DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-150\/2010 with Kalol Taluka Police Station,  for the offences<br \/>\npunishable under Sections 406, 420, 465, 467, 468, 471, 120-B, 114<br \/>\netc. of the Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel appearing for the applicant submits that investigation is on<br \/>\nverge of completion.  It is further submitted that so far as land in<br \/>\nquestion pertaining to Survey No. 384 and 386 are concerned,<br \/>\nallegations are to the extent that the applicant madey forged power<br \/>\nof attorney but now he has shown his willingness to restore the<br \/>\nstatus and so far as Survey No. 429, 430-A, 431 and 432\/2 are<br \/>\nconcerned, similar allegations along with creating fake identity of<br \/>\ncomplainant one Shri Dasrathbhai Somabhai Bhavsar is alleged.  So far<br \/>\nas the above survey numbers of land in question, on instruction it is<br \/>\nsubmitted that status-quo entity of land will be restored.\n<\/p>\n<p>\tLearned<br \/>\nadvocates appearing for the respective complainants agree to the<br \/>\nabove suggestion.\n<\/p>\n<p>\tHowever,<br \/>\nit is also submitted that one of the co-accused being a bonafide<br \/>\npurchaser was granted anticipatory bail.  Considering the nature of<br \/>\nevidence, role attributed to the applicant and version of the<br \/>\ncomplainant, this application for bail may kindly be considered.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned APP for the respondent &#8211; State who opposed grant of<br \/>\nbail looking to the nature and gravity of offence.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe above, by and large nature of allegations against the applicant<br \/>\nare of creating fake identity of complainant and forged power of<br \/>\nattorney but at the same time parties have arrived at an amicable<br \/>\nunderstanding, so that they can resolve the dispute.  However, the<br \/>\nobservations as above may not have any bearing on the proceedings if<br \/>\nany pending before any Court.   Hence, I am inclined to enlarge the<br \/>\napplicant on bail.\n<\/p>\n<p>6.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>7.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-150\/2010 with<br \/>\nKalol Taluka Police Station, on executing a bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. till the trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>8.\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>9.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>10.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>11.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>12.\tRule<br \/>\nis made absolute to the aforesaid extent.
