Agrawal\nRespondent:            President's Secretariat\n                             Decision announced 5.3.'10\nFACTS<\/pre>\n<p>      By an application of 11-8-08 Shri S.C. Agrawal of Dariba, Delhi applied<br \/>\nto the CPIO, President&#8217;s Secretariat seeking the following information:\n<\/p>\n<blockquote><p>          &#8220;1.    Is President&#8217;s Secretariat aware that Delhi High Court<br \/>\n                has famed its own rules for &#8216;Right to Information Act&#8217;<br \/>\n                which are in contradiction to provisions of RTI Act as<br \/>\n                passed by the Parliament and assented by Honourable<br \/>\n                the President of India, and also to notifications issued by<br \/>\n                Department of Personnel &amp; Training from time to time?<\/p>\n<blockquote><p>      2.        If yes, please provide action taken by President&#8217;s<br \/>\n                Secretariat against registry of Delhi High Court against<br \/>\n                such framing of rules.\n<\/p><\/blockquote>\n<blockquote><p>      3.        Will President&#8217;s Secretariat approach judicial side of Delhi<br \/>\n                High Court under article 226 of the Constitution to get the<br \/>\n                things corrected?\n<\/p><\/blockquote>\n<blockquote><p>      4.        has some other public authority other than Delhi High<br \/>\n                Court also over rules provisions of RTI Act by imposing<br \/>\n                their own rules, which are in contradiction to provisions of<br \/>\n                RTI Act and to notifications issued by Department of<br \/>\n                Personnel, &amp; Training from time to time? If yes, kindly<br \/>\n                name those public authorities.\n<\/p><\/blockquote>\n<blockquote><p>      5.        Any other related information on the issue.\n<\/p><\/blockquote>\n<blockquote><p>      6.        Please provide file notings.&#8221;<\/p><\/blockquote>\n<p>      After going through the process of response and appeal appellant Shri<br \/>\nAgrawal has approached this Commission in 2nd appeal with the following<br \/>\nprayer:\n<\/p>\n<blockquote><p>      &#8220;APIO at Delhi High Court has made such an undue<br \/>\n      demand of additional RTI fees even after esteemed CIC<br \/>\n      verdict    dated    23.9.2008.      in    appeal    number<br \/>\n      <a href=\"\/doc\/1767059\/\">CIC\/WB\/A\/2007\/00418 (Kamini Jaiswal vs. Delhi High Court)<\/a><br \/>\n      where Honourable the Chief Information Commissioner had<br \/>\n      required that Delhi High Court may amend its rules in<br \/>\n      accordance with various sections of RTI Act.         Public<br \/>\n      Information Officer at Delhi High court may kindly be<br \/>\n      directed to provide required information as ought in my RTI<br \/>\n      petition dated 11.8.2008 addressed to President&#8217;s<br \/>\n      Secretariat without charging any additional fees of rupees<br \/>\n        forty. Public authority of Delhi High Court may kindly be<br \/>\n       directed to amend its rules in a manner that these may not<br \/>\n       deviate from provisions of RTI Act as passed by both<br \/>\n       Houses of the Parliament and assented by the President of<br \/>\n       India. Any other relief as deemed fit in favour of the<br \/>\n       petitioner may kindly be allowed.&#8221;<\/p><\/blockquote>\n<p>       The appeal was scheduled for hearing on 5-3-2010. In the meantime<br \/>\nwe have received a representation from Shri S.C. Agrawal dated 26-2-2010<br \/>\nsubmitting that, &#8220;The case has already been decided in another petition No.<br \/>\nCIC\/WB\/C\/2008\/00872.&#8221;\n<\/p>\n<p>                             DECISION NOTICE<\/p>\n<p>       We have examined the file on complaint No. CIC\/WB\/C\/2008\/00872.<br \/>\nWe find that we have indeed announced a decision in this matter together<br \/>\nwith a decision on complaint No. CIC\/WB\/C\/2008\/00871, on 10-7-2009. The<br \/>\napplication for information in file No. CIC\/WB\/C\/2008\/00872 is indeed the<br \/>\nsame as the initial application in the present appeal as quoted above.<br \/>\nWhereas that was a complaint u\/s 18(1) however, the present case is an<br \/>\nappeal u\/s 19(3).In our decision notice in that case we have announced as<br \/>\nfollows:\n<\/p>\n<blockquote><p>     &#8220;Clearly the fee payable under sub-Section (1) of Sections 6 and 7 is<br \/>\n     required to be prescribed by the competent authority by Rules<br \/>\n     provided to carry out the provisions of this Act. The CJ of the High<br \/>\n     Court is competent authority of the High Court and the President of<br \/>\n     India, who is represented in this matter through the administrative<br \/>\n     Ministry, the competent authority for all organisations not otherwise<br \/>\n     listed in sub-sec (e) of Sec 2. In no way therefore is the High Court of<br \/>\n     Delhi governed by the RTI (Regulation of Fee &amp; Cost Rules) 2005 of<br \/>\n     the DoPT.\n<\/p><\/blockquote>\n<blockquote><p>     In both these cases the appropriate &#8216;competent&#8217; authorities have<br \/>\n     published the Rules. This Commission has no jurisdiction to rule on<br \/>\n     the matter. However, this authority to make rules is qualified by the<br \/>\n     proviso to Section 7 (5), which states as follows:\n<\/p><\/blockquote>\n<blockquote><p>                7 (5)<br \/>\n                Provided that the fee prescribed under sub-section (1) of<br \/>\n                section 6 and sub-sections (1) and (5) of section 7 shall<br \/>\n                be reasonable and no such fee shall be charged from<br \/>\n                the persons who are of below poverty line as may be<br \/>\n                determined by the appropriate Government.\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>       It is for this reason that this Commission had under the authority<br \/>\n       vested in us under sub Section 5 of Section 25 recommended to<br \/>\n        the Hon&#8217;ble High Court of Delhi that they might review the fee<br \/>\n       initially prescribed in their Rules, which had then been kept at<br \/>\n       Rs. 500\/-. Accepting this recommendation the fee has now been<br \/>\n       brought to Rs. 50\/-, and it is in the context of recommendations<br \/>\n       received that Hon&#8217;ble the Chief Justice had expressed views<br \/>\n       that complainant Shri Agrawal quotes. There can be no grounds<br \/>\n       of complaint in this matter. Both complaints are, therefore,<br \/>\n       dismissed.&#8221;<\/p><\/blockquote>\n<p>       Clearly then the issue in the present appeal being a duplication of that<br \/>\nin the earlier complaint, which has already been adjudicated upon, hence<br \/>\nbecomes infructuous. This is accordingly dismissed.\n<\/p>\n<p>       Announced in the hearing.
