DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 and 227 of the Constitution of India is<br \/>\nfiled against the interlocutory order dated 24.8.2009 passed by<br \/>\nlearned Additional Senior Civil Judge and Judicial Magistrate First<br \/>\nClass, Patan, by which, request of the petitioner to accept certain<br \/>\ndocuments in the proceedings, came to be rejected.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate for the petitioner submits that by Exh.42 list, the<br \/>\npetitioner had submitted relevant documents and certified copies of<br \/>\nsuch documents.  Not only that but it was referred to in the<br \/>\ndeposition of defendant at Exh.54 and, therefore, the same was to be<br \/>\naccepted.  Besides, the order passed by the Court below is devoid of<br \/>\nreasonings and as per law laid down by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/819853\/\">Bipin Shantilal Panchal vs. State of Gujarat<\/a> [(2001) 3 SCC 1],<br \/>\nthe court could have tentatively marked those documents and could<br \/>\nhave considered at a later stage.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the respondent submits that above documents are not<br \/>\nrelevant or important and the order passed by the trial court do not<br \/>\ndeserve any interference by this Court.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned advocates for the parties, considering facts and<br \/>\ncircumstances of the case, the order impugned passed by the learned<br \/>\nAdditional Senior Civil Judge and Judicial Magistrate First Class,<br \/>\nPatan cannot be said to be contrary to law in any manner or resulting<br \/>\ninto the grave injustice or gross failure of justice.  The decision<br \/>\nof <a href=\"\/doc\/819853\/\">Bipin Shantilal Panchal vs. State of Gujarat<\/a> (supra) relied<br \/>\nis not applicable in the facts of this case inasmuch as, the above<br \/>\nprocedure as laid down by the Apex court is to be adopted in a case<br \/>\nwere objection is raised by other party and only when court finds it<br \/>\nnecessary to defer such objection so as to avoid delay in the<br \/>\nproceedings.  In the facts of this case, the learned Judge has found<br \/>\nno substance in the application preferred by the petitioner and,<br \/>\ntherefore, no interference is called for.\n<\/p>\n<p>5.\tMere<br \/>\nerrors of fact or law as committed by the trial court not resulting<br \/>\ninto grave injustice to the party, do not require any interference in<br \/>\nexercise of extraordinary jurisdiction under Article 226 and 227 of<br \/>\nthe Constitution of India.\n<\/p>\n<p>6.\tPetition<br \/>\nis, therefore, rejected.  Notice discharged.  Interim relief stands<br \/>\nvacated.\n<\/p>\n<p>[ANANT<br \/>\nS.
