SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 11\/10\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\tBy<br \/>\nway of filing this appeal, the appellant has challenged the order<br \/>\ndated 19th April<br \/>\n2011 passed by the learned Single Judge in Special<br \/>\nCivil Application No.4467 of 2011 vide which the learned Single Judge<br \/>\nrejected the writ petition on the ground that the same is not<br \/>\nmaintainable in law as the learned Single Judge had already dismissed<br \/>\nearlier writ petition being Special Civil Application No.7439 of<br \/>\n2010.\n<\/p>\n<p><span class=\"hidden_text\">2\t<\/span><\/p>\n<p>The case of the appellant &#8211; original petitioner is that the<br \/>\npetitioner was appointed by the respondent-Board during the period<br \/>\nbetween 13th<br \/>\nOctober 1982 to 01st<br \/>\nJuly 1990. Thereafter, on 07th<br \/>\nSeptember 2005, he was retrenched by the respondent-Board without<br \/>\nfollowing due procedure under the law. Against the said action, the<br \/>\npetitioner raised a dispute culminated into aforesaid Reference<br \/>\nCases, which ultimately came to be rejected by the Labour Court.\n<\/p>\n<p>3\tThe<br \/>\npetitioner along with other workmen challenged the said judgment and<br \/>\naward of the Labour Court by filing Special Civil Application No.7439<br \/>\nof 2010 before the learned Single Judge, which was rejected vide<br \/>\norder dated 8th July 2010.    The petitioner, instead of<br \/>\nfiling appeal against the same, preferred Special Civil Application<br \/>\nNo.4467 of 2011 before the learned Single Judge again, who rejected<br \/>\nthe same on the ground that the successive writ petition is not<br \/>\nmaintainable.   Hence, the present appeal.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the appellant and perused the record.\n<\/p>\n<p>5.\tIt<br \/>\nis pertinent to note that the Labour Court while considering the<br \/>\nevidence on record has categorically observed that the petitioner has<br \/>\naccepted the amount of notice pay, retrenchment compensation as well<br \/>\nas gratuity. Further, the Labour Court has after taking into<br \/>\nconsideration the pros and cons of the matter has observed that the<br \/>\npetitioner was part-time employee and no other person after<br \/>\nretrenchment of the petitioner, has been retained by the respondents.<br \/>\nThus, there is no breach of provisions of Sections 25(F), 25(G) and<br \/>\n25(H) of the Industrial Disputes Act, 1947.   Having regard to the<br \/>\ncontentions raised by the learned counsel for the petitioner,  this<br \/>\nCourt is of the opinion that the impugned judgment and award passed<br \/>\nby the Labour Court is just and proper and the learned Single Judge<br \/>\nhas rightly rejected the same.  No interference is warranted by this<br \/>\nCourt in this appeal.  The appeal is devoid of any merits.
