2.   15.11.2010           Learned counsel for the State rightly points<\/p>\n
                  out that the impugned order terminating the service<\/p>\n
                  of the petitioner for dereliction of duty as Aganwari<\/p>\n
                  Sewika dated 12.10.2009, does not come within the<\/p>\n
                  purview of the Division Bench order dated 16.2.2010<\/p>\n
                  in L.P.A. No. 863 of 2009 reported in 2010(2) PLJR<\/p>\n
                  374. The petitioner therefore has a remedy of appeal<\/p>\n
                  before the District Magistrate.\n<\/p>\n
                          Leave is sought to withdraw the application<\/p>\n
                  to prefer an appeal before the District Magistrate.<\/p>\n
                  Only if the petitioner files such appeal or has already<\/p>\n
                  so filed and supplements the same if so advised<\/p>\n
                  within 30 days from today, let the District Magistrate<\/p>\n
                  consider and decide the same in accordance with<\/p>\n
                  law, by a reasoned and speaking order, without
\n                              2<\/span><\/p>\n
           going into issues of limitation, after hearing all<\/p>\n
           concerned preferably within a maximum period of<\/p>\n
           three months from the date of receipt\/production of<\/p>\n
           a copy of this order.\n<\/p>\n
                   The application is dismissed as withdrawn<\/p>\n
