DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent Company Petition has been preferred by the petitioner &#8211;<br \/>\n\tCompany under Sections 433, 434 and 439 of the Companies Act, 1956<br \/>\n\tfor an appropriate order of winding up of the respondent &#8211;<br \/>\n\tCompany i.e. Kenson Motors Private Limited.\n<\/p>\n<p>It<br \/>\n\tis the case on behalf of the petitioner that a sum of<br \/>\n\tRs.53,51,107.79p is due and payable to the petitioner by the<br \/>\n\trespondent company towards the Loan granted to the respondent<br \/>\n\tcompany.  It is the case on behalf of the petitioner that the<br \/>\n\trespondent company in not in a position to pay the debts to its<br \/>\n\tcreditors and has lost its substratum.   It is submitted that<br \/>\n\tdespite service of statutory notice, the amount has not been paid.<br \/>\n\tIt is further submitted that even there is no reply to the statutory<br \/>\n\tnotice.\n<\/p>\n<p>Though<br \/>\n\tserved, nobody appears on behalf of the respondent Company.\n<\/p>\n<p>Hence,<br \/>\n\tADMIT.\n<\/p>\n<p>The<br \/>\n\tpetition is fixed for final hearing on August 8, 2011.  Admission of<br \/>\n\tthe petition with the date of final hearing to be published in two<br \/>\n\tlocal newspapers i.e. Indian Express (English Daily), Ahmedabad<br \/>\n\tedition and Sandesh (Gujarati Daily), Rajkot edition.  Publication<br \/>\n\tin the Government Gazette is dispensed with.\n<\/p>\n<p>The<br \/>\n\torder of Advertisement is deferred for two weeks from today.  If by<br \/>\n\tthat time, no reply is received, or representation is made by<br \/>\n\trespondent No.1, the order as above shall be made effective.
