Justice K.T.SANKARAN\n\n Dated :19\/10\/2009\n\n O R D E R\n                       K.T.SANKARAN, J.\n                 ---------------------------------------------\n                        B.A.No.5558 of 2009\n                 ---------------------------------------------\n            Dated this the 19th day of October, 2009\n\n\n\n                              ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure.                       The petitioner is<\/p>\n<p>accused No.5 in Crime No.414 of 2009 of Kollam West Police<\/p>\n<p>Station.\n<\/p>\n<p>     2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 420, 468, 471 and 472 of the Indian Penal Code and<\/p>\n<p>Section 12(1)(b) of the Indian Passport Act.<\/p>\n<p>     3.   When the Bail Application came up for hearing on<\/p>\n<p>5.10.2009, the following order was passed:<\/p>\n<blockquote><p>                   &#8220;After having heard the learned counsel<\/p>\n<p>          for the petitioner            and the learned Public<\/p>\n<p>          Prosecutor, I am of the view that before disposing<\/p>\n<p>          of the Bail Application, an opportunity should be<\/p>\n<p>          given to the petitioner to appear before the<\/p>\n<p>          investigating officer. Accordingly, there will be a<\/p>\n<p>          direction to the petitioner to appear before the<\/p>\n<p>          investigating officer at 9 AM on 12th and 13th<\/p>\n<p>          October, 2009.\n<\/p><\/blockquote>\n<blockquote><p>                Post on 19.10.2009.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">BA No.5558\/2009                   2<\/span><\/p>\n<p>                 It is submitted by the learned Public<\/p>\n<p>            Prosecutor that the petitioner        will not be<\/p>\n<p>            arrested until further orders in connection with<\/p>\n<p>            Crime No.414 of 2009 Kollam West Police<\/p>\n<p>            Station.&#8221;<\/p><\/blockquote>\n<p>     4.     The learned counsel for the petitioner and the learned<\/p>\n<p>Public Prosecutor submitted that the petitioner has complied<\/p>\n<p>with the direction.\n<\/p>\n<p>     5.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>     There will be a direction that in the event of the arrest of<\/p>\n<p>the petitioner, the officer in charge of the police station shall<\/p>\n<p>release him on bail on his executing bond for Rs.25,000\/- with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p>a)   The petitioner shall report before the investigating officer<br \/>\n     between 9 A.M.      and 11 A.M. on alternate Mondays, till<br \/>\n     the final report is filed or until further orders;<\/p>\n<p>b)   The petitioner shall appear before the investigating officer<br \/>\n     for interrogation as and when required;<\/p>\n<p>c)   The petitioner shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;<\/p>\n<p><span class=\"hidden_text\">BA No.5558\/2009                   3<\/span><\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed to the extent indicated<\/p>\n<p>above.\n<\/p>\n<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                  JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Edward Aged 46 Years vs State Of Kerala on 19 October, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5558 of 2009() 1.
