No. 3663 OF 2007\n\n                  ````````````````````````````````````````````````````\n\n               Dated this the 10th day of December, 2007\n\n\n                                    O R D E R\n<\/pre>\n<p>              The   petitioner   faces   indictment   in   a   prosecution<\/p>\n<p>under   Section   138   of   the   Negotiable   Instruments   Act.     The<\/p>\n<p>petitioner   was   not   available   in   India,   it   is   submitted.<\/p>\n<p>Consequently,   after   taking   cognizance,   on   account   of   non-<\/p>\n<p>availability   of   the   petitioner,   the   case   against   the   petitioner<\/p>\n<p>has   been   transferred   to   the   list   of   Long   Pending   Cases   and<\/p>\n<p>coercive processes have been issued against the petitioner.<\/p>\n<p>      2.      The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent. His absence earlier was<\/p>\n<p>not   wilful   or   deliberate.   The   petitioner   is   willing   to   surrender<\/p>\n<p>before   the   learned   Magistrate   and   seek   regular   bail.   But   he<\/p>\n<p>apprehends that his application for bail may not be considered<\/p>\n<p>by  the   learned   Magistrate   on   merits,   in   accordance   with  law<\/p>\n<p>and   expeditiously.   He,   therefore,   prays   that   directions   under<\/p>\n<p>Section 482 Cr.P.C. may be issued to the learned Magistrate<\/p>\n<p>to release the petitioner on bail when he appears and applies<\/p>\n<p>for bail.\n<\/p>\n<p>\nCRMC.3663\/07<\/p>\n<p><span class=\"hidden_text\">                                      : 2 :<\/span><\/p>\n<p>         3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate,   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I find absolutely no reason to assume<\/p>\n<p>that the learned Magistrate would not consider the application<\/p>\n<p>for bail to be filed  by the  petitioner on merits,  in accordance<\/p>\n<p>with law and expeditiously. Every court must do the same. No<\/p>\n<p>special   or   specific   directions   appear   to   be   necessary.<\/p>\n<p>Sufficient   general   directions   have   been   issued   in  <a href=\"\/doc\/147290035\/\">Alice<\/p>\n<p>George vs. Deputy Superintendent of Police<\/a> [2003 (1) KLT<\/p>\n<p>339].\n<\/p>\n<\/p>\n<p>         4.
