Ltd. and learned Advocate Mr. Yogen N. Pandya for the<br \/>\nopponent  &#8211; original claimant.\n<\/p>\n<p>2.\tThe<br \/>\nappellant is before this Court being aggrieved by a judgment and<br \/>\naward dated 01.07.2009 passed by the Workmen Compensation<br \/>\nCommissioner, Ahmedabad under the Workmen&#8217;s Compensation Act. The<br \/>\nWorkmen Compensation Commissioner is pleased to award an amount of<br \/>\nRs. 69,265\/- with 9% interest from the date of application till the<br \/>\nrealization. The Workmen Compensation Commissioner was pleased to<br \/>\norder that the amount be paid within 45 days.\n<\/p>\n<p>3.\tThe<br \/>\nlearned Advocate Mr. Dave states that the principal amount is already<br \/>\ndeposited. However, the interest amount is yet to be deposited.<br \/>\nAppellant is directed to deposit the interest amount also by 1st<br \/>\nSeptember 2010, failing which the interest rate will be 12%, not by<br \/>\nway of a penalty, but as a measure to curb the utilization of that<br \/>\namount by the appellants.\n<\/p>\n<p>4.\tLearned<br \/>\nAdvocate vehemently submitted that the day which is set out as that<br \/>\nof the accident was staggering holiday and therefore the entire case<br \/>\nof the claimant is required to be dismissed. This very contention was<br \/>\ntaken before the Commissioner and Commissioner has dealt with that<br \/>\ncontention while deciding issue No.2. The Tribunal has recorded at<br \/>\none place that according to the applicant the accident had taken<br \/>\nplace on 28.07.2001 and the Tribunal has then recorded that,  with<br \/>\nregard to the date also there is no dispute between the<br \/>\nparties.(emphasis supplied).\n<\/p>\n<p>4.1.\tLearned<br \/>\nAdvocate for the appellant submitted that this is an inadvertent<br \/>\nrecording of the submission made by the learned Advocate appearing<br \/>\nfor the appellant. He submitted that what was admitted before the<br \/>\nWorkmen Compensation Commissioner was that, accident did take place<br \/>\non 28.07.2001 but not in the factory. It had taken place at home and<br \/>\nto convey that there is no dispute about accident having taken place<br \/>\nat the residence of claimant, the aforesaid finding is recorded. The<br \/>\nlearned Advocate could not convince this Court any further because<br \/>\nwhat follows is important. Assuming for the sake of arguments that on<br \/>\n28.07.2001, as contended by the learned Advocate for the appellant,<br \/>\nthere was staggering holiday about which the Commissioner has<br \/>\nrecorded that no documentary evidence is produced by the appellant<br \/>\nbefore the Workmen Compensation Commissioner. The Commissioner has<br \/>\nrecorded that after the claimant having discharged his duties in<br \/>\nthird shift on 27.07.2001, he was asked to stay back for overtime and<br \/>\nit is during that time the accident had taken place.\n<\/p>\n<p>5.\tBe<br \/>\nthat as it may, the question remains as to whether this Court will<br \/>\nlike to interfere with the order passed by the Workmen Compensation<br \/>\nCommissioner, Ahmedabad in which a categorical finding about the<br \/>\nincident is recorded and the liability of the appellant to pay the<br \/>\nsame is fixed. Having found no substance in the First Appeal, the<br \/>\nsame is dismissed.\n<\/p>\n<p>6.\tNow,<br \/>\nthat the First Appeal is dismissed, the claimant is entitled to move<br \/>\nthe Workmen Compensation Commissioner by filing an appropriate<br \/>\napplication for the disbursement of the amount already deposited and<br \/>\nwhich may be deposited hereafter.\n<\/p>\n<p> Order<br \/>\nin C.A. 7476 of 2010       <\/p>\n<p>\tAs<br \/>\nthe First Appeal is dismissed, no orders in Civil Application.\n<\/p>\n<p>(RAVI<br \/>\nR.
