Respondents\n\n                                         -----------\n<\/pre>\n<p>04.   28.03.2011              Heard learned counsel for the petitioner and<\/p>\n<p>                     the counsel appearing for the State.\n<\/p>\n<p>                              Petitioner has filed this application for a<\/p>\n<p>                     direction to the Respondents to give him promotion<\/p>\n<p>                     to the post of Block Agriculture Officer with effect<\/p>\n<p>                     from the date juniors to him have been allowed such<\/p>\n<p>                     promotion and all consequential benefits for which<\/p>\n<p>                     he would have been entitled on account of such<\/p>\n<p>                     promotion.\n<\/p>\n<p>                              Petitioner&#8217;s case is that he joined his service<\/p>\n<p>                     in the year 1974 as Jan Sewak. He superannuated<\/p>\n<p>                     on 31.08.1990 from the post of Sub-divisional<\/p>\n<p>                     Officer, Agriculture (Extension No. 1), Aurangabad.<\/p>\n<p>                     His grievance is that in the gradation list of Jan<\/p>\n<p>                     Sewak almost everyone was promoted to the post of<\/p>\n<p>                     Block Agriculture Officer, except the petitioner.<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>Persons, who were at serial no. 50 to 51 were given<\/p>\n<p>promotion, vide letter no. 6577, dated 02.05.1989,<\/p>\n<p>issued by the Director, Department of Agriculture,<\/p>\n<p>Government of Bihar, Patna. Petitioner&#8217;s name was<\/p>\n<p>at serial no. 53, but he was not given promotion<\/p>\n<p>though four juniors to him, appointed subsequently,<\/p>\n<p>were   given    promotion     to   the   post   of   Block<\/p>\n<p>Agriculture Officer and paid consequential benefits.<\/p>\n<p>Petitioner has stated that during his service period<\/p>\n<p>and subsequent to his superannuation he agitated<\/p>\n<p>this matter continuously. He was given promotion in<\/p>\n<p>super selection grade after his superannuation.<\/p>\n<p>Considering his representation in the year 2000, the<\/p>\n<p>Director,    Administration   had    written    a    letter,<\/p>\n<p>contained in Memo No. 3556, dated 27.07.2000 to<\/p>\n<p>the District Magistrate, Aurangabad for sending all<\/p>\n<p>connected service records of the petitioner, so that<\/p>\n<p>his representation can be considered and necessary<\/p>\n<p>orders can be passed. Despite this letter of Director,<\/p>\n<p>Administration, dated 27.07.2000, nothing was done<\/p>\n<p>and till date petitioner&#8217;s grievance has not been<\/p>\n<p>redressed.\n<\/p>\n<p>        Considering the fact that petitioner has<\/p>\n<p>retired in the year 1999 itself and the matter is very<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>      old, this application is being disposed of giving<\/p>\n<p>      liberty to the petitioner to re-agitate his matter<\/p>\n<p>      before    the   Respondent       Authorities    by   filing   a<\/p>\n<p>      representation. In case any such representation is<\/p>\n<p>      filed    by   the   petitioner    before    the    Secretary,<\/p>\n<p>      Department of Agriculture, Government of Bihar,<\/p>\n<p>      Patna he will look into the matter and dispose it of<\/p>\n<p>      considering the service record of the petitioner. The<\/p>\n<p>      representation of the petitioner must be disposed of<\/p>\n<p>      within four months from the date of its filing before<\/p>\n<p>      the      Secretary,       Department       of     Agriculture,<\/p>\n<p>      Government of Bihar, Patna. In case the petitioner is<\/p>\n<p>      found entitled for the consequential benefits of<\/p>\n<p>      promotional post, it should be allowed to him.
