Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/10\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n\n            ---------------------------------------------\n             CRL.M.C.NO.3915 OF 2009\n            ---------------------------------------------\n            Dated         29th    October, 2010\n\n\n                           O R D E R\n<\/pre>\n<p>          Petitioners are                     mother-in-law and<\/p>\n<p>sister-in-laws      of        the         second          respondent.<\/p>\n<p>Petitioners    are accused 2 to 4 and second<\/p>\n<p>respondent,   the        de        facto          complainant      in<\/p>\n<p>C.C.228\/2007 on the file of Judicial First<\/p>\n<p>Class  Magistrate&#8217;s              Court,             Tirur.     Second<\/p>\n<p>respondent filed Annexure-A1 complaint before<\/p>\n<p>Judicial   First          Class            Magistrate,          Tirur<\/p>\n<p>alleging that        petitioners                   along with the<\/p>\n<p>first   accused,          husband              of        the   second<\/p>\n<p>respondent, committed              offences under Section<\/p>\n<p>498 A of Indian Penal Code. It was sent for<\/p>\n<p>investigation under Section 156(3) of Code of<\/p>\n<p>Criminal Procedure. Annexure-A2 FIR in Crime<\/p>\n<p>No.179\/2007   of       Tirur           Police            Station  was<\/p>\n<p>Crmc 3915\/09<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>registered accordingly.        After investigation,<\/p>\n<p>Annexure-A3 final report was submitted before<\/p>\n<p>learned Magistrate on 13\/3\/2007 and      cognizance<\/p>\n<p>for the offence under Section 498 A of Indian<\/p>\n<p>Penal Code was taken on 16\/3\/2007. Petition is<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure to quash the cognizance taken against<\/p>\n<p>them       contending   that  even   as   per   the<\/p>\n<p>allegations      in  the   complaint,  the  alleged<\/p>\n<p>cruelty by the petitioners three years prior to<\/p>\n<p>the     filing    of   Annexure-A1  complaint   and<\/p>\n<p>therefore, learned Magistrate should not have<\/p>\n<p>taken cognizance, in view of Section 468 of<\/p>\n<p>Code of Criminal Procedure.\n<\/p>\n<p>            2.   Learned  counsel appearing for the<\/p>\n<p>petitioners and learned Public Prosecutor      were<\/p>\n<p>heard. Though notice was served on the second<\/p>\n<p>respondent, she did not appear.\n<\/p>\n<p>Crmc 3915\/09<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>            3. As it was found that cognizance was<\/p>\n<p>taken beyond      the period of three years, from<\/p>\n<p>the date of      the alleged cruelty committed by<\/p>\n<p>the petitioners, a report was called     for  from<\/p>\n<p>the     learned Magistrate   whether, any petition<\/p>\n<p>was filed      to condone the delay   to take the<\/p>\n<p>cognizance showing the reasons for the delay<\/p>\n<p>and    whether   the cognizance  was  taken  after<\/p>\n<p>condoning     the  delay.    Learned    Magistrate<\/p>\n<p>submitted that no petition was submitted to<\/p>\n<p>condone the delay showing any reason and delay<\/p>\n<p>was     not condoned and   instead, the cognizance<\/p>\n<p>was taken on receipt of the final report.<\/p>\n<p>            4. A reading of  Annexure-A1 complaint<\/p>\n<p>establishes     that  the  specific  case  of  the<\/p>\n<p>second respondent against petitioners is      that<\/p>\n<p>till first of 2003, she was living with the<\/p>\n<p>husband and the in-laws, after her marriage<\/p>\n<p>Crmc 3915\/09<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>with     the  first  accused    on  27\/4\/1998. The<\/p>\n<p>husband was employed in Gulf.        Allegation in<\/p>\n<p>paragraph 4 of the complaint is that       finding<\/p>\n<p>that it was intolerable     for her to continue to<\/p>\n<p>live     in  the  matrimonial  home,  Subair   her<\/p>\n<p>brother came      and took her to her house and<\/p>\n<p>thereafter, none of the petitioners had seen<\/p>\n<p>her or made any enquiry. In paragraph 5,     it is<\/p>\n<p>alleged that during the       first week of 2004,<\/p>\n<p>first accused the husband       returned from Gulf<\/p>\n<p>and    pursuant   to a mediation, under the belief<\/p>\n<p>that she could live         happily there, second<\/p>\n<p>respondent had gone with the first petitioner<\/p>\n<p>to their house and though she stayed there for<\/p>\n<p>some     days,  she  experienced  cruelty  and the<\/p>\n<p>first accused had gone to Gulf and she was<\/p>\n<p>sent to her house. It is specifically alleged<\/p>\n<p>that for more than three years, earlir to the<\/p>\n<p>Crmc 3915\/09<br \/>\n<span class=\"hidden_text\">                         5<\/span><\/p>\n<p>filing of the complaint there was no enquiry<\/p>\n<p>from     the petitioners.   The  said  allegation<\/p>\n<p>itself establishes that,      even if there was<\/p>\n<p>any cruelty by the petitioners, it was either<\/p>\n<p>before the first of 2003 or some days during 1st<\/p>\n<p>of 2004. As provided under Section 468 of Code<\/p>\n<p>of     Criminal  Procedure,   when  the   maximum<\/p>\n<p>sentence provided for an offence under Section<\/p>\n<p>498 A is      imprisonment for three years,   the<\/p>\n<p>period of limitation is three years.    Annexure-<\/p>\n<p>A3 final report does     not show any reason  for<\/p>\n<p>condoning     the delay. Report of the    learned<\/p>\n<p>Magistrate    also   shows  that  there  was   no<\/p>\n<p>petition      showing the reason for the delay or<\/p>\n<p>any order to condone the delay, before taking<\/p>\n<p>cognizance as provided under Section 473 of<\/p>\n<p>Code       of  Criminal   Procedure.   In    such<\/p>\n<p>circumstances,    cognizance  taken  against  the<\/p>\n<p>Crmc 3915\/09<br \/>\n<span class=\"hidden_text\">                           6<\/span><\/p>\n<p>petitioners      could only be quashed.<\/p>\n<p>            Petition is allowed.
