Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/03\/2010\n\n O R D E R\n             M.SASIDHARAN NAMBIAR,J.\n\n        ---------------------------------------------------------\n        CRL.M.C.NO.1025 &amp; 1026 OF 2010\n        --------------------------------------------------------\n               Dated        29th       March 2010\n\n\n                             O R D E R\n<\/pre>\n<p>            Petitioners                 in Crl.M.C.1025\/2010<\/p>\n<p>are  the    accused             in       C.C.644\/2006                and<\/p>\n<p>petitioners       in       Crl.M.C.1026\/2010                     is  the<\/p>\n<p>accused  in       C.C.13\/2008                on       the        file of<\/p>\n<p>Judicial First Class Magistrate&#8217;s court,<\/p>\n<p>Thiruvalla.           C.C.644\/2006                      was         taken<\/p>\n<p>cognizance for the offence under Sections<\/p>\n<p>20 and 21 of Kerala Protection of River<\/p>\n<p>Banks and Regulation of Removal of sand<\/p>\n<p>Act, 2001     and Rule 58 (1) of Kerala Minor<\/p>\n<p>Mineral Concession                    Rules on Annexure-A<\/p>\n<p>final report submitted by Sub Inspector of<\/p>\n<p>police,      Keezhvaypur                    police               station.<\/p>\n<p>C.C.13\/2008 was               taken cognizance by the<\/p>\n<p>learned Magistrate                    on Annexure-A final<\/p>\n<p>Crmc 1025 &amp; 1026\/10<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>report submitted by Additional Sub Inspector<\/p>\n<p>of Police, Thiruvalla police station for the<\/p>\n<p>offence under Sections        20 and 21 of Kerala<\/p>\n<p>Protection of River Banks and Regulation of<\/p>\n<p>Removal of sand Act, 2001. Petitions are<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure        to  quash  the cognizance  taken<\/p>\n<p>contending that in view of Section 25     of the<\/p>\n<p>Act       cognizance could have been taken only<\/p>\n<p>on a complaint filed by an officer authorized<\/p>\n<p>by    the     Act   and  not  on a  final report<\/p>\n<p>submitted         by the  police  and  therefore,<\/p>\n<p>cognizance taken are to be quashed.<\/p>\n<p>            2. Learned counsel appearing for the<\/p>\n<p>petitioners        and learned  Public Prosecutor<\/p>\n<p>were heard.\n<\/p>\n<p>            3. Cognizance in both the cases were<\/p>\n<p>taken on the final reports submitted under<\/p>\n<p>Crmc 1025 &amp; 1026\/10<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>Section 173(2) of        Code of Criminal Procedure<\/p>\n<p>by the police officer after investigation.<\/p>\n<p>Section 25 of the Act mandates that no court<\/p>\n<p>shall take cognizance of an offence         except<\/p>\n<p>on    a     complaint    filed     by  an  officer<\/p>\n<p>authorized         under the Act. As held by  this<\/p>\n<p>court in        <a href=\"\/doc\/429259\/\">Sherif and others v. Sub Inspector<\/p>\n<p>of Police, Konni and<\/a> another (2010 (1) KLD<\/p>\n<p>109) following the Division Bench decision in<\/p>\n<p><a href=\"\/doc\/272915\/\">Moosakoya v. State of Kerala<\/a> (2008 (1) KLT<\/p>\n<p>538),       approved    by   the  Apex   court  in<\/p>\n<p>Jeevankumar         Raut  v.  Central   Bureau   of<\/p>\n<p>Investigation (AIR 2009 SC 2763), cognizance<\/p>\n<p>could not have been taken by the learned<\/p>\n<p>Magistrate except on a complaint filed by an<\/p>\n<p>officer       authorized   under  the  Act.  Hence<\/p>\n<p>cognizance taken is bad and can only be<\/p>\n<p>quashed.\n<\/p>\n<p>Crmc 1025 &amp; 1026\/10<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>            Petitions   are   allowed.  Cognizance<\/p>\n<p>taken by Judicial First Class Magistrate,<\/p>\n<p>Thiruvalla in C.C.644\/2006 and C.C.13\/2008<\/p>\n<p>are quashed.
