Justice P.R.RAMACHANDRA MENON\n\n Dated :22\/01\/2010\n\n O R D E R\n               P.R.RAMACHANDRA MENON, J.\n                       -------------------------\n                   W.P (C) No.37279 of 2009\n                       --------------------------\n              Dated this the 22nd January, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>           Petitioner&#8217;s father had availed a financial<\/p>\n<p>facility from the respondent Bank.          But because of the<\/p>\n<p>serious ailments he could not honour the commitment in<\/p>\n<p>repaying the due amount and bid for farewell to this world.<\/p>\n<p>The petitioner approached the 2nd respondent Bank and<\/p>\n<p>requested the benefit of &#8216;One Time Settlement Scheme&#8217; so<\/p>\n<p>as to enable him to wipe off the entire liability. It is seen<\/p>\n<p>from the admitted pleadings and proceedings, that the<\/p>\n<p>Bank had granted the benefit of &#8216;OTS&#8217; directing the<\/p>\n<p>petitioner to satisfy a total sum of Rs.28 lakhs, to be paid<\/p>\n<p>within two months.      The said stipulation could not be<\/p>\n<p>satisfied by the petitioner due to some or other reason and<\/p>\n<p>the benefit of &#8216;OTS&#8217; was withdrawn and the Bank<\/p>\n<p>proceeded with further steps under the SARFEASI Act,<\/p>\n<p>which are under challenge in this Writ Petition.<\/p>\n<p>      2.   Learned counsel appearing for the respondent<\/p>\n<p>Bank, with reference to the counter affidavit filed, submits<\/p>\n<p>W.P (C) No.37279 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>that the claim of the petitioner for OTS has already been<\/p>\n<p>considered and rejected. This issue is no more alive. More<\/p>\n<p>so, there is no scheme for OTS as on date.<\/p>\n<p>     3.     Learned counsel for the petitioner submits that<\/p>\n<p>the petitioner has taken earnest efforts to tap          other<\/p>\n<p>sources to generate funds and to clear the entire liability,<\/p>\n<p>for which some breathing time is sought for.<\/p>\n<p>     4.     It is also stated that the entire liability to the<\/p>\n<p>Bank will be cleared on or before 31st of March, 2010 and<\/p>\n<p>that the petitioner might be permitted to approach the<\/p>\n<p>Bank for availing concessions to the possible extent.<\/p>\n<p>     5.     Considering the facts and circumstances, the<\/p>\n<p>Writ Petition is disposed of directing the petitioner to clear<\/p>\n<p>the entire liability under the loan transaction on or before<\/p>\n<p>the 31st of March, 2010. This will be without prejudice to<\/p>\n<p>the right of the petitioner to approach the Bank for availing<\/p>\n<p>the concessions, if any,     which of course will be at the<\/p>\n<p>hands of the respondent Bank to be considered and given<\/p>\n<p>effect to the permissible limit.\n<\/p>\n<p>W.P (C) No.37279 of 2009<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>     Subject to the above, the coercive proceedings stated<\/p>\n<p>as being pursued against the petitioner shall be kept in<\/p>\n<p>abeyance.
