Sinha, C.J.   <\/p>\n<p> 1. This writ petition is directed against a judgment and order<br \/>\ndated 12.12.2000 passed by the Central Administrative<br \/>\nTribunal, Principal Bench, New Delhi (hereinafter referred<br \/>\nto as &#8216;the Tribunal&#8217;) in O.A. No. 244 of 2000 whereby and<br \/>\nwhereunder the Original application filed by the respondents<br \/>\nherein for grant of temporary status and regularization<br \/>\npurported to be in terms of a scheme dated 20.06.1997 was<br \/>\nallowed.\n<\/p>\n<p> 2. According to the petitioner, Khalasis are recruited as<br \/>\nSeasonal employees during the floor season. Such<br \/>\nappointment would vary from season to season depending<br \/>\nupon the intensity of the monsoon. Admittedly, such<br \/>\ncandidates are appointed without intimating the vacancy<br \/>\nposition to the Employment Exchange under the<br \/>\nEmployment Exchanges (Compulsory Notification of<br \/>\nVacancies) Act, 1959 and the candidates being sponsored by<br \/>\nit.\n<\/p>\n<p> 3. The respondents formulated a scheme, which came into<br \/>\nforce on 01.06.1997, allegedly pursuant to or on the basis of<br \/>\na direction issued in this behalf by the Central<br \/>\nAdministrative Tribunals, Calcutta and Guwahati Benches.\n<\/p>\n<p> 4. Para 3 of the said scheme is as under:-\n<\/p>\n<p>  &#8220;3. This scheme is applicable to the<br \/>\nseasonal khalasis in employment on the work-charged<br \/>\nestablishment of the Central Water<br \/>\nCommission on the date of commencement of<br \/>\nthe scheme and who continue to be so<br \/>\nemployed and have rendered a minimum of<br \/>\n120 days continuous service or such persons<br \/>\nwho were engaged any time during the<br \/>\npreceding one year and have rendered a<br \/>\nminimum of 120 days continuous service in<br \/>\nthat year.&#8221;\n<\/p>\n<p> 5.The construction of the aforementioned provision falls for<br \/>\nconsideration in this writ petition.\n<\/p>\n<p> 6. The learned Tribunal held that from the certificates issued<br \/>\nin favor of the petitioners, it would appear that they in the<br \/>\nyears 1981, 1986, 1989 and 1990 worked for more than 120<br \/>\ndays in a year and as it is not stipulated therein that they<br \/>\nmust work for 120 days only in the year 1996, the original<br \/>\napplicants, i.e., the respondents herein were entitled to<br \/>\ngrant of temporary status. Hence this writ petition.\n<\/p>\n<p> 7. Mr. Sinha, the learned counsel appearing on behalf of the<br \/>\npetitioner, would submit that upon true and correct<br \/>\ninterpretation of the said scheme, there cannot be any<br \/>\ndoubt whatsoever that the concerned employees for the<br \/>\npurpose of grant of temporary status must work for 120<br \/>\ndays continuously.\n<\/p>\n<p> 8. Mr. Gupta, the learned counsel appearing on behalf of the<br \/>\nrespondents, on the other hand, would support the<br \/>\nimpugned judgment.\n<\/p>\n<p> 9. It is not in dispute that the respondents were unskilled<br \/>\nworkers. In the aforesaid scheme, Seasonal Khalasis have<br \/>\nbeen defined in the following terms:-\n<\/p>\n<p>  &#8220;4. Definition: Seasonal Khalasis are<br \/>\nunskilled persons employed year to year to<br \/>\nmeet the requirements during the monsoon<br \/>\nseason for 24 hours&#8217; observation of river<br \/>\ngauges for the purposes of flood forecasting,<br \/>\netc. Generally they are employed during the<br \/>\nmonths from June\/July to September\/October<br \/>\nwhen the monsoon is very active. They are<br \/>\npaid at the minimum in the scale of pay of the<br \/>\npost of Khalasis in work-charged<br \/>\nestablishment.&#8221;\n<\/p>\n<p>10. Clause 3 of the said scheme is in three parts. In terms of<br \/>\nthe said scheme, the Seasonal Khalasis must be in<br \/>\nemployment on the work-charged establishment of the<br \/>\nCentral Water Commission on the date of commencement<br \/>\nthereof. They must continue to be so employed and have<br \/>\nrendered minimum 120 days continuous service. However,<br \/>\nalso those persons who were engaged any time during the<br \/>\npreceding year and have rendered minimum 120 days<br \/>\ncontinuous service in that year were also entitled to the<br \/>\nbenefit there under.\n<\/p>\n<p> 11. Employment of the Seasonal Khalasis on the date of coming<br \/>\ninto force of the said scheme, i.e., 01.06.1997 and rendition<br \/>\nof 120 days continuous service is sine qua non for obtaining<br \/>\nthe benefit of the said scheme. It is only the second part,<br \/>\nwhich requires an interpretation.\n<\/p>\n<p> Under the scheme those who are employed on the<br \/>\ncommencement thereof must have rendered a minimum<br \/>\nperiod of 120 days of continuous service, i.e., from<br \/>\n01.06.1997 and only in that event they are entitled to<br \/>\ntemporary status. The expression &#8216;that&#8217; used in the scheme<br \/>\nis of some significance. They were also under the said<br \/>\nscheme in the alternative was required to have rendered a<br \/>\ncontinuous minimum service of 120 days in the year<br \/>\npreceding 01.06.1997.\n<\/p>\n<p> 12. Thus, in our opinion, the learned Tribunal has misdirected<br \/>\nitself in issuing the impugned directions.\n<\/p>\n<p> 13. It is also not in dispute that regularization or grant of<br \/>\ntemporary status cannot be claimed automatically.<br \/>\nRegularization or grant of temporary status can be conferred<br \/>\nonly by reason of a statute or statutory rules and\/or any<br \/>\nexecutive instructions issued in terms of Article 77 of the<br \/>\nConstitution of India.\n<\/p>\n<p> 14. It is no longer res integra that a cut-off date can be fixed in<br \/>\nterms of such scheme. It is also not in dispute that<br \/>\nconditions therefore can also be laid down.\n<\/p>\n<p> 15. The scheme was communicated to all concerned on<br \/>\n20.06.1997.\n<\/p>\n<p> 16. The forwarding letter issued by the Government of India,<br \/>\nMinistry of Water Resources to the Chairman, Central Water<br \/>\nCommission also clearly suggests that the said scheme<br \/>\nwould only be applicable to those, who are presently<br \/>\nemployed and had rendered minimum 120 days continuous<br \/>\nservice in the Central Water Commission or those who were<br \/>\nengaged any time during the preceding one year and have<br \/>\nrendered 120 days continuous service in that year. The<br \/>\nTribunal, therefore, in our opinion, committed an error of<br \/>\nlaw by wrongly interpreting the said scheme.\n<\/p>\n<p> 17. For the reasons aforementioned, the impugned judgment<br \/>\ncannot be sustained. It is set aside accordingly and the writ<br \/>\npetition is allowed.
