SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/04\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>As<br \/>\n\tcommon question of law and facts arise in both these petitions and<br \/>\n\tare with respect to similar prayers, both these petitions are<br \/>\n\tdisposed of by this common judgement and order.\n<\/p>\n<p>In<br \/>\n\tboth these petitions, the respective petitioners   have, as such,<br \/>\n\tchallenged the impugned Notification dtd.16\/3\/2010 issued by the<br \/>\n\tState Government &#8211; Agriculture and Cooperation Department in<br \/>\n\tso far as nominating the respondent Nos.4 to 12 of Special<br \/>\n\tCivil Application No.3542 of 2010 as members of newly<br \/>\n\tconstituted Rajkot-Lodhika Agricultural Produce Market committee. It<br \/>\n\tis also further prayed for an appropriate writ, order and\/or<br \/>\n\tdirection directing the concerned respondents &#8211; State<br \/>\n\tauthorities to comply with the orders passed by this Court<br \/>\n\tdtd.30\/1\/2009 in Special<br \/>\n\tCivil Application No. 11520 of 2008; order<br \/>\n\tdtd.9\/2\/2010 passed in Special<br \/>\n\tCivil Application No. 8435 of 2009 as well as interim<br \/>\n\torder passed by this Court in Special<br \/>\n\tCivil Application No. 1562 of 2010 and to nominate<br \/>\n\tonly those persons as members who were members of the old Market<br \/>\n\tCommittee as on 20\/3\/2004 (considering sec.54(2) of the Agriculture<br \/>\n\tProduce Market Committee Act, 1963,  hereinafter referred to  as<br \/>\n\t&#8220;the Act&#8221;).\n<\/p>\n<p>After<br \/>\n\tboth the petitions were heard by this Court at length on last<br \/>\n\toccasions, the matters were adjourned to today for dictation of the<br \/>\n\torder and at the request of Mr.P.K. Jani, learned Government<br \/>\n\tPleader so as to enable him to get further instructions in<br \/>\n\tthe matter.\n<\/p>\n<p>Today,<br \/>\n\tMr.P.K. Jani, learned Government<br \/>\n\tPleader  has tendered Affidavit in Special<br \/>\n\tCivil Application No.3542 of 2010, which has been<br \/>\n\taffirmed by Mr.Radhakant Tripathy, IAS, Principal Secretary,<br \/>\n\tAgriculture and Co-operation Department, State of Gujarat , which<br \/>\n\treads as under:-\n<\/p>\n<p>&#8220;At<br \/>\nthe outset, I tender an unconditional apology for not being able to<br \/>\ncomply with the statement made on behalf of the State Government,<br \/>\nwhich was recorded in the order dated 30th January, 2009<br \/>\npassed by this Honourable Court in Special<br \/>\nCivil Application No. 11520 of 2008. I also tender an<br \/>\nunconditional apology for not being able to comply with the<br \/>\ndirections issued vide order dated 9th February, 2010<br \/>\npassed in Special Civil Application No.8435 of 2009.\n<\/p>\n<p>2.\tI<br \/>\nrespectfully state and submit that the questions involved in the<br \/>\npresent writ petition are considered  in detail by the State<br \/>\nGovernment. The orders passed in the present petition as well as<br \/>\nother petitions with respect to subject matter of Rajkot\/Lodhika<br \/>\nAgricultural Produce Market Committee are also considered in detail.\n<\/p>\n<p>\tI<br \/>\nrespectfully state and submit that in light of the statement made on<br \/>\nbehalf of the State Government referred hereinabove and in pursuance<br \/>\nto and in respectful compliance of the directions issued by this<br \/>\nHonourable Court in the order dated 9th February, 2010, I<br \/>\nundertake to issue a requisite notification having effect of<br \/>\ncomplying with the statements recorded in the above order dated 30th<br \/>\nJanuary, 2009 and the order dated 9th February, 2010<br \/>\nreferred to hereinabove, that is to say, restoring the body, which<br \/>\nwas in power as on 20th March, 2004 as well as the order<br \/>\ndated 26-2-2010 passed in Special<br \/>\nCivil Application No. 1562\/2010, wherein Hon&#8217;ble Court<br \/>\nhas directed to act as per section 54 of the Act. The State<br \/>\nGovernment will issue notification in accordance with directions<br \/>\ncontained in the order dated 26-2-2010 in SCA No.1562\/2010 and<br \/>\nconsidering Section 54(2) of the Act.\n<\/p>\n<p>\tIn<br \/>\nlight of what is stated hereinabove, I am not making any averments on<br \/>\nmerits and pray that the present proceedings may kindly be disposed<br \/>\nof in light of the notification to be published on 23rd<br \/>\nApril, 2010 subject to what is submitted hereinabove.&#8221;\n<\/p>\n<p>Mr.P.K.\n<\/p>\n<p>\tJani, learned Government<br \/>\n\tPleader  has submitted that  there shall be one practical<br \/>\n\tdifficulty if the entire old body which was in power as on 20\/3\/2004<br \/>\n\tis restored, as some member\/s might have incurred disqualification<br \/>\n\tand\/or has\/have become ineligible to become member of the Market<br \/>\n\tCommittee.\n<\/p>\n<p>Mr.B.S.\n<\/p>\n<p>\tPatel, learned<br \/>\n\tadvocate appearing on behalf of the petitioners has<br \/>\n\tfairly conceded that while restoring the old body which was in power<br \/>\n\tas on 20\/3\/2004, those persons\/members who have incurred<br \/>\n\tdisqualification and\/or  have become ineligible to be member of the<br \/>\n\tMarket Committee after 20\/3\/2004 may not be nominated again. He has<br \/>\n\tfurther submitted that even to nominate those persons who have<br \/>\n\tbecome ineligible to become the Member cannot be nominated and as<br \/>\n\tsuch it would be  against the provision of sec.54(2) of the Act. It<br \/>\n\tis further submitted that to that extent his concession may be<br \/>\n\trecorded.\n<\/p>\n<p>In<br \/>\n\tview of the above, more particularly considering the affidavit filed<br \/>\n\tby the Principal Secretary, Agriculture and Cooperation Department,<br \/>\n\tState of Gujarat, referred to hereinabove, when the State Government<br \/>\n\tis to issue notification nominating the members of the newly<br \/>\n\tconstituted Market Committee by restoration the body which was in<br \/>\n\tpower as on 20\/3\/2004 (except those member\/s who have become<br \/>\n\tineligible to become member of the Market Committee on and after<br \/>\n\t20\/3\/2004), no further order is required to be passed except<br \/>\n\tdisposing of the present Special<br \/>\n\tCivil Applications by directing the respondents -State<br \/>\n\tauthorities and the State Government to act as per the affidavit<br \/>\n\tfiled by Principal Secretary, Agriculture and Cooperation<br \/>\n\tDepartment, State of Gujarat, referred to hereinabove and to issue a<br \/>\n\tfresh notification nominating the members of the newly constituted<br \/>\n\tMarket Committee while exercising the powers under sec.54(2) of the<br \/>\n\tAct and restoring the body which was in power as on 20\/3\/2004<br \/>\n\t(except those member\/s who have become ineligible to become member<br \/>\n\tof the Market Committee on and after 20\/3\/2004). It is reported that<br \/>\n\tthe State Government is to issue fresh notification and the same is<br \/>\n\tto be published on or before 24\/4\/2010 (may be on 23\/4\/2010).\n<\/p>\n<p>As<br \/>\n\tthere is no Market Committee constituted as on today and pursuant to<br \/>\n\tthe interim order passed by this Court, The Director of Agricultural<br \/>\n\tMarketing and  Rural Finance, State of Gujarat is at present in<br \/>\n\tmanagement and affairs of the Market Committee, it is observed and<br \/>\n\tdirected that the first meeting of the newly constituted Market<br \/>\n\tCommittee constituted as per the notification to be published on or<br \/>\n\tbefore 24\/10\/2010, as stated hereinabove, shall be convened at the<br \/>\n\tearliest but not later than 10 days from the date of issuance of<br \/>\n\tsuch notification nominating the members of the newly constituted<br \/>\n\tRajkot-Lodhika Agricultural Produce Market Committee.\n<\/p>\n<p>With<br \/>\n\tthe observations and directions aforesaid, both these petitions are<br \/>\n\tdisposed of accepting the unconditional apology as prayed for and<br \/>\n\tthe concerned respondents are hereby directed to act as stated above<br \/>\n\tand as per the  Affidavit  by Principal Secretary, Agriculture and<br \/>\n\tCo-operation Department, State of Gujarat, recorded hereinabove.
