No. 2585 OF 2007\n\n                      ````````````````````````````````````````````````````\n\n                        Dated this the 5th day of July, 2007\n\n\n                                        O R D E R\n<\/pre>\n<p>                  In this  Revision filed under Section 397 read with Sec. 401<\/p>\n<p>Cr.P.C. the petitioner who was the accused in S.T. No.76\/2004 on the<\/p>\n<p>file   of   the   J.F.C.M.,   Perumbavoor   challenges     the   conviction     entered<\/p>\n<p>and the sentence passed against   him for an offence punishable under<\/p>\n<p>Sec. 138 of the Negotiable Instruments Act, 1881 (hereinafter referred to<\/p>\n<p>as &#8216;the Act&#8217;).\n<\/p>\n<\/p>\n<p>       2.         I heard the learned counsel for the Revision Petitioner and<\/p>\n<p>the learned Public Prosecutor.\n<\/p>\n<\/p>\n<p>       3.         The  learned   counsel   appearing   for   the   Revision  Petitioner<\/p>\n<p>re-iterated the contentions in support of the Revision.  The courts below<\/p>\n<p>have  concurrently   held   that   the   cheque  in   question   was  drawn  by  the<\/p>\n<p>appellant     in   favour  of  the    complainant  on   the  drawee bank,  that   the<\/p>\n<p>cheque was validly presented to the bank, that it was dishonoured for<\/p>\n<p>reasons which fall under Section 138 of the Act, that the   complainant<\/p>\n<p>made   a   demand   for   payment   by   a   notice   in   time   in   accordance   with<\/p>\n<p>clause (b) of the proviso to Section 138 of the Act  and that the Revision<\/p>\n<p>Petitioner\/accused failed to make the payment  within 15 days of receipt<\/p>\n<p>of the statutory notice.       Both the courts have considered and rejected<\/p>\n<p>the defence set up by the revision petitioner while   entering the above<\/p>\n<p>Crl.R.P.No.2585\/07<\/p>\n<p><span class=\"hidden_text\">                                            : 2 :<\/span><\/p>\n<p>finding.     The said finding has been recorded on an appreciation of the<\/p>\n<p>oral   and   documentary   evidence.     I   do     not   find   any  error,   illegality   or<\/p>\n<p>impropriety in the finding so recorded concurrently by the courts below.<\/p>\n<p>The conviction was thus rightly entered against  the  petitioner.<\/p>\n<p>        4.       What  now survives for   consideration  is  the   question  as  to<\/p>\n<p>whether   a   proper   sentence   has   been   imposed   on   the   Revision<\/p>\n<p>Petitioner.\n<\/p>\n<\/p>\n<p>        5.       I am, however, inclined to modify the sentence imposed on<\/p>\n<p>the   appellant   provided   he   complies   with   the   condition   hereinafter<\/p>\n<p>mentioned.     Accordingly,   if   the   revision   petitioner   pays   to   the   1st<\/p>\n<p>respondent complainant by way of compensation under section 357(3)<\/p>\n<p>Cr.P.C. a sum of Rs.40,000\/- (Rupees forty thousand only) within three<\/p>\n<p>months from today, then he need to undergo only imprisonment till the<\/p>\n<p>rising of the court.  If on the other hand, the revision petitioner commits<\/p>\n<p>default   in   making   the   payment   as   aforesaid,   he   shall   undergo   simple<\/p>\n<p>imprisonment for  three  months by way of default  sentence.   Money, if<\/p>\n<p>any, paid by the revision petitioner pursuant to the orders, if any, passed<\/p>\n<p>by the lower appellate court shall be refunded to the revision petitioner.<\/p>\n<p>        This   Revision   is   disposed   of   confirming   the   conviction   but<\/p>\n<p>modifying the sentence as above.\n<\/p>\n<\/p>\n<p>                                                           (V.
