Mahtab Ansari, son of Md. Naeem.\n                                                Versus\n                                       The State Of Bihar\n                                   ----------------------------------\n<\/pre>\n<p>05.   17.11.2011              Heard learned counsel for the petitioner and<\/p>\n<p>                    learned Additional Public Prosecutor for the State.<\/p>\n<p>                              The petitioner, apprehends his arrest in<\/p>\n<p>                    connection with Rajauli P.S. Case No. 8\/2011 for<\/p>\n<p>                    offences under Section 304(B) of the Indian Penal<\/p>\n<p>                    Code,    is one of the named accused in this case<\/p>\n<p>                    instituted roughly after four months of the occurrence<\/p>\n<p>                    being husband of the deceased daughter of the<\/p>\n<p>                    informant who died under unnatural circumstance.<\/p>\n<p>                              Submission is that except some suspicion<\/p>\n<p>                    raised against the petitioner there is absolutely nothing.<\/p>\n<p>                    Further the deceased died by committing suicide<\/p>\n<p>                    though before succumbing to such attempt series of<\/p>\n<p>                    attempts were made to get her rescued, in that course,<\/p>\n<p>                    the incident on road also took place causing death of<\/p>\n<p>                    two of the companions. However, she could reach at<\/p>\n<p>                    P.M.C.H. Patna, but ultimately died where her post<\/p>\n<p>                    mortem examination was also done, but no case was<br \/>\n            instituted nor anyone raised any allegation against the<\/p>\n<p>           petitioner or anyone else. Learned Additional Public<\/p>\n<p>           Prosecutor who is armed with carbon copy of the case<\/p>\n<p>           diary could not refute such submissions.<\/p>\n<p>                     Considering the facts and circumstances of<\/p>\n<p>           the case, in the event of his arrest or surrender within a<\/p>\n<p>           period of four weeks, let the above-named petitioner be<\/p>\n<p>           enlarged on bail on furnishing bail bond of sum of Rs.<\/p>\n<p>           10,000\/- (ten thousand only) with two sureties of the<\/p>\n<p>           like amount each to the satisfaction of Chief Judicial<\/p>\n<p>           Magistrate, Nawada, in connection with Rajauli P.S.<\/p>\n<p>           Case No. 8\/2011, subject to condition under section<\/p>\n<p>           438(2) of the Code of Criminal Procedure, and<\/p>\n<p>           additional condition to attend the court regularly till<\/p>\n<p>           disposal of the case, in the event of failure on two<\/p>\n<p>           consecutive dates, without any reasonable explanation,<\/p>\n<p>           the privilege granted shall be deemed to be cancelled.<\/p>\n<pre>Rajeev\/-                        ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
