner of the house in question.\n    On\tappeal, the Additional District.judge confirmed\t the\nfinding of the trial court on the ground that the  plaintiff\ndid not produce the deed of partition, alleged to have\tbeen\nexecuted  by  the  parties and, under  which  the  house  in\nquestion  was said to have been allotted to him.  In  second\nappeal, the High Court reversed the finding and decreed\t the\nsuit.\n    In the appeal to this Court, on behalf of the tenant  it\nwas  contended\tthat  it was essential\tfor  the  plaintiff-\nrespondent  to\testablish  that\t he was\t the  owner  of\t the\npremises,  and that the concurrent finding of fact  recorded\nby  first two courts was binding on the High Court under  s.\n100  of\t the Code of Civil Procedure and  its  reversal\t was\nillegal.\n    Dismissing the appeal,\n    HELD:  1.1 The High Court's power to interfere with\t the\nfinding of fact reached by the first appellate court  cannot\nbe  denied  if, when the lower appellate  court\t decides  an\nissue  of fact, a substantial question of law  arises,\teven\n\t\t\t\t\t\t  PG NO 276\n\t\t\t\t\t\t  PG NO 277\nthough the High Court, while hearing the appeal under s. 100\nof  the Code of Civil Procedure, has no jurisdiction to\t re-\nappraise the evidence and reverse the conclusion reached  by\nthe first appellate   court.[280C]\n    The court is under a duty to examine the entire relevant\nevidence  on record and if it refuses to consider  important\nevidence having direct\t B bearing on the disputed issue and\nthe error which arises is of a magnitude that it gives birth\nto  a substantial question of law, the High Court  is  fully\nauthorised to set aside the finding. [280D]\n    1.2\t A perusal of the language of the clause (f)  of  s.\n12(l) of the Madhya Pradesh Accommodation Control Act, 1961,\nand  comparison\t there\tof with that in\t the  other  clauses\nclearly indicates that it is essential for the plaintiff who\nclaims\tthat he requires the shop personally for starting  a\nbusiness, to establish that he is the owner of the premises.\n[278G-H]\n    In\tthe  instant case, though the partition\t deed  under\nwhich the\t  D plaintiff claims exclusive title to\t the\nproperty  was  not produced in court,  the  first  appellate\ncourt was under a duty to consider all the relevant evidence\nled  by the parties along with the circumstances. The  Civil\nJudge, who tried the suit as well as the Additional District\nJudge,\tconfirming  the\t decision of the  trial\t court,\t had\nseriously  erred in not considering the entire\tevidence  on\nrecord\tincluding  the\treply  to the  notice  sent  by\t the\nplaintiff-respondent,  wherein\tthe  tenant-appellant\t has\naccepted  the  plaintiff's title and  counter-foil  receipts\nsigned\tby  the appellant in which the\tplaintiff  had\tbeen\ndescribed   as\t the   owner  of  the\tproperty.   In\t the\ncircumstances,\tthe  High  Court  was  fully  justified\t  in\nreversing the finding of the courts below. [279E, F-G, 280A]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>   CIVlL  APPELLATE JURlSDlCTlON: Civil Appeal No. 3387\t of<br \/>\n<span class=\"hidden_text\">1981<\/span><br \/>\n    From  the  Judgment\t and Order dated  20.8.1981  of\t the<br \/>\nMadhya\tPradesh High Court in Second Appeal No. 33 of  1978.<br \/>\n    S.N. Jain for the Respondent.\n<\/p>\n<p>    The Judgment of the Court was delivered by<br \/>\n\t\t\t\t\t\t  PG NO 278<br \/>\n    SHARMA,J. The appellant is in possession of a shop in  a<br \/>\ntown in Madhya Pradesh as a tenant under the respondent\t who<br \/>\nfiled a suit out of which the present appeal arises for\t his<br \/>\neviction  on the ground of personal necessity. The suit\t was<br \/>\ndismissed by the trial court and the first appellate  court.<br \/>\nThe  High Court in second appeal has reversed  the  decision<br \/>\nand passed a decree.\n<\/p>\n<p>    2.\t The  case  is\tgoverned  by  the   Madhya   Pradesh<br \/>\nAccommodation Control Act, 1961 (hereinafter referred to  as<br \/>\nthe Act) and s. 12(1)(f) deals with the ground of landlord&#8217;s<br \/>\nbona fide necessity with reference to buildings let out\t for<br \/>\nnon-residential purposes, in the following words:\n<\/p>\n<p>    &#8220;12.    Restriction\t  on   eviction\t   of\t tenants-(l)<br \/>\nNotwithstanding\t anything to the contrary contained  in\t any<br \/>\nother  law or contract, no suit shall be filed in any  Civil<br \/>\nCourt\tagainst\t  a  tenant  for  his  eviction\t  from\t any<br \/>\naccommodation except on one or more of the following grounds<br \/>\nonly, namely :\n<\/p>\n<blockquote><p>\t     (a)  &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t\t  &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p><\/blockquote>\n<p>    (f)\t that  the  accommodation  let\tfor  non-residential<br \/>\npurposes  is  required\tbona fide by the  landlord  for\t the<br \/>\npurpose\t of continuing or starting his business or  that  of<br \/>\nany  of his major sons or unmarried daughters if he  is\t the<br \/>\nowner  thereof\tor  for any person  for\t whose\tbenefit\t the<br \/>\naccommodation is held and that the land- lord or such person<br \/>\nhas    no   other   reasonably\t suitable    non-residential<br \/>\naccommodation  of his own in his occupation in the  city  or<br \/>\ntown concerned ;\n<\/p>\n<blockquote><p>\t     (g)   &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<br \/>\n\t\t   &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/p><\/blockquote>\n<p>    3.\tThe  plaintiff\tclaims that  he\t requires  the\tshop<br \/>\npersonally  for\t starting  a  business\tand  it\t is  rightly<br \/>\ncontended  by Mr. Kacker, learned counsel appearing for\t the<br \/>\nappellant, that it is essential for him to establish that he<br \/>\nis  the owner of the premises. A perusal of the language  of<br \/>\nthe  clause  (f) and a comparison thereof with that  in\t the<br \/>\nother clauses clearly leads to this conclusion. The issue in<br \/>\nthe case is whether the plaintiff, respondent before us, has<br \/>\nbeen able to establish this condition.\n<\/p>\n<p>\t\t\t\t\t\t  PG NO 279\n<\/p>\n<p>    4. The defendant has been admittedly paying the rent  to<br \/>\nthe plaintiff who, therefore, is included in the  expression<br \/>\n&#8216;landlord&#8217;  as defined in the Act as a person  receiving  or<br \/>\nentitled  to receive the rent whether on his own account  or<br \/>\non  account  of\t any other person. In the  register  of\t the<br \/>\nMunicipal Corporation the property stands in the name of the<br \/>\nplaintiff&#8217;s  brother  Hukum Chand Jain. On this\t ground\t the<br \/>\ntrial  court  rejected the plaintiff&#8217;s case  that  the\tshop<br \/>\nbelongs\t to  him. On appeal the Additional  District  Judge,<br \/>\nGwalior confirmed the finding mainly on the ground that\t the<br \/>\nplaintiff  did\tnot produce the deed of partition  which  is<br \/>\nalleged to have been executed by the parties and under which<br \/>\nthe house was claimed by the plaintiff to have been allotted<br \/>\nto him. The Court also held that since the plaintiff  failed<br \/>\nto  plead  his ownership and further neglected\tto  get\t his<br \/>\nplaint\tamended\t after his title was denied in\tthe  written<br \/>\nstatement,  he was not entitled to rely on any\tevidence  in<br \/>\nsupport\t of  his  title. On the plaintiff  filing  a  second<br \/>\nappeal,\t the Madhya Pradesh High Court reversed the  finding<br \/>\nand decreed the suit.\n<\/p>\n<p>    5. Mr. Kacker strongly urged that the concurrent finding<br \/>\nof fact recorded by the first two courts was binding on\t the<br \/>\nHigh  Court under s. 100 of the Code of Civil Procedure\t and<br \/>\nits reversal is illegal. We have gone through all the  three<br \/>\njudgments and some of the documents placed before us by\t the<br \/>\nlearned\t counsel for the parties and we find that  the\tHigh<br \/>\nCourt  was  fully justified in reversing  the  finding.\t The<br \/>\nfirst  appellate court was not correct in assuming that\t the<br \/>\nplaintiff  had failed to assert in the plaint his  ownership<br \/>\nof the disputed shop. The necessary pleading is to be  found<br \/>\nin paragraph 1 of the plaint, which of course was denied  in<br \/>\nthe written statement and the parties led their evidence  on<br \/>\nthis  question at the trial. It is true that  the  partition<br \/>\ndeed under which the plaintiff claims exclusive title to the<br \/>\nproperty was not produced in court, but the first  appellate<br \/>\ncourt was under a duty to consider all the relevant evidence<br \/>\nled   by   the\tparties\t along\t with\tthe   circumstances.<br \/>\nUnfortunately neither the Civil Judge who tried the suit nor<br \/>\nthe Additional District Judge confirming the decision of the<br \/>\ntrial court adverted to important items of relevant evidence<br \/>\nwhich were considered and relied upon by the High Court. The<br \/>\nplaintiff, before filing the suit, sent a notice through his<br \/>\ncounsel,  to the appellant in which it was stated  that\t the<br \/>\nshop  in question belongs to him. In his reply sent  through<br \/>\nan   advocate  the  appellant,\twhile  denying\t the   other<br \/>\nstatements in the notice, accepted the plaintiff&#8217;s title  in<br \/>\nthe following words :\n<\/p>\n<p>    &#8220;That  it  is admitted that my client is  occupying\t the<br \/>\nshop situated at Dal Bazar belonging to your client. . . . &#8221;\n<\/p>\n<p>\t\t\t\t\t\t  PG NO 280<br \/>\n    The plaintiff also produced counter foil receipts signed<br \/>\nby the tenant-appellant in which the plaintiff was described<br \/>\nas &#8220;the owner of property&#8221;. It was not a case of an isolated<br \/>\nsingle\treceipt-quite  a  number  of  such  documents\twere<br \/>\nproduced  in  the trial court. The High Court was  right  in<br \/>\npointing  out that the courts below had seriously  erred  in<br \/>\nnot considering the entire evidence on the record  including<br \/>\nthe  aforesaid\tdocuments. It is true that  the\t High  Court<br \/>\nwhile  hearing the appeal under s. 100 of the Code of  Civil<br \/>\nProcedure  has no jurisdiction to re-appraise  the  evidence<br \/>\nand  reverse the conclusion reached by the  first  appellate<br \/>\ncourt, but at the same time its power to interfere with\t the<br \/>\nfinding\t cannot be denied if when the lower appellate  court<br \/>\ndecides\t an  issue  of fact a substantial  question  of\t law<br \/>\narises.\t The  court is under a duty to\texamine\t the  entire<br \/>\nrelevant  evidence on record and if it refuses\tto  consider<br \/>\nimportant  evidence  having direct bearing on  the  disputed<br \/>\nissue  and the error which arises is of a magnitude that  it<br \/>\ngives birth to a substantial question of law, the High Court<br \/>\nis  fully authorised to set aside the finding. This  is\t the<br \/>\nsituation  in  the  present  case.
