SHAH ASST.GOVERNMENT PLEADER for\nRespondent(s) : 1 - 2. \nRULE SERVED BY DS for Respondent(s) : 1 -\n3. \nMR SUNIT SHAH WITH MR NV GANDHI for Respondent(s) :\n4, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.A.PUJ\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/03\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npetitioner has filed this petition under Article 226 of the<br \/>\nConstitution of India praying for quashing and setting aside the<br \/>\norder passed by the respondent No.1-Admission Committee for<br \/>\nProfessional and Diploma Courses, Gujarat State, dated 16.12.2008.<br \/>\nThe petitioner has also prayed for a direction to the respondent<br \/>\nNo.3-College to permit the petitioner&#8217;s daughter-Bhoomi, to appear in<br \/>\nthe first semester examination on and from 01.01.2009 and allow her<br \/>\nto continue study in respondent No.3-College.\n<\/p>\n<p>2.\tDuring<br \/>\nthe pendency of this petition and pursuant to the order passed by<br \/>\nthis Court in Civil Application No.9058\/2009 on 27.08.2009, the<br \/>\npetitioner has made one more prayer in the petition  seeking interim<br \/>\ndirection to the respondent No.4 to issue the caste certificate to<br \/>\nthe petitioner on the basis of the letter dated 13.08.2009 addressed<br \/>\nby Vice President of Rajgor Community to respondent No.4.\n<\/p>\n<p>3.\tEarlier<br \/>\nthis Court vide order passed on 30.12.2008, granted ad-interim relief<br \/>\nin favour of the petitioner and the petitioner&#8217;s daughter was<br \/>\npermitted to appear in the examination without creating any<br \/>\nadditional equity in her favour, subject to further orders that may<br \/>\nbe passed by this Court. Thereafter, on 04.03.2009, further order was<br \/>\npassed by this Court directing this petition to be heard with Special<br \/>\nCivil Application No.124\/2009. Special Civil Application No.124\/2009<br \/>\nwas heard and disposed of on 18.08.2009 on the basis of the order<br \/>\npassed by the Chair Person, Commission for the Other Backward Classes<br \/>\ndated 20.05.2009 certificate granted by the Deputy District Director<br \/>\n(Vikasati Jati), Rajkot dated 06.07.2009, whereby  it was certified<br \/>\nthat the said petitioner belonged to Rajgor Community and to the<br \/>\nSocially and Educationally Backward Class(SEBC).\n<\/p>\n<p>4.\tSince<br \/>\nthe present petition was ordered to be heard along with Special Civil<br \/>\nApplication No.124\/2009 and\tsince the said petition is already<br \/>\ndisposed of, the present petition is taken up for final disposal.<br \/>\nHeard Mr.A.R. Thacker for the petitioner, Ms. Chetana Shah for the<br \/>\nrespondent Nos.1 &amp; 2 and Mr.Sunit Shah with Mr.N.V. Gandhi for<br \/>\nthe respondent No.4. Despite service of notice, nobody appears on<br \/>\nbehalf of the respondent No.3.\n<\/p>\n<p>5.\tThe<br \/>\ndispute between the parties is that after filing of the petition and<br \/>\nduring the pendency of this petition, survey was undertaken by the<br \/>\nrespondent No.4. The petitioner could not appear before the<br \/>\nCommission during the course of survey and hence the petitioner&#8217;s<br \/>\napplication could not be considered. As against the stand of the<br \/>\nCommission, the petitioner&#8217;s contention is that the petitioner, in<br \/>\nfact, sent an application to the leader of the community. However,<br \/>\ninadvertently or through oversight the application could not be<br \/>\nforwarded and because of that the petitioner&#8217;s application was not<br \/>\nconsidered during the course of survey. However, the petitioner did<br \/>\nappear before the Commission, but the petitioner was asked to<br \/>\napproach through the leader of the community. Immediately on the next<br \/>\nday, the leader of the community has sent representation but that has<br \/>\nnot been considered till this date. It is also the case of the<br \/>\npetitioner that the other members of the petitioner&#8217;s family were<br \/>\nissued necessary caste certificate. However, the petitioner&#8217;s case<br \/>\nhas not been considered. It is, therefore, the case of the<br \/>\npetitioner that if the application forwarded through the leader is<br \/>\nconsidered, the petitioner would certainly get the caste certificate<br \/>\nas requested for.\n<\/p>\n<p>6.\tThe<br \/>\nstand taken by the petitioner was strongly opposed by Mr.Sunit Shah,<br \/>\nlearned advocate appearing for the Commission and detailed affidavit<br \/>\nwas filed on behalf of the respondent No.4-Commission. It was stated<br \/>\ntherein that the caste certificate was issued in favour of those<br \/>\npersons, who were surveyed by the Commission and whose names appeared<br \/>\nin survey report. This process of 100% survey was in consonance with<br \/>\nthe observations made by the Hon&#8217;ble Apex Court in the case of Indra<br \/>\nSawhney reported in AIR 1993 SC 477. It is further submitted<br \/>\nthat the leaders of Rajgor Community had provided information for<br \/>\nabout 4661 families and more than 60% of the members of the Rajgor<br \/>\nCommunity were left out and hence as an exception, order was passed<br \/>\non 23.07.2008 for re-survey. Pursuant to the said order, leaders of<br \/>\nthe community have submitted a list of 9837 families of  Kathi Gor<br \/>\nand 3305 families of  Ahir Gor .  Accordingly survey was carried<br \/>\nout and report was submitted. It was further stated that the<br \/>\npetitioner&#8217;s name was not included by leaders of  the community at<br \/>\nthe time when survey was carried out and completed. Despite the fact<br \/>\nthat the petitioner was aware about this survey, the petitioner did<br \/>\nnot  make any effort to verify and ascertain whether or not  his<br \/>\ndaughter&#8217;s name was included in the list submitted by community<br \/>\nleaders. It is therefore submitted that now, as the survey has been<br \/>\ncarried out practically, that too on case to case basis, no<br \/>\npermission should be issued by this Court directing the Commission to<br \/>\nundertake  this exercise again and to grant the certificate.\n<\/p>\n<p>7.\tHaving<br \/>\nheard the learned counsel appearing for the parties and having<br \/>\nconsidered the documents produced on record and in view of the fact<br \/>\nthat the petitioner&#8217;s daughter has continued her study on the basis<br \/>\nof interim order of this Court and the petitioner&#8217;s other family<br \/>\nmembers are enjoying the caste certificate and only because of some<br \/>\nmisunderstanding or mistakes on the part of the caste leader, the<br \/>\npetitioner&#8217;s application could not be forwarded and hence the same<br \/>\nwas not considered, the petitioner or his daughter should not suffer.<br \/>\nIt is therefore in the interest of justice that the petitioner&#8217;s case<br \/>\nis required to be considered. The Court is taking this view looking<br \/>\nto the peculiar facts of this case and that too, when the petition<br \/>\nwas pending before this Court when the survey was undertaken by the<br \/>\nCommission. Hence without treating this case as any kind of<br \/>\nprecedent, the respondent No.4-Commission shall consider the<br \/>\npetitioner&#8217;s case in light of the letter forwarded by the Vice<br \/>\nPresident of the Rajgor Community on 13.08.2009 in relation to the<br \/>\npetitioner&#8217;s daughter and issue the necessary caste certificate in<br \/>\nher favour at an early date. Till such exercise is over, interim<br \/>\nprotection granted by this Court would continue. If any adverse view<br \/>\nis taken by the Commission, the same shall not be implemented  for<br \/>\nthe period of 15 days from the date of communication of such decision<br \/>\nand it shall be open for the petitioner to challenge such decision<br \/>\nbefore this Court by way of a substantive petition, if so required.\n<\/p>\n<p>8.\tWith<br \/>\nthis direction and observation, this petition is, accordingly,<br \/>\ndisposed of.
