S. Nanavati for learned advocate Mr.<br \/>\nChudgar appearing for applicants, learned Senior Advocate Mr. Manish<br \/>\nBhatt for opponent no.1 and learned AGP Ms. Sachi Mathur appearing<br \/>\nfor respondent state authority.\n<\/p>\n<p>2.\tThis<br \/>\napplication is preferred by applicants with a prayers made in<br \/>\npara-4(A) to 4(E) of present application.  The said prayers are<br \/>\nquoted as under:\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to admit and allow the present application;\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to review and recall the order dated 30th<br \/>\nAugust, 2011 passed in SCA No.12779 of 2011 at Annexure-I hereto;\n<\/p>\n<p>(C)\tPending<br \/>\nthe hearing and final disposal of the present application, Your<br \/>\nLordships may be pleased to suspend the operation and implementation<br \/>\nof the order dated 30th August, 2011 passed in SCA<br \/>\nNo.12779 of 2011 at Annexure-I hereto;\n<\/p>\n<p>(D)\tAn<br \/>\nex-parte ad interim relief in terms of prayer (C) above may kindly be<br \/>\ngranted.\n<\/p>\n<p>(E)\tSuch<br \/>\nother and further reliefs may kindly be granted as may be deemed fit<br \/>\nin the facts and circumstances of the present case.&#8221;\n<\/p>\n<p>3.\tLearned<br \/>\nSenior Advocate Mr. Nanavati raised contention  before this Court<br \/>\nthat present applicant is not state within the meaning of Article-12<br \/>\nof Constitution of India or not other authority as specified under<br \/>\nArticle-12 of Constitution of India.  Therefore, writ petition is not<br \/>\nmaintainable at all against present applicant.  He also raised<br \/>\ncontention before this Court that order which has been passed by this<br \/>\nCourt in Special Civil Application No.12779 of 2011 dated 30\/8\/2011<br \/>\nis without giving opportunity of hearing to present applicants.    He<br \/>\nalso raised contention that date of retirement which has been<br \/>\nmentioned in order dated 11\/6\/2010 is found to be incorrect because<br \/>\nhe has not retired from service but he has tendered resignation.  He<br \/>\nalso raised contention that according to applicants opponent no.1 is<br \/>\nreaching age of superannuation on 4\/5\/2008 thereafter extension was<br \/>\ngiven and he was remained continued in service and thereafter<br \/>\ntendered resignation on 11\/6\/2010.  On these grounds a prayer is made<br \/>\nin present application to review or recall the order passed by this<br \/>\nCourt on 30\/8\/2011 in Special Civil Application No.12779 of 2011.<br \/>\nThe said order is quoted as under:\n<\/p>\n<p>&#8220;1.0\tHeard<br \/>\nMrs. Mauna Bhatt, learned advocate appearing for the petitioner and<br \/>\nMr. Anand Sharma, learned AGP appearing for the respondent No.1-State<br \/>\nauthorities.\n<\/p>\n<p>2.0\tIn<br \/>\nthe present petition, the petitioner has prayed for following<br \/>\nreliefs:\n<\/p>\n<p>&#8220;(A)<br \/>\nThis Hon&#8217;ble Court may be pleased to issue a writ, order or direction<br \/>\nin the nature of mandamus, directing the respondent No.1- Registrar,<br \/>\nCooperative Societies to initiate appropriate action against the<br \/>\nrespondent No.2 and its concerned office bearers for non-payment of<br \/>\nthe petitioner&#8217;s legitimate retiral\/terminal dues as also to initiate<br \/>\nsuitable action against the respondent No.2 and its office bearers<br \/>\nfor their arbitrary, harsh and highhanded action;\n<\/p>\n<p>  (B)<br \/>\nThat this Hon&#8217;ble Court may be pleased to issue a writ of mandamus or<br \/>\nany other appropriate writ, order or direction, directing the<br \/>\nrespondent No.2 to forthwith make payment of the retiral\/terminal<br \/>\ndues of the petitioner considering terminal date correctly as<br \/>\n11.06.2010;\n<\/p>\n<p>  (C)<br \/>\n Pending hearing and final disposal of this petition, this Hon&#8217;ble<br \/>\nCourt may be pleased to direct the respondent No.1- Registrar to<br \/>\ninitiate appropriate inquiry into the malafide and arbitrary action<br \/>\non the part of the respondent No.3 and other concerned office bearers<br \/>\nof the Federation;\n<\/p>\n<p>  (D)<br \/>\n Pending hearing and final disposal of this petition, this Hon&#8217;ble<br \/>\nCourt may be pleased to direct the Respondents No.2, 3, 4 and 6 to<br \/>\nrefrain from indulging in illogical, unlawful and arbitrary behavior<br \/>\nagainst the Petitioner.\n<\/p>\n<p>  (E)<br \/>\n Pending hearing and final disposal of this petition, this Hon&#8217;ble<br \/>\nCourt may be pleased to direct the respondent No.2 &#8211; Federation<br \/>\nto deposit an amount of Rs.164.56 lacs with this Hon&#8217;ble Court;&#8221;\n<\/p>\n<p>3.0\tThe<br \/>\nclaim of the petitioner is to direct the respondent No.1 Registrar<br \/>\nCooperative Societies to initiate appropriate action against<br \/>\nrespondent No.2 for non-payment of legitimate retiral\/terminal dues<br \/>\nof petitioner and further to direct respondent No.2 to pay<br \/>\nimmediately all the retiral\/terminal dues to petitioner considering<br \/>\nterminal date as 11th June, 2010.\n<\/p>\n<p>4.0\tIn<br \/>\nlight of the aforesaid prayer and considering the submissions made by<br \/>\nlearned advocate Mrs. Bhatt, the representation is already made by<br \/>\nthe petitioner on 28th January, 2011 (Annexure-H,<br \/>\nPage-73). The aforesaid representation has been sent to Registrar<br \/>\nCooperative Societies, State of Gujarat, Gandhinagar.\n<\/p>\n<p>5.0\tHowever,<br \/>\nit is open for the petitioner to make further representation claiming<br \/>\naforesaid amount from respondents within a period of one month from<br \/>\nthe date of receiving copy of writ of present order. As and when<br \/>\nrespondents no.1 and 2 receive such representation from the<br \/>\npetitioner, it is directed to respondent Nos.1 and 2 to consider such<br \/>\nrepresentation made by the petitioner and examine it and then to pass<br \/>\nappropriate reasoned order in accordance with law\/rules within a<br \/>\nperiod of one month from the date of receiving such representation<br \/>\nfrom the petitioner and it is further directed to both the<br \/>\nrespondents whatever undisputed legal dues being a terminal\/retiral<br \/>\ndues, let that may be paid immediately to the present petitioner<br \/>\nconsidering the date of retirement dated 11th June, 2010.\n<\/p>\n<p>6.0\tIn<br \/>\nlight of the above observations and directions present petition is<br \/>\ndisposed of by this Court without expressing any opinion on merits.<br \/>\nHowever, in case if ultimate decision is adverse to the petitioner,<br \/>\nit is open for the petitioner to challenge the same before the<br \/>\nappropriate forum in accordance with law. Direct Service is<br \/>\npermitted.&#8221;\n<\/p>\n<p>4.\tIn<br \/>\noriginal petition respondent no.1 being a state authority a Registrar<br \/>\ncooperative societies against whom prayer was made by original<br \/>\npetitioner Shri B.M. Vyas and this Court has directed to original<br \/>\nRespondent No.1 State Authorities and present applicant to decide<br \/>\nrepresentation made by petitioner, examine it and then pass<br \/>\nappropriate reasoned order in accordance with law\/rules within a<br \/>\nperiod of one month from date of receiving such representation from<br \/>\npetitioner and this Court further directed to present applicant<br \/>\nincluding State Government that whatever undisputed legal dues being<br \/>\nterminal\/retiral dues, let that may be paid to original petitioner<br \/>\nconsidering original date of retirement i.e. 11\/6\/2010.\n<\/p>\n<p>5.\tIn<br \/>\nlight of aforesaid observations and directions made by this Court<br \/>\nnow, applicant is having serious objection that this Court cannot<br \/>\nissue such direction against present applicant because applicant is<br \/>\nnot state or other authority as specified under Article-12 of the<br \/>\nConstitution of India.\n<\/p>\n<p>6.\tThis<br \/>\nCourt has exercised extra ordinary powers under Article-226 of the<br \/>\nConstitution of India while passing aforesaid order that even include<br \/>\nother than state authorities within meaning of Article-12 of<br \/>\nConstitution of India in some occasion for giving justice to a<br \/>\npetitioner-employee.  Therefore, this Court has not decided the<br \/>\nmerits of the matter whether writ is maintainable or not and in<br \/>\nrespect to question whether it was resignation or termination or<br \/>\nretirement.  That question is also kept open by this Court and this<br \/>\nCourt has now clarified in order dated 30\/8\/2011 that instead of date<br \/>\nof retirement let it be considered by applicants a date of<br \/>\nresignation but question is still remained that whatever legal dues<br \/>\nbeing undisputed amount must be paid by applicant to present opponent<br \/>\nno.1.   Therefore, this Court has passed an order while keeping in<br \/>\nmind the powers which has been exercised by this Court under<br \/>\nArticle-226 of the Constitution of India.  The question which has<br \/>\nbeen raised before this Court by applicants is that whether applicant<br \/>\nis covered by state or other authority under Article-12 or not has<br \/>\nnot examined by this Court at all.  However, according to my opinion,<br \/>\nno case is made out for review or recall the order impugned and even<br \/>\napplicant is having any grievance about this order dated 30\/8\/2011<br \/>\nthen applicant is having alternative remedy to file Letters Patent<br \/>\nAppeal before Division Bench of this Court, therefore, on this ground<br \/>\nalso this Court has not entertained present application with a<br \/>\nclarification that it is open for applicant to consider date of<br \/>\nretirement 4\/5\/2008 or date of resignation 11\/6\/2010, for payment of<br \/>\nundisputed legal dues, if any, of present opponent no.1.
