Kuriakose, J<\/p>\n<p>      The tenant is the revision petitioner and he<\/p>\n<p>challenges in this revision under Section 20, the order<\/p>\n<p>of eviction concurrently passed against him by the<\/p>\n<p>Rent Control Court and the Appellate Authority on the<\/p>\n<p>ground of bona fide own occupation under Section 11<\/p>\n<p>(3) and the ground that the tenant has put up another<\/p>\n<p>building of his own reasonably sufficient for his<\/p>\n<p>requirement under clause 3 Sub Section 4 of Section<\/p>\n<p>11.<\/p>\n<p>      2. Sri.P.C.Chacko, learned counsel for the<\/p>\n<p>petitioner has addressed us extensively and very<\/p>\n<p>persuasively. He submitted that it has come out in<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.129 of 2009        -2-<\/span><\/p>\n<p>      evidence that the building on the basis of which<\/p>\n<p>      eviction was sought for under clause 3 of sub Section<\/p>\n<p>      4 of Section 11 is not presently under the occupation<\/p>\n<p>      of the tenant. It is under the occupation of the<\/p>\n<p>      tenant&#8217;s tenant. As for the ground under sub Section<\/p>\n<p>      3 of Section 11, he submitted that the need projected<\/p>\n<p>      is the need of the respondent\/landlady&#8217;s husband to<\/p>\n<p>      start business. But it was not proved that the<\/p>\n<p>      respondent\/landlady&#8217;s husband is dependent on the<\/p>\n<p>      respondent\/landlady.\n<\/p>\n<\/p>\n<p>            3. We have anxiously considered the submissions<\/p>\n<p>      of Sri.P.C.Chacko, the learned counsel for the<\/p>\n<p>      petitioner. We have carefully gone through the order<\/p>\n<p>      of the Rent Control Court and the judgment of the<\/p>\n<p>      Rent Control Appellate Authority. It is seen that the<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.129 of 2009           -3-<\/span><\/p>\n<p>      findings entered into by the Rent Control Court and<\/p>\n<p>      the Appellate Authority that the revision petitioner is<\/p>\n<p>      liable to be evicted under Section 11(4)(iii), are based<\/p>\n<p>      on evidence. It is not financial dependency which is<\/p>\n<p>      necessary for the purpose of ground under clause 3<\/p>\n<p>      Section 11. It has become evident that the husband of<\/p>\n<p>      landlady does not have any other building of his own<\/p>\n<p>      in possession. Thus, it stands proved that the<\/p>\n<p>      landlady&#8217;s husband is dependent on the landlady for<\/p>\n<p>      the purpose of a building for commencing business.<\/p>\n<p>      Putting up of a building or coming into possession of a<\/p>\n<p>      building or having possession of a building already &#8211;<\/p>\n<p>      are sufficient to constitute an eviction ground under<\/p>\n<p>      Section 11(4)(iii). If the tenant is not in possession of<\/p>\n<p>      the building pointed out by the landlady for getting<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.129 of 2009         -4-<\/span><\/p>\n<p>      order of eviction under Section 11(4)(iii), that is only<\/p>\n<p>      because of the said building was let out by the tenant<\/p>\n<p>      to his tenant. Under these circumstances, the<\/p>\n<p>      argument that presently the said building is possessed<\/p>\n<p>      not by the tenant but by the tenant&#8217;s tenant will not<\/p>\n<p>      improve matters for the revision petitioner\/tenant.<\/p>\n<p>            4. Having regard to the contours of this Court&#8217;s<\/p>\n<p>      jurisdiction under Section 20, we do not find any<\/p>\n<p>      warrant for interference on the eviction passed under<\/p>\n<p>      either of the grounds.\n<\/p>\n<\/p>\n<p>            5.   As  his  last  submission,   Sri.P.C.Chacko<\/p>\n<p>      requested that at least one year&#8217;s time be granted for<\/p>\n<p>      peacefully surrendering the premises. We are not<\/p>\n<p>      inclined to grant so much of time. However, we feel<\/p>\n<p>      that in the circumstances of the case and by way of<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.129 of 2009          -5-<\/span><\/p>\n<p>      indulgence that time can be granted till 31st December,<\/p>\n<p>      2009.\n<\/p>\n<\/p>\n<p>            The result of this RCR therefore, is as follows:-<\/p>\n<p>            1) The RCR is dismissed.\n<\/p>\n<\/p>\n<p>            2) However, the execution court is directed not<\/p>\n<p>      to order and effect delivery of the petition schedule<\/p>\n<p>      building till 31\/12\/09 on condition that the revision<\/p>\n<p>      petitioner files an affidavit within three weeks from<\/p>\n<p>      today either before the execution court or before the<\/p>\n<p>      Rent Control Court stating that he will unconditionally<\/p>\n<p>      and peacefully surrender the petition schedule building<\/p>\n<p>      to the respondent\/landlady on or before 31st of<\/p>\n<p>      December, 2009 and that he will discharge the arrears<\/p>\n<p>      of rent, if any, within one month and will continue to<\/p>\n<p>      pay occupational charges at the current rent rates till<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.129 of 2009           -6-<\/span><\/p>\n<p>      the date of actual surrender as and when the same<\/p>\n<p>      falls due. If the revision petitioner does not file<\/p>\n<p>      affidavit within the time limit mentioned above he will<\/p>\n<p>      not be entitled for the benefit of time granted by this<\/p>\n<p>      judgment.\n<\/p>\n<\/p>\n<p>                                          PIUS C.
